Se’if 1א׳

שטף נהר את זיתיו והמוכר זיתיו לעצים. ובו ב סעיפים: שטף הנהר זיתיו ושתלן בתוך שדה חבירו ואמר הלה זיתי אני נוטל אין שומעין לו בארץ ישראל משום יישוב הארץ אלא יעמדו במקומם ואם עקרן הנהר בגושיהם (בענין שראויים להתקיים על ידן) (טור) יחלקו הפירות בעל השדה עם בעל (הזתים) כל שלשה שנים ולאחר שלשה שנים הכל לבעל השדה אלא שצריך ליתן לבעל הזיתים דמי הזיתים כמו שהיו שוים מתחלה כששטפן הנהר ואם לא נעקרם בגושיהן הכל לבעל הקרקע מיד ואם בא בעל הזיתים ליטול זיתיו בין תוך שלשה בין לאחר שלשה הרשות בידו בחוצה לארץ אבל בארץ ישראל אין שומעין לו וזה נותן לו דמי זיתיו כמו שעומדים לימכר לנטיעות ואם זה אומר לו טול אילנותיך שומעין לו:

If a river swept away his olive trees, and one who sells his olive trees for wood; it contains two se'ifim. If the river swept away his olive trees and planted them in his fellow's field, and that one said: I will take my olive trees — they do not listen to him, in the Land of Israel, because of the settlement of the Land; rather they remain in their place. And if the river uprooted them with their clods (in such a way that they are fit to survive through them) (Tur), the owner of the field divides the fruit with the owner of (the olive trees) for all three years; and after three years it all belongs to the owner of the field, only that he must give the owner of the olive trees the value of the olive trees as they were worth at first, when the river swept them away. And if they were not uprooted with their clods, everything belongs to the owner of the land at once. And if the owner of the olive trees comes to take his olive trees, whether within the three years or after the three, he may, outside the Land; but in the Land of Israel they do not listen to him, and this one gives him the value of his olive trees as they stand to be sold for planting. And if this one says to him: take your trees, they listen to him.

המוכר זיתיו לעצים אם פסק עמו לקוץ מיד כל הפירות שיעשו הרי הן לבעל הקרקע ואם התנה עמו לקיץ כל זמן שירצה כל הפירות שיוציאו לבעל העצים מכר סתם אם עשו פחות מרביעית לסאה חוץ מההוצאה הרי אלו של בעל הזיתים עשו רביעית לסאה חוץ מההוצאה יחלוקו:

One who sells his olive trees for wood: if he settled with him to cut them at once, all the fruit they make belongs to the owner of the land; and if he stipulated with him to cut them whenever he wishes, all the fruit they produce belongs to the owner of the wood. If he sold without specifying: if they made less than a revi'it per se'ah, beyond the expense, they belong to the owner of the olive trees; if they made a revi'it per se'ah beyond the expense, they divide.
