Se’if 1א׳
מי שירד לתוך שדה בתורת משכון וחזר ועשה שטר מכירה. ובו ז סעיפים: מי שירד לתוך שדה אחת בתורת משכונא אין לו בה חזקה אם ידוע שבתורת משכונא ירד לתוכה ואם אין שם אלא קול בעלמא נתבאר בסי' קמ"ט (סעיף כ') ומ"מ עצה טובה לממשכן למחות בסוף כל שלש ושלש שמא יכבוש זה שטר המשכונא אחר שישכח הדבר ויטעון לקוח הוא בידי כההוא דמשכן פרדסא לחבריה לעשר שנין ולבתר דאכלה ג' שנין אמר ליה אי מזבנת לי מוטב ואם לא אכבוש שטר משכונא ואטעון לקוח הוא בידי:
One who went down into a field as a pledge and afterwards made a document of sale; it contains seven se'ifim. One who went down into a field by way of a mashkanta (a mortgage in which the lender eats the produce of the land) has no presumptive possession in it, if it is known that he went down into it by way of a mashkanta; and if there is only a mere rumour, it was explained in siman 149 (se'if 20). Nevertheless, it is good advice for the one who mortgaged it to protest at the end of every three years, lest this one suppress the document of mashkanta after the matter is forgotten and plead: it is bought by me — as in that case of one who mortgaged an orchard to his fellow for ten years, and after he had eaten it three years said to him: if you sell it to me, well and good; and if not, I will suppress the document of mashkanta and plead: it is bought by me.
Se’if 2ב׳
נתנה הממשכן לבנו במתנה וחזר ועשה שטר מכירה לבעל המשכונא שטר המכירה אינו כלום והמעות שנתן יותר על המשכונא אינם אלא כמלוה על פה:
If the one who mortgaged it gave it to his son as a gift, and then made a document of sale to the holder of the mashkanta — the document of sale is nothing, and the money he gave beyond the mashkanta is only as a loan by word of mouth.
Se’if 3ג׳
היכא שידוע שירד בתורת משכונא י"א שאין לו בה חזקה לעולם אפילו אם ידוע ששלמו ימי המשכונא והחזיק בה שלש שנים אחר כך וי"א שאם אכלה ג' שנים אחר שכלו ימי המשכונא יש לו חזקה ויש מי שאומר שאם העידו העדים ששדה זו משכונא אצלו ואינם יודעים לכמה שנים אפי' החזיק בה כמה שנים אין לו חזקה ואם העידו שמשכנה אצלו סתם ואכלה ג' שנים משנה ראשונה ואילך יש לו חזקה דסתם משכונא שתא:
Where it is known that he went down by way of a mashkanta, some say that he never has presumptive possession in it, even if it is known that the days of the mashkanta were completed and he held it three years afterwards; and some say that if he ate it three years after the days of the mashkanta ended, he has presumptive possession. And there is one who says that if the witnesses testified that this field is a mashkanta with him and they do not know for how many years, even if he held it several years he has no presumptive possession; and if they testified that he mortgaged it to him without specifying, and he ate it three years from the first year onward, he has presumptive possession, for an unspecified mashkanta is for a year.
