שנים שהן שותפים בחצר ובאים לידי חלוקה כיצד יבנו הכותל. ובו יג סעיפים: חצר השותפין שיש בה דין חלוקה או שחלקוה ברצונם אע"פ שאין בה דין חלוקה יש לכל אחד מהם לכוף את חבירו לבנות הכותל באמצע כדי שלא יראהו חבירו בשעה שמשתמש בחלקו ואפי' עמדו כך שנים רבות בלא מחיצה כופהו לעשות מחיצה בכל עת שירצה: הגה ואפי' יש מנהג בעיר שלא לעשותו אין הולכין אחריו וכופין לעשותו (טור בשם הרא"ש ונ"י ריש ב"ב) ואפי' אמר האחד חזקתי כך בלא כותל ואתה מחלת לי לא מהני אא"כ יש עדים שמחלו זה לזה על היזק ראייה שוב אינן יכולין למחות (טור ס"ד בשם הרא"ש):

Two people that share a courtyard and are coming to divide [it], how should they build the wall. And there are 13 clauses in it. A shared courtyard that is subject to the law of division, or that they divided willingly even though it is not [large enough to be] subject to the law of division - each one of them may compel his fellow to build a wall in the middle so that his fellow not see him when he is using his portion. And even if they remained like this many years without a partition, he may compel him to make a partition anytime he wants. Gloss: And even if there is a custom in the city not to make it, they do not follow it and compel him to make it (Tur in the name of the Rosh, and Nimukei Yosef at the beginning of Bava Batra). And even if one of them said, "I assumed possession like this without a wall, and you pardoned me," it is not effective unless there are witnesses that they pardoned each other for the damage to visual privacy. [Then] they may no longer protest (Tur in the name of the Rosh).

מקום שאין בו דין חלוקה שרצו שותפין לחלקו אע"ג שקנו מידם כל אחד מהם יכול לחזור בו שזה קנין דברים הוא אבל אם בירר כל אחד חלקו ורצה זה ברוח פלונית וזה רצה ברוח פלונית וקנו מידם על זה אינם יכולים לחזור בהם וכן אם הלך זה בעצמו והחזיק בחלקו וזה בעצמו והחזיק בחלקו אע"פ שלא קנו מידם אין א' מהם יכול לחזור בחבירו י"א שאפי' החזיק שלא בפני חבירו ולא אמר לו לך חזק וקני קנה ואפי' לא החזיק אלא א' זכה הלה בחלק האחר: הגה וע' לקמן בס' קע"א מדיני מקומות בית הכנסת:

A place that is not subject to the law of division, in which those sharing it wanted to divide it - even though they acquired it from [each other] - each one can retract about it, as this is [only] a verbal acquisition. But if each one chose his portion, one wanting direction x and one wanting direction y, and they acquired it from each other like this, they can not retract. And likewise, if this one went by himself and assumed possession over his portion and that one went by himself and assumed possession over his portion - even though they did not acquire it from [each other] - none of them may retract towards his fellow. Some say that even if he assumed possession not in front of his fellow and did not say to him, "Go and possess and acquire it," he acquired it. And even if only one assumed possession, the other one acquired the other portion. Gloss: And see below in Paragraph 171, about the laws of the places of synagogues.

כותל זה יבנוהו על מקום שניהם ובהוצאות שניהם ואין אחד מהם יכול לומר לא נתרציתי לחלוק אע"פ שלא היה בו דין חלוקה אלא בתנאי שתבננה אותה משלך אפילו אם יש לאחד פי שנים בחצר יעשו הכותל לחצאים: הגה היה אחד מהן עשיר ואחד מהן עני אם אחד רוצה לכנוס בשלו ולבנות א"צ יותר ואם אינו רוצה דינו כמו בבית ועלייה וע"ל סימן קס"ד ואם שניהם עניים משתמשים כך ומ"מ כל אחד ירחיק עצמו בכל מה דאפשר שלא יזיק חבירו בראייה (טור ס"ז בשם הר"י ברצלוני):

This wall they build on the place of both of them and at the expense of both of them; and neither of them can say: I consented to divide only on condition that you build it of your own — even though it was not subject to the law of division. Even if one has a double share in the courtyard, they make the wall in halves. Hagah [Rema]: If one of them was rich and one poor: if one wants to recess into his own and build, no more is needed; and if he does not want to, its law is as with a house and an upper storey — and see below, siman 164. And if both are poor, they use it so; and nevertheless each shall distance himself in every way possible so as not to damage his fellow by sight (Tur, se'if 7, in the name of Rabbi Yehudah of Barcelona).
