Se’if 1א׳

דין אלו שאין אכילתן ראיה. ובו ג סעיפים: כל אלו שאין אכילתן ראיה אם הביאו עדים שמכרו להם הבעלים שדה זו או ניתנה להם במתנה ראייתן ראיה חוץ מהגזלן ובעל בנכסי אשתו באיזה נכסים אמרו בנצ"ב או בשדה שייחד לה בכתובתה ובשדה שכתב לה בכתובתה ובשדה שנתן לה משלו אבל בנכסי מלוג יש לו ראיה:

The law of those whose eating is no proof; it contains three se'ifim. All those whose eating is no proof — if they brought witnesses that the owners sold them this field or gave it to them as a gift, their proof is proof, except for the robber, and a husband with his wife's property. With which property did they say this? With tzon barzel property (property whose value the husband guarantees), or with a field he set aside for her in her ketubah (the marriage settlement written for her), or a field he wrote to her in her ketubah, or a field he gave her of his own; but with melog property (the property of hers whose fruits her husband eats), he has proof.

Se’if 2ב׳

אשה בנכסי בעלה שהביאה עדים שמכרם לה נתבאר בטור אבן העזר:

A wife with her husband's property, who brought witnesses that he sold it to her — this was explained in Tur Even HaEzer.

Se’if 3ג׳

גזלן כיצד כיון שהוחזק גזלן על שדה זו אע"פ שהביא ראיה בשטר שהודה הבעל בפני עדים שמכר לו שדה ולקח דמים והבעלים אומרים לא מכרנו אלא מפני היראה הודינו לו מוציאין את השדה מידו ואין לו כלום (ואם כתב לו אחריות נכסים י"א דקנה [טור ס"ג בשם רי"א]) ואם העידו העדים שבפניהם מנה לו כך וכך (מעות) מוציאין השדה מיד הגזלן ומחזירין לו הבעלים הדמים: הגה וי"א דאם ראו העדים נתינת המעות ולא מסר המוכר מודעה תחלה מכירתו מכירה דקיי"ל תלוהו וזבין זביני' זבינא (טור בשם הרא"ש) וכנ"ל עיקר וע"ל סי' ר"ה בדיני מסירת מודעה:

A robber — how so? Since he is established as a robber in regard to this field, even though he brought proof by a document that the owner admitted before witnesses that he sold him the field and took the price, and the owners say: we did not sell; we admitted to him only out of fear — they take the field out of his hand, and he has nothing (and if he wrote him liability on his property, some say that he has acquired) (Tur, se'if 3, in the name of Rabbi Yehudah of Barcelona). And if the witnesses testified that in their presence he counted out to him such-and-such (money), they take the field out of the robber's hand, and the owners return the price to him. Hagah [Rema]: And there are those who say that if the witnesses saw the giving of the money, and the seller did not deliver a declaration of protest (made before witnesses, that what he does he does under duress) beforehand, his sale is a sale, for we hold: if they hung him and he sold, his sale is a sale (Tur in the name of the Rosh); and so it seems to me the principal view.
