Se’if 1א׳
גג הסמוך לחצר ושתי חצרות אחת גבוה מחברתה. ובו ג סעיפים: גג הסומך לחצר חבירו בעל הגג מזיק לבעל החצר ואין בעל החצר מזיק לבעל הגג לפיכך צריך בעל הגג לעשות ביניהם מחיצה ד' אמות כדי לסלק היזקו ואין בעל החצר מסייעו אלא כפי שיגיע חלקו למחיצת י' טפחים כדי שיהיה נתפס כגנב ואם קרקע החצר גבוה מן הגג צריך בעל הגג לבנות על שלו למטה עד שיהיה גבוה ארבע אמות למעלה מקרקעית החצר כדי לסלק היזקו ואפי' אם הגג נמוך מן החצר ד' אמות יש מי שאומר דאכתי איכא היזק ראייה ממנו לחצר וצריך בעל הגג לבנות מחיצה גבוהה ד' אמות מקרקע החצר ויש מי שאומר דכיון שהגג נמוך מן החצר ד' אמות שוב אין לו היזק ראיה ואינו צריך לעשות כלום:
A roof adjoining a courtyard, and two courtyards one higher than the other; it contains three se'ifim. A roof adjoining his fellow's courtyard — the owner of the roof damages the owner of the courtyard, and the owner of the courtyard does not damage the owner of the roof; therefore the owner of the roof must make a partition of four cubits between them to remove his damage, and the owner of the courtyard helps him only to the extent of his share in a partition of ten handbreadths, so that one who enters may be seized as a thief. And if the ground of the courtyard is higher than the roof, the owner of the roof must build on his own, below, until it is four cubits high above the ground of the courtyard, to remove his damage. And even if the roof is four cubits lower than the courtyard, there is one who says that there is still damage by sight from it to the courtyard, and the owner of the roof must build a partition four cubits high from the ground of the courtyard; and there is one who says that since the roof is four cubits lower than the courtyard, there is no longer damage by sight to him, and he need not do anything.
Se’if 2ב׳
ואם הגג נמוך מהחצר י"א שאין העליון זקוק לתחתון כלל וי"א דהני מילי כשהחצר גבוה מהגג י' טפחים אבל אם הוא גבוה מהגג פחות מי' טפחים בונה בעל הגג עד קרקע החצר ורואין כמה חסר עדיין להשלים לגובה י' ויתן לו בעל החצר החצי מזה:
And if the roof is lower than the courtyard, some say that the upper one is not bound to the lower one at all; and some say that this applies when the courtyard is ten handbreadths higher than the roof; but if it is less than ten handbreadths higher than the roof, the owner of the roof builds up to the ground of the courtyard, and they see how much is still lacking to complete a height of ten, and the owner of the courtyard gives him half of that.

שתי חצירות שקרקעית הא' גבוה מחבירו צריך העליון לסייע לתחתון לבנות למטה והתחתון צריך לסייע לעליון עד שיהיה גבוה ד' אמות מקרקע העליון ולמעלה לפיכך יקציעו העפר מקרקע של עליונה שיעור עובי חצי הכותל ובונין הכותל על קרקע שניהם עד שיהא גבוה ד' אמות מקרקע העליונה ולמעלה: הגה ואם החצר גבוה הרבה או שהתחתון אינו רחב להביט בו מרחוק ואפשר שבמחיצה מועטת יסתלק היזק ראיה שלו סגי במחיצה שירא' לבני אדם שאינו מזיק עוד בראייתו (טור בשם ה"ר יונה):
Two courtyards, where the ground of one is higher than its fellow — the upper one must help the lower one to build below, and the lower one must help the upper one until it is four cubits high above the ground of the upper one. Therefore they cut away the earth from the ground of the upper one to the measure of the thickness of half the wall, and build the wall on the ground of both of them until it is four cubits high above the ground of the upper one. Hagah [Rema]: And if the courtyard is much higher, or the lower one is not wide enough to look into it from afar, and it is possible that with a small partition his damage by sight will be removed, a partition suffices by which it will be seen by people that he no longer damages by his sight (Tur in the name of Rabbeinu Yonah).
