Se’if 1א׳
אחים או שותפי' או בכור שבאי' לחלוק. ובו ה סעיפים: האחין או השותפין שבאו לחלוק השדה וליטול כל אחד חלקו אם היתה כולה שוה לגמרי חולקין לפי המדה בלבד ואם אמר א' תנו לי חלקי מצד זה כדי שיהא סמוך לשד' אחר שלי ויהיה הכל שדה א' שומעין לו וכופה אותו על זה שעיכוב בדבר זה מדת סדום היא (וי"א דאין שומעין לו אלא צריך להעלות בדמים עד שיתרצו חביריו) (טור בשם הרא"ש) ויש אומרים דהוי ספק וכל דאלים גבר (מרדכי סוף פ"ק דב"ב בשם מהר"ם) אבל אם היה חלק ממנה טוב או קרוב לנהר יותר או קרוב לדרך ושמו אותה היפה כנגד הרע ואמר תנו לי בשומא שלי מצד זה אין שומעין לו אלא נוטל בגורל אמר להם תנו בשומא שלי מצד זה חצי מדתה מהצד הרע וטול אתה מהצד הטוב כדי שיהא חלקי סמוך לשדה שלי שומעין לו: הגה היו בכאן שני שדות האחד אומר לחלוק כל שדה ושדה והאחד אומר לחלוק שדה כנגד שדה שומעין לזה שאומר לחלוק שדה כנגד שדה ודוקא ששתיהן שוות ואין נפקותא בחלוקת השדות לחצאין אבל אם האחד טובה בשום צד או שאחד יש לו מצר אצל השדות חולקין כל שדה לשנים (טור ס"ג):
Brothers or partners or a firstborn who come to divide; it contains five se'ifim. Brothers or partners who came to divide the field, each one to take his share: if it was all entirely equal, they divide by measure alone. And if one said: give me my share on this side, so that it should be next to another field of mine and the whole be one field — they listen to him, and he compels him to this, for holding back in such a thing is the trait of Sodom (and some say that they do not listen to him, but he must make it up in money until his fellows are content) (Tur in the name of the Rosh); and some say that it is a doubt, and whoever is stronger prevails (Mordechai, end of the first chapter of Bava Batra, in the name of the Maharam). But if part of it was good, or nearer to the river, or near the road, and they appraised the good against the bad, and he said: give me my appraised share on this side — they do not listen to him, but he takes by lot. If he said to them: give me, for my appraised share, half its measure on this side from the bad side, and you take from the good side, so that my share should be next to my field — they listen to him. Hagah [Rema]: If there were two fields here, and one says to divide each field and the other says to divide field against field, they listen to the one who says to divide field against field; and specifically where both are equal and nothing turns on dividing the fields in halves. But if one is better in any respect, or one of them has a boundary beside the fields, they divide each field in two (Tur, se'if 3).
Se’if 2ב׳
הבכור שחלק נוטל ב' חלקים שלו כאחד אבל היבם שחלק עם אחיו בנכסי האב נוטל חלקו וחלק אחיו בגורל אם עלו במקום א' עלו ואם עלו בב' מקומות עלו: הגה וי"א דדוקא שהיו החלקים שווים אבל אם היה אחד טוב מחבירו אפי' בכור אינו נוטל חלקו ביחד וכן אם היה לפשוט שדה במצר אלו השדות (טור והרא"ש והמגיד פי"ב דשכנים בשם שאר מפרשים):
The firstborn who divided takes his two shares together. But the yavam (the brother who took his dead brother's childless widow) who divided with his brothers in the father's property takes his share and his brother's share by lot: if they came up in one place, they came up; and if they came up in two places, they came up. Hagah [Rema]: And some say that this is specifically where the shares were equal; but if one was better than the other, even a firstborn does not take his share together. And likewise if an ordinary son had a field on the boundary of these fields (Tur and the Rosh, and the Maggid, chapter 12 of the Laws of Neighbours, in the name of the other commentators).
Se’if 3ג׳
ארץ מרובעת שהיה הנהר מקיף לה מזרח וצפון והדרך דרום ומערב חולקין אות' באלכסון כדי שיגיע לזה נהר ודרך ולזה נהר ודרך ואם אמר תנו לי החצי שמצד זה שהוא בצד שדי שומעין לו כללו של דבר כל דבר שהוא טוב לזה ואין על חבירו הפסד כלל כופין אותו לעשות:
A square piece of land that the river surrounded on the east and the north, and the road on the south and the west — they divide it diagonally, so that this one gets river and road and that one gets river and road. And if he said: give me the half that is on this side, which is beside my field — they listen to him. The rule of the matter: anything that is good for this one, and there is no loss at all to his fellow, they compel him to do.
