Se’if 1א׳
דין הוצאת זיז ומרזב והעמדת סולם ונעיצת קורות. ובו כ סעיפים: המבקש להוציא זיז (פי' כעין נסר או ראש קורה הבולט מן העלייה ולחוץ) מכותלו על אויר חצר חבירו כל שהוא בעל החצר מעכב עליו שהרי מזיקו בראייה בעת שתולה בו ומשתמש בו: הגה וכל זמן שלא הסירו שהניחו בעל החצר מרצונו אין בעל הזיז משתמש בו מפני שמזיק לבעל החצר בראייה ובעל החצר משתמש בו (טור סעי"ד):
The law of putting out a projection and a gutter, setting up a ladder, and fixing beams; it contains twenty se'ifim. One who seeks to put out a projection (that is, something like a board or the end of a beam jutting out from the upper storey outward) from his wall over the air of his fellow's courtyard, however small — the owner of the courtyard may prevent him, for he damages him by sight when he hangs things on it and uses it. Hagah [Rema]: And so long as he has not removed it, the owner of the courtyard having left it of his own will, the owner of the projection does not use it, because he damages the owner of the courtyard by sight; and the owner of the courtyard uses it (Tur, se'if 14).
Se’if 2ב׳
הוציא את הזיז ולא מיחה בו בעל החצר לאלתר הרי החזיק בעל הזיז (ומשתמש בו ומונע בעל החצר להשתמש בו) (טור סע"ב): הגה וי"א דכל חזקות אלו בעינן ג' שנים וכל שלא החזיק ג' שנים יכול למחות וכן בעינן שיבא בטענה כמו בחזקת קרקע (טור בשם ר"ת והרא"ש) וכמו שנתבאר לעיל בסי' קמ"ו סעיף ט' וי"א דבזיז שאין בו טפח לא מהני חזקה כלל ויכול בעל החצר למחות בו כל זמן שירצה ואם לא מיחה בו והניחו מרצונו בעל החצר יכול להשתמש בו אבל לא בעל הזיז (טור בשם הרמ"ה והר"י ברצלוני והרא"ש):
If he put out the projection and the owner of the courtyard did not protest against him at once, the owner of the projection has established a presumptive right (and he uses it and prevents the owner of the courtyard from using it) (Tur, se'if 2). Hagah [Rema]: And there are those who say that for all these presumptive rights we require three years, and so long as he has not held it three years the other may protest; and likewise we require that he come with a plea, as with presumptive possession of land (Tur in the name of Rabbeinu Tam and the Rosh), as was explained above, siman 146, se'if 9. And there are those who say that with a projection that is not a handbreadth, a presumptive right does not avail at all, and the owner of the courtyard may protest against it whenever he wishes; and if he did not protest against it and left it of his own will, the owner of the courtyard may use it, but not the owner of the projection (Tur in the name of the Ramah and Rabbi Yehudah of Barcelona and the Rosh).

היה בזיז טפח החזיק באויר החצר כנגדו ואם רצה בעל החצר לבנות תחת הזיז ולבטל תשמישו בעל הזיז מעכב עליו ואם אין בזיז טפח לא החזיק באויר החצר וכל עת שירצה בעל החצר לבנות תחתיו ולבטל תשמישו של זיז אין בעל הזיז יכול לעכב עליו:
If the projection was a handbreadth, he has established a presumptive right over the air of the courtyard opposite it; and if the owner of the courtyard wants to build beneath the projection and cancel its use, the owner of the projection may prevent him. And if the projection is not a handbreadth, he has not established a presumptive right over the air of the courtyard, and whenever the owner of the courtyard wishes to build beneath it and cancel the use of the projection, the owner of the projection cannot prevent him.
