בית או חצר איך נותנים ד"א ודין הזבל שבחצר ונתינת האכסניא. ובו ט סעיפים: חצר המתחלקת נותן לכל פתח ד' אמות והשאר חולקי' בשוה שכל פתח צריך לפניו ד' אמות לתוך החצר ואפי' שהפתח רחב הרבה נוטל ד"א על פני כל רחבו לתוך אויר החצר ואם אין הפתח רחב ד' משלים עליו מהצדדים ד' כדי שיהיה לו ד' על ד' ואם יש לא' פתוח לחצר בית שיש לו ב' פתחים ולשני בית שאין לו אלא פתח א' אותו שיש לו ב' פתחים נוטל לכל פתח ארבע אמות כפי מה שהם פתחיו ובעל הפתח אחד אין לו אלא ד' אמות לפני פתחו בד"א בשנים שקנו מההפקר כגון שבנו במקום הפקר זה בנה לו בית ופתח בו ב' פתחים וזה בנה לו בית ופתח בו פתח אחד ואח"כ הקיפו אותם עד שנעשה להם לחצר: הגה וי"א דהוא הדין אם חלק נכסיו על פיו ונתן לאחד מבניו בית עם שני פתחים ולאחד עם פתח אחד (טור ס"ג בשם רש"י ור"ת) אבל שנים שקנו או שירשו קנו וירשו בשוה חלק כחלק בין בבתים בין בחצר ולא יטול האחד יותר מחבירו כלום ואפי' אם קדמו וחלקו הבתים קודם חלוקת החצר לא אמרינן אותו שעלה לחלקו הבית שיש לו שני פתחים זכה בד' אמות החצר לכל אחד מפתחיו אלא חולקים בשוה:

A house or a courtyard: how they give four cubits; the law of the dung in the courtyard and of the giving of lodging; it contains nine se'ifim. A courtyard that is being divided: he gives each doorway four cubits, and they divide the rest equally; for every doorway needs four cubits before it into the courtyard. And even if the doorway is very wide, he takes four cubits along its whole width into the air-space of the courtyard; and if the doorway is not four wide, he completes it to four from the sides, so that he should have four by four. And if one of them has, opening onto the courtyard, a house that has two doorways, and the other a house that has only one doorway, the one who has two doorways takes four cubits for each doorway, according to the doorways he has, and the owner of the one doorway has only four cubits before his doorway. When is this said? With two who acquired from what was ownerless — for example, they built in an ownerless place: this one built himself a house and opened two doorways in it, and that one built himself a house and opened one doorway in it, and afterwards they enclosed them until it became a courtyard for them. Hagah [Rema]: And some say that the same applies if he divided his property by his own word and gave one of his sons a house with two doorways and another one with one doorway (Tur, se'if 3, in the name of Rashi and Rabbeinu Tam). But two who bought or who inherited bought and inherited equally, share for share, both in the houses and in the courtyard, and the one takes nothing at all more than his fellow; and even if they first divided the houses before the division of the courtyard, we do not say that the one to whose share came the house that has two doorways acquired four cubits of the courtyard for each of its doorways; rather, they divide equally.

בד"א כששני הבתים שוים וחלקו בית כנגד בית ולא הוצרכו לשום אותם ולהעלות בדמים אבל אם אינם שוים ושמו אותם והעלום בדמים ואותו שהגיע לחלקו הבית שיש בו שני פתחים נתן לחבירו הדמים ששוה יותר על שלו בכלל זה העילוי ג"כ ד' אמות שבחצר וזכה בהם כמו שזכה במה שביתו שוה יותר משל האחר אע"פ שבעוד שלא חלקו לא היו הד' אמות שלו לגמרי אלא לפרק בו משאו וחבירו היה משתמש בו ג"כ כשהיה מוצא אותם פנויים עתה שחלקו הם שלו לגמרי: הגה וכל זה מיירי בסתם חצירות אבל חצר שיש לכל אחד חלק ידוע כל אחד אינו נוטל אלא כפי מה שיש לו ואם מגיע לכל אחד לפני ביתו ד' אמות על ד' אמות חולקין בין אם יש לבית פתחים הרבה או לא (טור):

When is this said? When the two houses are equal and they divided house against house, and did not need to appraise them and make up the difference in money. But if they are not equal, and they appraised them and made up the difference in money, and the one to whose share came the house that has two doorways gave his fellow the money by which it is worth more than his, the four cubits in the courtyard are also included in this surplus, and he has acquired them just as he acquired that by which his house is worth more than the other's — even though, while they had not yet divided, the four cubits were not wholly his, but only for unloading his burden there, and his fellow too used them when he found them free; now that they have divided, they are wholly his. Hagah [Rema]: And all this speaks of ordinary courtyards; but a courtyard in which each one has a known share — each one takes only according to what he has; and if each one's share comes to four cubits by four cubits before his house, they divide, whether the house has many doorways or not (Tur).

Se’if 3ג׳

בית שיש לו פתחים רבים מכל רוחותיו יש לו ארבע אמות לכל רוח ואם ייחד לו פתח אין לו אלא ארבע אמות כנגד פתחו:

A house that has many doorways on all its sides has four cubits for each side; and if he designated one doorway for it, it has only four cubits opposite its doorway.
