היזק ראייה שמגג לגג וכיצד יסירוהו. ובו ד סעיפים: שני בתים זה בצד זה והיו גגותיהם עשויים לדירה אפי' היו בשני צידי רשות הרבים זה עושה מעקה לחצי גגו וזה עושה מעקה לחצי גגו שהוא דר בו זה שלא כנגד זה ומעדיף כדי שלא יראו זה את זה אע"פ שבני רשות הרבים רואים אותו יכול לומר כל אחד לחבירו אלו אין רואים אותי אלא ביום בעת שאעמוד על גגי אבל אתה רואה אותי תמיד: הגה ואם הגג שפל עד שבני רשות הרבים רואין אותו כמי שעומד בגג אין כאן היזק ראייה (טור בשם ר' יונה):

Damage by sight from roof to roof, and how they remove it; it contains four se'ifim. Two houses, one beside the other, and their roofs were made for dwelling — even if they were on the two sides of a public domain — this one makes a parapet for half his roof and that one makes a parapet for half his roof on which he dwells, not opposite each other, and he extends it a little, so that they should not see one another. Even though the people of the public domain see him, each can say to his fellow: these see me only by day, when I stand on my roof, but you see me always. Hagah [Rema]: And if the roof is so low that the people of the public domain see him as one who stands on the roof, there is no damage by sight here (Tur in the name of Rabbeinu Yonah).

גג הסמוך לחצר חבירו עושה לו מעקה גבוה ד' אמות אבל בין גג לגג משאר הגגים אינו זקוק לד' אמות שאין בני אדם דרים בגגות לפיכך אין בגגות היזק ראיה אבל צריך לעשות מחיצה בין שני הגגים גבוה י' טפחים כדי שיתפוס אותו כגנב אם נכנס לרשותו: הגה וי"א דוקא שהגגין סמוכין זה לזה אבל אם אויר מפסיק ביניהן לא שנא אויר רה"י או אויר ר"ה בעינן מעקה וכדרך שנתבאר בסמוך (טור ס"א והגמ"יי והמגיד פ"ג משכנים) וכן נ"ל עיקר:

A roof adjoining his fellow's courtyard — he makes for it a parapet four cubits high; but between one roof and another, among other roofs, he is not bound to four cubits, for people do not dwell on roofs, and therefore on roofs there is no damage by sight. But he must make a partition between the two roofs ten handbreadths high, so that he may seize him as a thief if he enters his domain. Hagah [Rema]: And some say that this is specifically where the roofs are adjoining one another; but if air separates between them — no matter whether the air of a private domain or the air of a public domain — we require a parapet, in the manner that was explained shortly above (Tur, se'if 1, and Hagahot Maimoni and the Maggid, chapter 3 of the Laws of Neighbours); and so it seems to me the principal view.

אם הא' אומר החצי שלי אבנה אותו לרוח מזרח והשני אומר לא כי אלא אני אבנה אותו רוח יפילו גורל ואם בא אחד לפנינו ותבע ואמר לחבירו או תעשה אתה המעקה ואני אתן לך חצי ההוצאה או תן לי ואעשנו שומעין לו אבל אם המתין עד שעשה חבירו החצי שלו ואמר לו הואיל והתחלת גמור אם הלה אינו רוצה אינו יכול לכופו:

If one says: my half I will build on the east side, and the second says: not so, but I will build it on that side — they cast lots. And if one came before us and claimed, and said to his fellow: either you make the parapet and I will give you half the expense, or give me and I will make it — they listen to him. But if he waited until his fellow made his half, and said to him: since you have begun, finish — if that one does not want to, he cannot compel him.
