Se’if 1א׳
חזקת חלונות ופתחים וכמה צריך להתרחק מהן. ובו לב סעיפים: אחד מהשותפין בחצר שלקח בית בחצר אחרת אינו יכול לפתוח פתחו לחצר השותפים שלו (שכל אחד מבני החצר אין לו רשות לשנות כלל אלא כמו שבנאו או קנאו או ירשוהו יש להם לנהוג בו) (טור סע"ב) אפי' בנה עלייה על גב ביתו לא יעשה לה (פתח) לתוך החצר לפי שמרבה עליהם את הדרך נעשה כמי שהיה לו שכן אחד ונעשו לו שכנים הרבה אבל יכול הוא לבנות עלייה על גב ביתו בנין חדש ובלבד שלא תהא פתוחה לחצר אלא לתוך ביתו ואצ"ל שאם רצה לחלוק (ביתו) לשנים חולק כיון שאינו פותח פתח אחר לחצר בד"א שאם לקח בית בחצר אחרת אינו יכול לפתוח פתחו לחצר השותפים בפותחו לחצר ממש אבל יכול לפתחו לתוך ביתו והוא שיסתום הפתח שהיה לו בחצר אחרת (ויש חולקין דאפי' לתוך ביתו אסור לפתחו) (טור בשם הרא"ש):
The presumptive right of windows and doors, and how far one must distance oneself from them; it contains thirty-two se'ifim. One of the partners in a courtyard who bought a house in another courtyard cannot open its door into the courtyard of his partners (for none of the residents of the courtyard has authority to change anything at all; rather, as they built it, or bought it, or inherited it, so they must conduct themselves in it) (Tur, se'if 2). Even if he built an upper storey on top of his house, he may not make a (door) for it into the courtyard, because he increases the traffic over them: he becomes like one who had one neighbour and has come to have many neighbours. But he may build an upper storey on top of his house as a new building, provided it does not open into the courtyard but into his house. And needless to say, if he wanted to divide (his house) in two, he divides it, since he does not open another door into the courtyard. When is it said that if he bought a house in another courtyard he cannot open its door into the courtyard of the partners? When he opens it into the courtyard itself; but he may open it into his house, provided he stops up the door he had into the other courtyard (and there are those who disagree, that even into his house it is forbidden to open it) (Tur in the name of the Rosh).
Se’if 2ב׳
אחד מהשותפין בחצר שהביא לביתו אנשי בית אחרת יש לחבירו לעכב עליו מפני שמרבה עליו את הדרך וכן המשכיר ביתו לבעל הבית אחד ואח"כ הביא עמו קרוביו או מיודעיו לשכון עמו כאחד בבית זה הרי המשכיר מעכב ואם הם סמוכים על שלחנו אינו יכול לעכב עליו לא השותף ולא המשכיר: הגה וי"א דשותף יכול למלאות ביתו אכסנאי' ודיורים כל שאינו מוסיף בנין חדש (טור בשם רשב"ם ונ"י בשם הרי"ף והרמב"ן וריטב"א) אע"פ שחולק ביתו לדיורים ויש להן בית הכסא אחד ביחד ולא יוכל השני למימר הם ממלאים לי הבית הכסא שנים שיש להם בשותפות בית אחד אין האחד יכול להרשות לאחרים להשתמש בחלקו אע"ג דבחצר אין להקפיד בכה"ג מיהו בבית קפידי אינשי (כ"ז מרדכי פרק חזקת ):
One of the partners in a courtyard who brought the people of another house into his house — his fellow may prevent him, because he increases the traffic over him. And likewise one who rented his house to one householder, and afterwards the tenant brought his relatives or acquaintances with him to dwell together with him in this house — the landlord may prevent him. And if they are supported at his table, neither the partner nor the landlord can prevent him. Hagah [Rema]: And there are those who say that a partner may fill his house with lodgers and tenants, so long as he adds no new building (Tur in the name of the Rashbam, and Nimukei Yosef in the name of the Rif and the Ramban and the Ritva), even though he divides his house among tenants and they have one privy together, and the other cannot say: they fill my privy. Two who have one house in partnership — one cannot allow others to use his share, even though with a courtyard one need not be particular in such a case; however, with a house, people are particular (all this in Mordechai, chapter "The presumption of houses").

