מי שנפל כותלו לגינת חבירו. ובו סעיף אחד: מי שהיה כותלו סמוך לגינת חבירו ונפל כופין אותו לפנות אבניו אם אמר ליה פנה אותם ויהיו שלך אין שומעין לו ואם נתרצה בעל הגינה בכך ופינה אותם וחזר זה ואמר תן לי אבני ואין לך (אלא) יציאותך אין שומעין לו אבל כל זמן שלא פינה אותם אפי' הם בחצירו של זה ואמר לו פנה אותם ויהיו שלך לא קנה חצירו שלא כוון אלא לדחותו:
One whose wall fell into his fellow's garden; it contains one se'if. One whose wall was near his fellow's garden, and it fell — they compel him to clear away his stones. If he said to him: clear them away and they shall be yours, they do not listen to him. And if the owner of the garden consented to this and cleared them away, and this one went back and said: give me my stones, and you have (only) your expenses — they do not listen to him. But so long as he has not cleared them away, even if they are in this one's courtyard, and he said to him: clear them away and they shall be yours, his courtyard has not acquired them, for he intended only to put him off.
