איזה דבר שהשותפין כופין זה את זה לחלוק וכל דיניו. ובו יז סעיפים: אחד הקונה מחבירו חצי שדהו או שנים שקנו מאחד שדה או שירשו או שניתן להם במתנה או שהחזיקו בו מההפקר וביקש אחד מהשותפין לחלוק וליטול חלקו לבדו אם יש באותו קרקע דין חלוקה כופה את שאר השותפין וחולקין עמו ואם אין בו דין חלוקה אין אחד מהם יכול לכוף את חבירו לחלוק וכן הדין במטלטלין: הגה ואם היה בו דין חלוקה וקבלו קנין שלא לחלוק אינן יכולין לחזור בהן (תשו' רשב"א סי' תתק"ז) ראובן ושמעון שיש להן מקומות בבית הכנסת זה אצל זה וראובן רוצה לעשות מחיצה ביניהם ולהכניס המחיצה בתוך שלו ושמעון רוצה לעכב באמרו שאם יעשה מחיצה המקום יהיה דחוק הדין עם ראובן (ב"י סי' קנ"ז בשם הרשב"א והרא"ש כלל ה' סי' ג') וכן רבים היושבים על ספסל אחד בבית הכנסת והיושב בראש רוצה להוסיף עוד מקום אחד אצל מקומו והיושב אצלו רוצה למחות באמרו שעכשיו הוא שני אצל הראש ואם יוסיף יהיה שלישי הדין עמו ויכול למחות (הרא"ש כלל ה' סי' ד') וע' לעיל סי' קס"ב ס"ז מדיני מקומות בבית הכנסת:
What partners compel one another to divide, and all its laws; it contains seventeen se'ifim. One who buys half his field from his fellow, or two who bought a field from one, or who inherited, or to whom it was given as a gift, or who took possession of it from ownerless property, and one of the partners asked to divide and take his share alone: if that land is subject to the law of division, he compels the other partners, and they divide with him; and if it is not subject to the law of division, none of them can compel his fellow to divide. And so is the law with movables. Hagah [Rema]: And if it was subject to the law of division, and they took upon themselves a kinyan (a formal act of acquisition) not to divide, they cannot retract (Responsa of the Rashba, siman 907). Reuven and Shimon, who have places in the synagogue beside each other, and Reuven wants to make a partition between them and put the partition within his own, and Shimon wants to prevent it, saying that if he makes a partition the place will be cramped — the law is with Reuven (Beit Yosef, siman 157, in the name of the Rashba, and the Rosh, klal 5, siman 3). And likewise many who sit on one bench in the synagogue, and the one who sits at the head wants to add another place beside his place, and the one who sits beside him wants to protest, saying that now he is second beside the head, and if he adds he will be third — the law is with him, and he may protest (the Rosh, klal 5, siman 4). בד"א כשאין א' מהם מכיר את חלקו במקום שהם שותפין בו אלא יד כולם משתמשת בכל מקום אבל אם היה א' מכיר חלקו אע"פ שאין בו דין חלוקה כופה כל אחד מהם את חבירו להבדיל בין חלקו לחלק חבירו כדי שלא יזיקו זה את זה בראיה:
When is this said? When none of them recognises his share in the place in which they are partners, but the hand of all of them uses every place; but if each recognised his share, even though it is not subject to the law of division, each of them compels his fellow to separate between his share and his fellow's share, so that they should not damage one another by sight.

