דין אלו שאין להם חזקה מתי יש להם חזקה. ובו סעיף אחד: כל אלו שאמרו אין להם חזקה בניהם יש להם חזקה שאם אכל הבן ג' שנים וטוען שהבעלים מכרוה או נתנוה לו יש לו חזקה אבל אם טען שהוא ירושה לו מאביו שאכלה שני חזקה אין לו חזקה (וכן בן הבן אם טוען שירשה מאבי אביו וכן עד עולם אבל אם טען בן הבן שירשה מאביו יש לו חזקה) [טור] ואם הביא עדים שהודו הבעלים לאביו שמכרוה או נתנוה לו מעמידים השדה בידו (וי"א דאפי' לא הביא (עדים) רק שאמרו בפנינו הודה לאבינו שמכרה לו נאמנים במגו שהיו אומרים לקוחה בידינו) [טור] חוץ מבן הגזלן שאף ע"פ שהביא ראיה שהודו הבעלים לאביו שמכרו לו אינו ראיה כמו שנתבאר: הגה מיהו אם אומר בפני מנה לך אבי המעות והוא החזיק שלשה שנים נאמן במיגו שהיה יכול לומר ממך לקחתי (טור) ובן בן הגזלן אפילו בא בטענת אביו יש לו חזקה אבל אם בא בטענת אבי אביו אין לו חזקה: הגה וי"א דאם בן בן הגזלן אומר בפני הודית שמכרת לאבי אבא הוה חזקה דכולי האי לא מטיל אימה בשביל בן בנו אבל אם בן הגזלן אמר בפני הודה שמכר לאבי לא מהני דמשום מורא הוצרך להודות גם בפניו (טור בשם הרא"ש):

The law of those who have no presumptive possession — when they have presumptive possession; it contains one se'if. All those of whom they said that they have no presumptive possession — their sons have presumptive possession: if the son ate it three years and pleads that the owners sold it or gave it to him, he has presumptive possession. But if he pleaded that it is an inheritance to him from his father, who ate it for the years of presumptive possession, he has no presumptive possession (and likewise a grandson, if he pleads that he inherited it from his father's father, and so on forever; but if the grandson pleaded that he inherited it from his father, he has presumptive possession) (Tur). And if he brought witnesses that the owners admitted to his father that they sold it or gave it to him, they leave the field in his hand (and some say that even if he did not bring (witnesses), but they said: in our presence he admitted to our father that he sold it to him, they are believed by a migo (a plea he could have made in which he would have been believed), since they could have said: it is bought by us) (Tur) — except for the son of a robber, for even though he brought proof that the owners admitted to his father that they sold it to him, it is no proof, as was explained. Hagah [Rema]: However, if he says: in my presence my father counted out the money to you, and he held it three years, he is believed by a migo, since he could have said: I bought it from you (Tur). And the grandson of a robber, even if he comes with his father's plea, has presumptive possession; but if he comes with his father's father's plea, he has no presumptive possession. Hagah [Rema]: And there are those who say that if the robber's grandson says: in my presence you admitted that you sold it to my father's father, it is presumptive possession, for he does not cast so much fear on account of his grandson; but if the robber's son said: in my presence he admitted that he sold it to my father, it does not help, for out of fear he had to admit in his presence too (Tur in the name of the Rosh).