לא יפתח אדם חלון לחצר חבירו ואפי' א' מהשותפים בחצר שבקש לפתוח לו חלון בתוך ביתו לחצר מעכב עליו שותפו מפני שמסתכל בו ממנו ואם פתח יסתום ואם נתנו לו השותפים בחצר רשות לפתוח חלון או פתח רשאי והוא שלא יפתח פתח כנגד פתח או חלון כנגד חלון: הגה ופתח כנגד פתח לא מהני חזקה וה"ה בחלון נגד חלון (ב"י בשם רשב"ם) וי"א בחלון נגד חלון מהני (טור בשם הרמ"ה) ואם באו שניהם לפתוח בבת אחת פתח נגד פתח או חלון נגד חלון אם אחד מהן אינו חסר וחבירו נהנה כופין על מדת סדום ואם שניהם כאחד חסרים יעשו פשרה ביניהם (נ"י פ' חזקת) אלא ירחיק משהו זה מנגד זה ואם הוא לחצר אחרת שנתנו לו רשות לפתוח פתח או חלון צריך להרחיק מכנגד פתחו או חלונו של חבירו עד שלא יוכל לראות בו כלל אבל פותח אדם לר"ה פתח בית כנגד פתח בית וחלון כנגד חלון אם אינם גבוהים ד' אמות מפני שאומר לו הריני כא' מבני ר"ה שרואים אותך: הגה והבא לבנות ראשון בעלייה אם חבירו שכנגדו יכול לעכב עליו לומר היום או מחר אפתח ג"כ ותעכב עלי ע"ל סי' זה סעיף י"ד ט"ו וי"ו וי"ז ולמבוי כל שיש למטה ממנו ג' בתים יש מי שאומר שדינו כר"ה וי"א שכל שאינו מפולש אין דינו כרשות הרבים פתח לר"ה ויש בזה היזק ראייה לחצר שבצד רה"ר שכנגדו חבירו יכול למחות בו (נ"י ומרדכי פ"ק דב"ב וד"ע מדקדוק הפוסקים ) ואע"פ כן לא יפתח אדם חנות כנגד פתח או חלון חבירו מפני שזה היזק קבוע תמיד שבני ר"ה עוברים ושבים ואינם מביטים בו תמיד וזה יושב בחנותו כל היום ומביט בפתח או בחלון חבירו לפיכך צריך להתרחק עד כדי שלא יהא יכול לראות בו כלל: (י"א שצריך ליזהר אדם מלהסתכל בבית חבירו עד שהוא נתפס כגנב בראייה ההיא כיון שאין לו טענה) (נ"י פ' חזקת):
A man may not open a window onto his fellow's courtyard; and even one of the partners in a courtyard who sought to open a window from his house onto the courtyard — his partner may prevent him, because he looks at him through it; and if he opened it, he must stop it up. And if the partners in the courtyard gave him permission to open a window or a door, he may, provided he does not open a door opposite a door, or a window opposite a window. Hagah [Rema]: And with a door opposite a door, a presumptive right does not avail, and the same holds for a window opposite a window (Beit Yosef in the name of the Rashbam); and some say that with a window opposite a window it avails (Tur in the name of the Ramah). And if both came to open at the same time, a door opposite a door or a window opposite a window: if one of them loses nothing and his fellow benefits, they compel against the trait of Sodom; and if both alike lose, they make a compromise between them (Nimukei Yosef, chapter "The presumption of houses"). Rather, he must distance them a little, this one from opposite that one. And if it is onto another courtyard, where they gave him permission to open a door or a window, he must distance it from opposite his fellow's door or window until he cannot see into it at all. But a man may open onto the public domain a house door opposite a house door, and a window opposite a window, if they are not four cubits high, because he says to him: I am like one of the people of the public domain, who see you. Hagah [Rema]: And as to one who comes to build first in an upper storey, whether his fellow opposite him can prevent him, saying: today or tomorrow I too will open, and you will prevent me — see below in this siman, se'ifim 14, 15, 16 and 17. And as to an alleyway, so long as there are three houses beneath it, there is one who says that its law is as the public domain; and some say that whatever is not open at both ends has not the law of the public domain. If he opened onto the public domain, and there is in this damage by sight to a courtyard at the side of the public domain opposite it, his fellow may protest against him (Nimukei Yosef, and Mordechai, the first chapter of Bava Batra, and his own opinion from the precision of the poskim). And even so, a man may not open a shop opposite his fellow's door or window, because this is a constant damage: the people of the public domain pass to and fro and do not look into it constantly, but this one sits in his shop all day and looks into his fellow's door or window. Therefore he must distance himself until he cannot see into it at all. (Some say that a man must take care not to look into his fellow's house, so much so that he is seized as a thief for that looking, since he has no plea) (Nimukei Yosef, chapter "The presumption of houses").
