בית ועליה של שנים ומה יש על כל אחד לתקן. ובו ח סעיפים: הבית והעליה של שנים כל קלקול שיארע בכתלים מן התקרה ולמטה חייב בעל הבית לתקנו ואם אינו רוצה לתקנו בעל העליה כופהו ומן התקרה ולמעלה יתקננו בעל העלייה אם ירצה והתקרה בעצמה היא של בעה"ב והמעזיב' שעליה היא של בעל העלייה: הגה וי"א דאין בעל הבית חייב לתקן התקרה אלא בעל העלייה צריך לתקנו וכן נראה לי לדון וכל צרכי הגג חייב בעל העלייה לתקן ג"כ ודוקא בב' שותפים אבל בשוכר ומשכיר על התחתון לתקן התקרה (ע' בטור והמגיד פי"א דשכנים ונ"י סוף ב"מ):
A house and an upper storey belonging to two, and what each must repair; it contains eight se'ifim. A house and an upper storey belonging to two people — any damage that happens to the walls from the ceiling downward, the owner of the house must repair; and if he does not want to repair it, the owner of the upper storey compels him. And from the ceiling upward, the owner of the upper storey repairs it if he wishes. And the ceiling itself belongs to the owner of the house, and the plaster flooring on it belongs to the owner of the upper storey. Hagah [Rema]: And some say that the owner of the house is not obliged to repair the ceiling, but the owner of the upper storey must repair it; and so it seems to me to rule. And all the needs of the roof the owner of the upper storey must also repair. And this is specifically with two partners; but with a tenant and a landlord, it is upon the lower one to repair the ceiling (see Tur, and the Maggid, chapter 11 of the Laws of Neighbours, and Nimukei Yosef, end of Bava Metzia).

נדלדלו קורות הבית וירדו לאויר הבית אם הגיעו לתוך י' טפחים סותר ובונה ואם לא הגיעו יכול בעל העלייה לעכב עליו ואפי' אמר לו בעל הבית אני אשכור לך מקום כדי שתדור בו עד שאתקן התקרה אפי' אינו משתמש בו אלא בעצים אין שומעין לו שהרי אומר לו איני רוצה שאטרח ממקום למקום כדי שתתקן ביתך התנו ביניהם דבר זה אם נשאר בגובה הבית שיקח אדם חבילה בינונית על ראשו ויכנס בה תחת קורות אלו שנתעקמו אינו סותר ואם אינו יכול ליכנס עד שיכוף ראשו סותר ומתקן ובונה ואין בעל העליה יכול לעכב שהרי התנו ביניהם תחלה: הגה לא נדלדלו הקורות אלא הושפלה התקרה מחמת שנכנסו כותלי הבית בארץ והגיעה עד פחות מי' הוצאות ההגבהה על שניהם ולמעלה מי' העליון יכול לעכב וכדרך שנתבאר (טור סי"ג וכפי' רש"י שם ע' בב"י) כותל שבין ראובן לשמעון והיא של א' מהן יכול לסתרה כשירצה ואין השני יכול למחות (מרדכי ריש ב"ב) ואם הכותל רעוע אע"פ שהוא של שניהן אחד מהן יכול לסותרה והשני צריך לתת חלקו (נ"י סוף פ' שור שנגח ד' וה'):
If the beams of the house sagged and came down into the air of the house: if they came within ten handbreadths, he tears it down and builds; and if they did not come so far, the owner of the upper storey can prevent him. And even if the owner of the house said to him: I will rent you a place to live in until I repair the ceiling — even if he uses it only for wood — they do not listen to him, for he says to him: I do not want to trouble myself from place to place so that you may repair your house. If they stipulated this between them — if there remained in the height of the house enough that a man may take a middling bundle on his head and go in with it beneath these beams that have bent, he does not tear down; and if he cannot go in without bending his head, he tears down, repairs and builds, and the owner of the upper storey cannot prevent him, for they stipulated so between them from the first. Hagah [Rema]: If the beams did not sag, but the ceiling was lowered because the walls of the house sank into the ground, and it came to less than ten, the expenses of raising it are upon both of them; and above ten, the upper one can prevent him, in the manner that was explained (Tur, se'if 13, and according to Rashi's explanation there; see Beit Yosef). A wall between Reuven and Shimon, and it belongs to one of them — he may tear it down whenever he wishes, and the second cannot protest (Mordechai, the beginning of Bava Batra). And if the wall is shaky, even though it belongs to both of them, one of them may tear it down, and the second must give his share (Nimukei Yosef, end of chapter "An ox that gored four and five").

נפלו שניהם הבית והעליה הרי שניהם חולקים בעצים ובאבנים ובעפר (וכפי מה שאחד גבוה יותר מחבירו נוטל יותר בעצים ובאבנים ובעפר) (טור ס"ד) ואם נשתברו מקצת האבנים רואים איזה ראויה להשתבר אם אבני הבית או אבני העלייה ודבר זה ידוע מדרך הנפילה אם נפל העליון על התחתון והרסו או נשמט התחתון ונפל העליון ונהרס ואם אינם יודעים כיצד נפל חולקין האבנים השלימות והשבורות:
If both fell, the house and the upper storey, the two of them divide the timber, the stones and the earth (and according as one is higher than his fellow, he takes more of the timber, the stones and the earth) (Tur, se'if 4). And if some of the stones were broken, they see which were likely to break, the stones of the house or the stones of the upper storey; and this is known from the manner of the falling — whether the upper fell on the lower and destroyed it, or the lower slipped away and the upper fell and was destroyed. And if they do not know how it fell, they divide the whole stones and the broken.
