Se’if 1א׳
שותפים או אחים שרצו לחלוק דבר שאין בו דין חלוקה וחלוקת ספרים ושאין להם חזקה זה על זה. ובו ד סעיפים: השותפין שרצו לחלוק דבר שאין בו דין חלוקה אע"פ שהם מפסידין את שמו חולקין ובכתבי הקדש דהיינו כ"ד ספרים שהם כתובים בגליון כספר תורה שלנו אם הם בכרך אחד אין חולקין (שהוא בזיון לספרים לחלקן מכרך אחד (טור) אע"פ שאם היו של אחד מותר לחתכן) (הגהות אשיר"י) ואם הם בשתי כריכות אם הם שני ענינים אין בו דינא דגוד או אגוד ואם הם ענין א' אומרים בו גוד או אגוד (וע' לעיל סי' קע"א סעיף י"ג):
Partners or brothers who wished to divide a thing to which the law of division does not apply; the division of books; and that they have no presumptive right against one another; it contains four se'ifim. Partners who wished to divide a thing to which the law of division does not apply divide, even though they destroy its name. And the Holy Writings — that is, the twenty-four books, which are written on one scroll like our Torah scroll — if they are in one volume, they do not divide them (for it is a disgrace to the books to divide them out of one volume (Tur), even though, had they belonged to one person, it would be permitted to cut them) (Hagahot Asheri). And if they are in two bindings: if they are two subjects, the law of god o agod (either you buy my share or you sell me yours, at the price named) does not apply to them; and if they are one subject, god o agod is said of them (and see above, siman 171, se'if 13).

אם חלקו בגורל לאחר שעלה הגורל לא' מהם נתקיימה החלוקה לכולם: הגה מיהו הרא"ש כתב (בתשובה והביאו הטור) דאין הגורל קונה רק מברר החלקים ואם החזיק אחד בחלקו החלוקה קיימת וע"ל סי' קנ"ז סעיף ב':
If they divided by lot, once the lot has come up for one of them, the division is established for all of them. Hagah [Rema]: However, the Rosh wrote (in a responsum, and the Tur brought it) that the lot does not acquire but only makes the shares clear; and if one of them took possession of his share, the division stands. And see above, siman 157, se'if 2.

האחים שחלקו הרי הם כלקוחות זה מזה ואין להם זה על זה דרך ולא סולמות ולא חלונות ולא אמת המים שכיון שחלקו לא נשאר לא' מהם זכות בחלק חבירו אע"פ שהיה מקודם וה"ה לשנים שקנו שדה כא' וחלקו לא נשאר לא' מהם זכות בחלק חבירו אבל ב' שקנו שדה משני אנשים או משני אחים כשהיה נודע חלק כל אחד והיו מחזיקים בנזקים אלו אין לא' מהם להפסיק אמת המים ולא לשנות דבר מהנזקים שהחזיקו בהם המוכרים: הגה שנים שחלקו חצר ונשאר באר מים חיים בחלק א' מהן ונשאר רשות לשני לשמש בו ונתקלקל הבאר על שניהן לתקנו ואם נפל אזלא חזקת הב' לענין הזה דאין לו עוד דרך לשאוב משם אבל מקום הבאר לשניהם אבל אם חלקו ונשאר הבאר מתחלה לאחד בלבד (אלא) שנתן רשות לשני לשאוב משם אם נפל אזלא חזקתו לגמרי ואין לו עוד חלק בבאר אפי' חזר ותקנו (ב"י בשם הרשב"א):
Brothers who divided are as purchasers from one another, and they have against one another no way, nor ladders, nor windows, nor water channel; for since they divided, none of them has any right left in his fellow's share, even though he had one before. And the same holds for two who bought a field as one and divided: none of them has any right left in his fellow's share. But two who bought a field from two men or from two brothers, when each one's share was known and they held a presumptive right over these damages — neither of them may cut off the water channel, nor change anything of the damages over which the sellers held a presumptive right. Hagah [Rema]: Two who divided a courtyard, and a well of living water remained in the share of one of them, and the second was left with permission to use it: if the well was spoiled, it is on both of them to repair it; and if it collapsed, the second's presumptive right is gone as to this, that he no longer has a way to draw from there, but the place of the well belongs to both of them. But if they divided and the well remained from the outset to one alone, (only) that he gave the second permission to draw from there — if it collapsed, his presumptive right is gone entirely, and he has no further share in the well, even if he went back and repaired it (Beit Yosef in the name of the Rashba).
