The residents of a town can force one another (even the minority can force the majority - Rabbneu Yerucham 6:31) to put up a wall with gates and a bolt for the town; and to build a synagogue and to buy a book of the Torah, Prophets and Writings so that anyone from the community may read from them. Gloss/Rema: And the same is true for all the needs of the town and see Orachot Chaim 55 - Laws of Hiring a Cantor for the People of the Town; and also ibid., 53. And the residents of the town can force one another to provide hospitality for guests, distribute charity to them and to contribute to the charity container (Mordekhai on Bava Barta: Chapter 1; Teshuvot Maimoni on Mishneh Torah, Acquisition 59). And see above Choshen Mishpat 4 and Choshen Mishpat 7 regarding whether if the people of the town have a case with an individual, they can judge him. And... And regarding expenses that were spent to get rid of a talebearer, all of the residents of the town are obligated to give towards this (Rosh in a responsum, Principle 6: 21, 27 and repeated below Choshen Mishpat 288). And with a matter that the community is not able to be in agreement about, all the heads of households that pay taxes should convene and accept upon themselves that each one proclaim his opinion for the sake of heaven, and [then] go according to the majority. And if the minority [refuses to go along], the majority can force them [to comply] - even through the laws of the idolaters - and to extricate money form them, and they must give their portion. And backed by the ban (cherem), the opinion of one who refuses to state his opinion is nullified, and we follow the majority of those stating their opinion (Responsum of Mohoram, Sefer Kinyan 27; Hagahot Maimoniot on MT, Prayer 11). One who has a courtyard in another town — the people of the town bind him to dig with them pits, ditches and caves, and a water channel; but in all other things they do not bind him. And anyone who lives in the town twelve months, or who bought a dwelling house in it, gives with the people of the town for all the things needed for the repair of the wall and the doors, and the pay of the horsemen and those who guard the country, and things like these by which they guard the town. Hagah [Rema]: This is specifically in an unspecified case; but if we know that he wants to settle in the town, he is at once like the people of the town. And some say that if he rented a dwelling house, as soon as he rented it for twelve months he is at once like the people of the town (Rivash, siman 475); and some say that we require specifically that he bought it to settle (Mordechai, the first chapter of Bava Batra); and some say, even to dwell. And according to all, if a house fell to him by inheritance or by gift, it is nothing (Rivash, simanim 414 and 132). However, if there is a custom, they follow it. And some say that all this is with a fixed tax; but when it is not fixed, as soon as he rents a house he too must give, for he draws the eye like the other people of the town, and one may say that the tax is increased because of him (Maharam of Merseburg, and the Tosafot, and Mordechai, and the Rosh); and there are those who disagree (Nimukei Yosef, chapter "The presumption of houses"). And what we said, that it avails if he lived there twelve months, means that he stayed there not because of constraint; but if he stayed there because of constraint, for example he fell ill or the like, it does not. However, if he made a profit there, he must give tax according to the profit, as was explained above, siman 156 (Maharyu, siman 106). One who stayed in a town many years and they did not claim tax from him — it is not a waiver, and when they claim it from him he must give retroactively (Maharam of Merseburg). Any tax that was laid on the people of the town — a man cannot exempt himself from it by leaving the town after the tax was laid (Mordechai, chapter "Partners", in the name of the Ri). And even after they gave the ruler their share, if the ruler denies it, they must give again (Hagahot Mordechai, the chapter mentioned). And if they have disputes with the people of the town, they must return to their place and go to law with them (Maharik, shoresh 2). And if they were accustomed otherwise, all is according to the custom (Terumat haDeshen, siman 342).

When they collect from the people of the town to build the wall, they collect according to the nearness of the houses to the wall: whoever is nearer to the wall gives more. And some say that they collect according to wealth, and after they have divided according to wealth they also collect so that whichever house is near the wall pays more. How so? Two houses equal in nearness, one to the other, with equal wealth in them, pay equally; and if there is a house near the wall with no wealth in it, and one far with wealth in it, they collect nothing from the near one, since he has nothing to fear for. Hagah [Rema]: Whatever they collect according to wealth, they follow the majority of the wealth, and the rich, who are a minority of persons, are considered the majority in this matter. And therefore Maharai ruled (Terumat haDeshen, siman 344) concerning five men in one town, among them two brothers, powerful and rich, who want to choose two who are connected with them, that the law is with them. And if two houses have equal wealth in them, and one is far and one near, the near one gives more than the far one. And this is specifically when there is peace in the land and there is fear of the kingdom; but at a time when there is war, and the kings are provoking one another, we are not concerned with the nearness of houses at all, and they collect only according to the value of the wealth. And if they come over matters of life, they collect also according to the value of lives: half according to the value of wealth and half according to lives. And this value of wealth is specifically movable wealth. Hagah [Rema]: And likewise, if a company travelling in the wilderness went astray and there is danger of life, they collect also according to persons (the Tosafot and Mordechai and the Rosh, the first chapter of Bava Batra). And with whatever libels of persecution the gentiles bring against Israel, and even if they torment them with afflictions, some say that they collect according to the wealth of the Israelites (the Rosh); and there are those who disagree and hold that wherever there is danger of life — and even if they only commanded not to sell bread to Jews, or forbade the slaughter, and the like — they collect according to persons (Responsa of the Rashba, siman 