Se’if 1א׳
דברים שבני מבוי כופין זה את זה. ובו ז סעיפים: בני מבוי כופין זה את זה לעשות לחי וקורה למבוי אבל אם באו להעמיד לו דלתות אפי' אחד מהם יכול לעכב ולומר אני רוצה ליכנס בחבילתי עד פתחי ואפי' אם יסכימו כולם להעמיד דלתות בני רשות הרבים מעכבים עליהם: הגה ואפי' מכרו בני המבוי המבוי להעמיד דלתות והכריזו שכל מי שלא יערער שאבד זכותו ולא ערערו בני רשות הרבים אפ"ה יכולין למחות (ב"י בשם הרשב"א) ואפי' אם ירצו להעמיד הדלתות בפנים במבוי הרבה לפי שפעמים דוחקים ונכנסים לתוכו: הגה מיהו מבואות קטנים הפתוחים לאותן הפתוחים לרשות הרבים או לסמטא רשאין בני המבוי לעשות להן דלתות (טור ס"ד בשם הרא"ש) וי"א דאפי' אם פתוח לרשות הרבים וניכר בראשו כמין פתח שיש לו פצימין יכולין להעמיד לו דלתות (טור ס"ה בשם הרמב"ן ונ"י ריש ב"ב) בני מבוי שהיה במבוי שלהן שכונה בחצר אחד ובו בית הכנסת ובית המקוה והחצר סגור בדלתות והמבוי פתוח לרשות עכו"ם ובמקום אחר דרים ישראלים שיש להם דרך על זה המבוי לילך לחצר ההוא לצורך טבילה או תפלה ובני המבוי רוצים להעמיד דלתות כדי לשמור (עצמן) מן העכו"ם הנכנסים הישראלים האחרים יכולין למחות בידם אע"פ שרוצים להסיר הדלת מן החצר ולקבעה בראש המבוי זה משורת הדין אבל אם נתן להם המלך רשות להעמיד דלתות במבוי שלהן דינא דמלכותא דינא כי השווקים והרחובות שלהן ויכולין לעשות בהן מה שירצו (תשובת רשב"א):
Things in which the residents of an alleyway compel one another; it contains seven se'ifim. The residents of an alleyway compel one another to make a side-post and a cross-beam for the alleyway; but if they came to set up doors for it, even one of them can prevent them and say: I want to come in with my bundle right up to my door. And even if all of them agree to set up doors, the people of the public domain may prevent them. Hagah [Rema]: And even if the residents of the alleyway sold the alleyway to set up doors, and announced that whoever does not contest has lost his right, and the people of the public domain did not contest — even so they may protest (Beit Yosef in the name of the Rashba). And even if they want to set up the doors far inside the alleyway, for sometimes they are pressed and go into it. Hagah [Rema]: However, small alleyways that open onto those that open onto the public domain, or onto a side-street — the residents of the alleyway may make doors for them (Tur, se'if 4, in the name of the Rosh). And some say that even if it opens onto the public domain, and at its head there is recognisable something like a doorway with jambs, they may set up doors for it (Tur, se'if 5, in the name of the Ramban, and Nimukei Yosef, the beginning of Bava Batra). Residents of an alleyway in whose alleyway there was a quarter in one courtyard, and in it a synagogue and a mikveh, and the courtyard is closed with doors, and the alleyway opens onto a gentiles' domain; and in another place live Israelites who have a way through this alleyway to go to that courtyard for the need of immersion or prayer; and the residents of the alleyway want to set up doors in order to guard (themselves) from the gentiles who come in — the other Israelites may protest against them, even though they want to remove the door from the courtyard and fix it at the head of the alleyway; this is by the strict line of the law. But if the king gave them permission to set up doors in their alleyway, the law of the kingdom is law, for the markets and the streets are theirs, and they may do with them what they wish (Responsa of the Rashba).
Se’if 2ב׳
וכן מבואות המפולשין לדרך עיר אחרת ובקשו בני אותם מבואות לסתמם בני אותם העיר מעכבים עליהם ואפי' יש להם דרך אחרת לעבור משם:
And likewise alleyways that are open through to the road of another town, and the residents of those alleyways sought to close them — the people of that town may prevent them, even if they have another way to pass from there.
Se’if 3ג׳
מי שבקש לפתוח פתח במבוי שאינו מפולש בני מבוי מעכבין עליו מפני שמרבה עליהם את הדרך ואם היה מפולש (לר"ה) (המגיד) פותח כל פתח שירצה לכתחלה ואי אית ליה דלתות שנועלים בהם בלילה כסתום דמי שמרבה עליהם הדרך בלילה: הגה וכן מעכבין זה את זה שלא להשתמש במבוי רק בדברים שדרך להשתמש במבואות (טור בשם הרמב"ם פ"ה דשכנים):
One who sought to open a door onto an alleyway that is not open through — the residents of the alleyway may prevent him, because he increases the traffic over them. And if it was open through (to the public domain) (the Maggid), he may open any door he wishes at the outset. And if it has doors that they lock at night, it is as closed, for he increases the traffic over them at night. Hagah [Rema]: And likewise they prevent one another from using the alleyway except for things for which it is usual to use alleyways (Tur in the name of the Rambam, chapter 5 of the Laws of Neighbours).
