Se’if 1א׳
מי שאבדה לו דרך שדהו. ובו ב סעיפים: מי שהלך למדינת הים ואבד דרך שדהו בין שהיו ארבעה השדות המקיפים אותה לארבעה אנשים בין שהיו ארבעה שקנו מאחד הרי כל אחד מהם דוחהו ואומר שמא דרך שלך על חבירי הוא לפיכך יקנה לו דרך במאה מנה או יפרח באויר:
One whose way to his field was lost; it contains two se'ifim. One who went to a country overseas and the way to his field was lost — whether the four fields surrounding it belonged to four men, or whether four men bought them from one — each of them pushes him off and says: perhaps your way ran over my fellow's field. Therefore let him buy himself a way for a hundred maneh, or fly through the air.
Se’if 2ב׳
וכן אם היו ד' השדות לאיש אחד שקנה אותן מארבעה אין לו עליו דרך שהרי אומר לו עתה אם אחזיר לכל אחד שטרו אין אתה יכול לעבור על אחד מהם ואני קניתי מכל אחד מהם כל זכות שיש לו אבל אם היה בעל ד' השדות המקיפות איש אחד והוא בעל המצר מתחלה ועד סוף ה"ז אומר מכל מקום דרכי עליך וילך לו בקצרה באי זו שדה שירצה בעל השדה ואם החזיק בדרך [בדין חזקה] [המגיד פט"ו דטוען ] ואומר היא דרכי אין מסלקין אותו ממנה אלא בראיה ברורה:
And likewise, if the four fields belonged to one man who bought them from four, he has no way against him; for he says to him: now, if I return to each one his document, you cannot pass over any one of them, and I bought from each of them every right he had. But if the owner of the four surrounding fields was one man, and he was the owner of the boundary from beginning to end, he may say: in any case my way runs over you; and he goes by the shortest route, through whichever field the owner of the field wishes. And if he took possession of the way by the law of presumptive possession (the Maggid, chapter 15 of the Laws of Claimant and Defendant) and says: it is my way, they do not remove him from it except by clear proof.