1091). And it seems to me that one judges in this according to the matter as it appears to the judges. Guards of the town who guarded by themselves at night, and came to terms with the governor to give a fixed sum yearly — they collect according to wealth, even though at first they had to guard equally (Mordechai, the first chapter of Bava Batra). And this is specifically in such a case; but if the gentiles still guard, and the Jews hire two or three to guard in their place, it still rests on each man's head, and they collect equally, poor and rich alike (Terumat haDeshen, siman 145). And when they collect according to wealth, there is no difference between his own wealth and the wealth of others with which he does business; and even if they were accustomed not to give from it, they may change and fix that it be given from it from now on (Mordechai, chapter "Partners"). And some disagree and hold that he need not give on the wealth of others; and if they fear that it draws the eye to them, let them tell the king (Mordechai, chapter "The last robber", in the name of Rabbeinu Tam). And the custom is as the first opinion. And one who has in his hand an iska (a venture in which the investor shares the gain and the loss) from others — the recipient gives half and the giver half. And likewise they must give from what the wife has apart from her husband, or his minor sons or daughters (Mordechai, the chapter mentioned). If they were accustomed at first to give according to an assessment, they may change and enact giving according to an oath, for they are like partners with one another, who may make one another swear the oath of partners (Nimukei Yosef in the name of the Rashba, and Terumat haDeshen, siman 342). And if all of them give according to an oath, and one says: I will not swear, but assess me at whatever you wish — some say that they do not listen to him (Terumat haDeshen, mentioned above). And if they laid the tax on each of them, what he is to give, and began collecting from that time, it is upon (each) one as a debt; and even if he became poor afterwards, he must give what they fixed upon him (Responsa of the Rashba, siman 877). And likewise, if he was poor and became rich, they always follow the time of the collection (the Rashba, siman 977). However, one who came to the town between the time the obligation for that tax arose and the time of collection — some say that he need not give that tax, since it was already obliged, and the community has no authority to stipulate that they give (Rivash, siman 477). However, some say that if that tax is for the benefit of the newcomers, they must give their share (the Rosh, klal 6, siman 12). And in all matters of taxes they follow the fixed custom of the town, that they did so three times, even though it is a poor custom; they are not exacting in matters of taxes (Terumat haDeshen, the siman mentioned, and Maharyu, siman 132). A community that lent to the ruler, and he said to deduct it for them in matters of taxes, and afterwards he did not want to (and died), and they despaired of the debt; and afterwards his son arose in his place and deducted it for them — the community are as those who acquire from ownerless property, and they need not pay a share to those who were rich at the time of the loan and have since come down from their property (Maharik, shoresh 3). One who has debts owed him by others — if they are fit to be paid, he gives on them; and likewise, if he is obliged to others, they deduct it for him if he will have to pay. They need not give on interest that has accrued on pledges so long as it has not been added to the principal, and likewise on rent that has not come into the owner's hand (Terumat haDeshen, mentioned above, and Maharyu, siman 433). And likewise they do not give on money set aside for a mitzvah or for charity (the Rosh, klal 13, siman 6, and Hagahot Mordechai, the beginning of Bava Batra), if he has no benefit from it; but if he has benefit from the profit, or for his descendants after him, he gives according to the benefit in it (Terumat haDeshen, mentioned above). One who has a deposit in the hands of others and does not do business with it — some say that he must give tax on it, even though he also gives in the place where he deposited it (Terumat haDeshen, mentioned above); and there are those who disagree (Responsa of the Rashba, simanim 664 and 788, and Maharik, shoresh 124). And according to all, if he had land in another place, he gives nothing on it (Terumat haDeshen, mentioned above). And in a place where they give according to assessment, he cannot say that they erred; but if they give according to an oath, one may say that they erred (Maharyu, siman 84). But on wealth that is not movable they do not collect at all. Hagah [Rema]: And what we said, that they do not give on land, means houses and the like in which he makes no profit; but if a man has two or three houses and lives in one of them and rents out the others, or he has fields and vineyards in which he makes a profit, or he does business in trade, he must give on them — but not so much as on other wealth. When they give on houses, every house that is more important and draws the eye more must give more (Mordechai, chapter "Partners", and Terumat haDeshen, siman 342). And in all this they follow the custom (Responsa of the Rashba, siman 644). And if the moneyed men want to fix a tax on the houses in a place where one need not give on them, they do not listen to them (Mordechai, mentioned above). And just as they do not give on houses, so they do not give on other household utensils or books; but on jewellery they give, though not as much as on other wealth, and there is no difference whether they are attached to garments or not; and all is according to the custom (Terumat haDeshen, siman 342). And if there is concern of the robbery of courtyards and land, and the burning of houses and their demolition, they collect also according to all of them. Hagah [Rema]: In a place where the people of the town install among them a teacher of children, and the fathers of the children cannot hire one for their sons, and the community must give the pay, they collect according to wealth; and likewise for the pay of the prayer leader (Rabbeinu Yerucham, netiv 29, part 3); and see Orach Chayim, siman 53, se'if 23. And likewise for the building of the synagogue they collect according to wealth (Maharam of Padua, siman 3). All the needs of the town, even though some of them do not need them — such as a wedding house, or a mikveh, and the like — even so they must give their share (Mahari Mintz).