איזהו דין חלוקה כל שאלו יחלק לפי השותפים יגיע לפחות שבהם חלק ששם הכל קרוי עליו אבל אם אין שם הכל קרוי על החלק אין בו דין חלוקה כיצד כל חצר שאין בה ד"א על ד"א מרובעות חוץ מד' אמות של הפתחים אינה קרויה חצר וכל שדה שאין בה כדי זריעת ט' קבין אינה קרויה שדה וכל גנה שאין בה כדי זריעת חצי קב אינה קרויה גנה וכל פרדס שאין בה כדי זריעת ג' קבין אינה קרויה פרדס לפיכך אין חולקין את החצר עד שיהא בה ד' אמות לכל א' וא' מהשותפין ולא את השדה עד שיהא בו זריעת ט' קבין לכל אחד ולא הגנה עד שיהא בה חצי קב לכל א' וא' (ולא את הפרדס עד שיהא בו בית ג' קבין לכל אחד ואחד) בד"א בא"י וכיוצא בה אבל בבבל וכיוצא בה אין חולקין את השדה עד שיהא בה כדי חרישת יום לזה וכדי חרישת יום לזה ולא את הפרדס עד שיהא בה ל"ו אילנות לזה ול"ו אילנות לזה כדי עבודת אדם א' ביום א' ושדה שמשקים אותה בכלי עד שיהא בה כדי שימלא הפועל יום א' לזה ויום א' לזה: הגה היה בו דין חלוקה ומכר א' מהן לשנים או הורישו לב' בניו ואין לאחד מהן כדי חלוקה אינן יכולין לעכב מלחלוק דלא עדיפי מגברא דאתו מחמתיה (מרדכי ס"פ השואל וסוף כתובות בשם מהר"מ וטור סי' קע"ד) היו ד' שותפין ביחד לב' יש להן שיעור חלוקה ולב' אין להן שיעור חלוקה הב' שיש להן חלוקה נוטלין חלקן והב' האחרים נשארו שותפין ואפי' אמר אחד מאותן שאין בו כדי חלוקה תנו לי ג"כ חלקי וא"כ ישאר לרביעי פחות מכדי חלוקה וכדי לבטל החלוקה אמר כן אין שומעין לו (תשובת מיי' דקנין סי' י"ד) שלשה שהיו שותפין בבית לשנים היה להן כדי חלוקה ולאחר אין בו כדי חלוקה וקנה א' מן השנים חלקו של האחד שאין לו כדי חלוקה אין יכול לבטל החלוקה אע"פ שהמוכר היה יכול לבטלה (שם מרדכי סוף כתובות):
What is the law of division? Wherever, if it were divided according to the partners, there would come to the least of them a share to which the name of the whole applies. But if the name of the whole does not apply to the share, it is not subject to the law of division. How so? Any courtyard that does not have four cubits by four cubits square, apart from the four cubits of the doorways, is not called a courtyard; and any field that does not have enough for sowing nine kav is not called a field; and any garden that does not have enough for sowing half a kav is not called a garden; and any orchard that does not have enough for sowing three kav is not called an orchard. Therefore they do not divide the courtyard until it has four cubits for each of the partners, nor the field until it has the sowing of nine kav for each, nor the garden until it has half a kav for each (nor the orchard until it has an area of three kav for each). When is this said? In the Land of Israel and places like it; but in Babylonia and places like it, they do not divide the field until it has enough for a day's ploughing for this one and a day's ploughing for that one; nor the orchard until it has thirty-six trees for this one and thirty-six trees for that one, the work of one man in one day; and a field that is watered with a vessel, until it has enough for the worker to fill for one day for this one and one day for that one. Hagah [Rema]: If it was subject to the law of division, and one of them sold to two, or left it to his two sons, and neither of them has enough for division, they cannot prevent the dividing, for they are no better than the man on whose strength they come (Mordechai, end of chapter "One who borrows", and end of Ketubot, in the name of the Maharam, and Tur, siman 174). If there were four partners together — two have the measure of division and two do not have the measure of division — the two who have division take their share, and the other two remain partners; and even if one of those who do not have enough for division said: give me my share too, so that there will remain to the fourth less than enough for division, and he said so in order to cancel the division, they do not listen to him (Teshuvot Maimoniyot, Kinyan, siman 14). Three who were partners in a house — two had enough for division and the other did not have enough for division — and one of the two bought the share of the one who does not have enough for division: he cannot cancel the division, even though the seller could have cancelled it (there; Mordechai, end of Ketubot).
