Se’if 1א׳

דין הרחקת נזיקין. ובו מד סעיפים: הבית והעלייה של שנים לא יעשה בע"ה תנור בתוך ביתו אא"כ יש לו על גביו גובה ד' אמות בינו לתקרת העלייה (שלא ישרף העלייה) וכן לא יעמיד בעל העלייה תנור עד שיהיה תחתיו מעזיבה שלשה טפחים מלבד שיהא על גביו גובה ד' אמות ובכירה טפח מעזיבה מתחתיה ואם תנור של נחתומין הוא צריך שיהיה תחתיו ד' טפחים ובכירה של נחתומין ג' טפחים אע"פ שהרחיק כשיעור אם יצא האש והזיקה משלם מה שהזיקה וכל אדם בביתו צריך להרחיק כשיעורים הללו מפני השכנים שמעכבים עליו:

The law of distancing damages; it contains forty-four se'ifim. A house and an upper storey belonging to two people — the owner of the house may not make an oven inside his house unless he has above it a height of four cubits between it and the ceiling of the upper storey (so that the upper storey should not burn); and likewise the owner of the upper storey may not set up an oven unless there is plaster flooring three handbreadths thick beneath it, besides having above it a height of four cubits; and with a stove, a handbreadth of plaster flooring beneath it. And if it is a bakers' oven, there must be four handbreadths beneath it, and with a bakers' stove, three handbreadths. Even though he distanced it by the measure, if the fire went out and did damage, he pays for what it damaged. And every man in his house must distance by these measures because of the neighbours, who may prevent him.

מי שהיתה לו חנות תחת אוצר חבירו לא יעשה בה לא נחתום ולא צבע ולא רפת בקר ולא יכניס שם אספסתא (פי' תבואה שלא הביאה שליש והוא מאכל בהמה תרגום על בלילו על אספסתיה) וכיוצא בהם מדברים שעולה מהם הבל חם הרבה מפני שהחום מפסיד פירות האוצר (וה"ה שלא יפתח חלון מבית שיש בו דברים אלו לחדר שיש לו תחת האוצר) (טור בשם הרשב"א) לפיכך אם היה אוצר יין בא"י שאין החום מפסידו הרי זה עושה בחנותו כל מלאכת אש שירצה אבל לא יעשה רפת בקר מפני שמפסיד ריח היין (וכן במקום שקול ונדנוד קשים ליין שצריך להרחיק) (ריב"ש סימן רל"ו) ואם הוחזקה החנות בתחלה לרפת או לנחתום וכיוצא בו ואח"כ רצה בעל העלייה לעשות עלייתו אוצר אינו יכול למחות בידו:

One who had a shop beneath his fellow's storehouse may not set up in it a baker, or a dyer, or a cattle stall, and may not bring in there aspasta (that is, grain that has not reached a third of its growth, which is fodder for animals; the Targum renders "over his fodder" as "over his aspasta") and the like — things from which much hot vapour rises — because the heat spoils the produce of the storehouse (and the same holds that he may not open a window from a house in which there are these things into a room he has beneath the storehouse) (Tur in the name of the Rashba). Therefore, if it was a wine store in the Land of Israel, where heat does not spoil it, he may do in his shop any work with fire that he wishes; but he may not set up a cattle stall, because it spoils the smell of the wine (and likewise, in a place where noise and shaking are bad for wine, he must distance them) (Rivash, siman 236). And if the shop was established first as a stall, or for a baker and the like, and afterwards the owner of the upper storey wanted to make his upper storey a storehouse, he cannot protest against him.

Se’if 3ג׳

גילה בעל העלייה דעתו שחפץ לעשות בה אוצר כגון שכיבד וריבץ עלייתו או שריבה בה חלונות כדרך שעושים לאוצר וקדם זה ועשה תנור קודם שיכניס פירות לאוצר או שהתחיל לאצור שומשמין או רמונים או תמרים וכיוצא בהם וקדם זה ועשה התנור קודם שאצר חטים או שעשה בעל החנות מחילה על גבה להבדיל בין החנות ובין האוצר בכל אלו בעל האוצר מעכב עליו ואם עבר ועשה אינו יכול להסירו:

If the owner of the upper storey revealed his mind that he wished to make a storehouse of it — for example, he swept and sprinkled his upper storey, or added windows to it, as one does for a storehouse — and this one went ahead and made an oven before he brought produce into the storehouse; or he began storing sesame, or pomegranates, or dates and the like, and this one went ahead and made the oven before he stored wheat; or the shopkeeper made a vault over it to separate between the shop and the storehouse — in all these the owner of the storehouse may prevent him; and if he transgressed and made it, he cannot remove it.
