מחאה מבטלת החזקה ובאיזה לשון ובמה ומתי. ובו כה סעיפים: מחאה מבטלת החזקה אפי' מיחה המערער שלא בפני המחזיק אפילו הוא במדינה אחרת אם שיירו' מצויות ביניהם ובלבד שתהי' בפני עדים ודי בפני ב' ואפי' זקנים או חולים אע"פ שאינם יכולים לילך ולהודיע למחזיק שהם יאמרו הדבר לאחרים ואחרים לאחרים עד שישמע למחזיק:
A protest cancels presumptive possession: in what language, by what means, and when; it contains twenty-five se'ifim. A protest cancels presumptive possession, even if the challenger protested not in the presence of the one in possession, and even if he is in another country — if caravans are found between them — provided that it is before witnesses; and before two is enough, even old or sick men, even though they cannot go and inform the one in possession, for they will tell the matter to others, and others to others, until it is heard by the one in possession.
Se’if 2ב׳
אין מחאה בפחות משנים אבל באחד לא אפי' מיחה בפני המחזיק ואפי' שמודה במחאה דמתוך שיכול לומר לא מחית בי נאמן לומר לקוחה היא בידי ואע"פ שעד א' מכחישו ויש מי שחולק:
There is no protest with fewer than two; with one, no — even if he protested in the presence of the one in possession, and even if the one in possession admits the protest; for since he could say: you did not protest against me, he is believed to say: it is bought in my hand, even though one witness contradicts him. And there is one who disagrees.

אפי' אם יאמרו העדים שמיחה בפניהם לא הגדנו לשום אדם אפי' הכי הוי מחאה לבטל החזקה כיון שהוא מיחה כראוי וסמך עליהם שיאמרו אותו לאחרים ואחרים יאמרו לו ואפי' שאמר לעדים כשמיחה בפניהם אל תאמרו לו או שהם אמרו מעצמם לא נאמר לו הוי מחאה שהם יאמרו לאחרים ואחרים יאמרו לו ואפילו אמרו לא נוציא דבר זה מפינו הוי מחאה דמילתא דלא רמיא עליה דאינש אמר ולאו אדעתיה אבל אם הוא אמר לא יצא דבר זה מפיכם לא הוי מחאה.
Even if the witnesses say: he protested before us, and we told no one — even so it is a protest to cancel the presumptive possession, since he protested properly and relied on them to tell it to others, and others would tell him. And even if he said to the witnesses when he protested before them: do not tell him; or they said of their own accord: we will not tell him — it is a protest, for they will tell others and others will tell him. And even if they said: we will not let this matter out of our mouths — it is a protest, for a matter that does not lie upon a man he says without thinking. But if he said: let this matter not go out of your mouths — it is not a protest.

כיצד לשון המחאה אומר בפני ב' פלוני (שהוא) משתמש בחצרי או בשדי גזלן הוא ולעתיד אני תובע אותו בדין (וי"א שא"צ לומר אתבע אותו בדין) (טור בשם הרא"ש וב"י בשם רשב"ם ותוס') וכן אם אמר להם שכורה היא בידו או משכונא ואם יטעון עלי שמכרתי או נתתי אני תובע אותו בדין וכן כל כיוצא בזה ה"ז מחאה אבל אם אמר להם פלוני שמשתמש בחצרי גזלן הוא אין זו מחאה שהרי המחזיק אומר כששמעתי (זה) אמרתי שמא חירף אותי בלבד ולפיכך לא נזהרתי בשטרי: הגה ולא מהני אלא מחאת המערער שידוע שהקרקע היתה שלו אבל אם נתנה לו (למערער הזה) הקרקע בסתר ולא נתגלה שהיא שלו אין מחאתו כלום דהמחזיק יכול לומר לא חששתי במחאתו שלא ידעתי שהקרקע שלו (ב"י בשם הרשב"א):
What is the language of the protest? He says before two: so-and-so (who) is using my courtyard or my field is a robber, and in future I will summon him to judgment (and some say that he need not say: I will summon him to judgment) (Tur in the name of the Rosh, and Beit Yosef in the name of the Rashbam and the Tosafot). And likewise, if he said to them: it is hired in his hand, or held as a mashkanta (a mortgage in which the lender eats the produce of the land), and if he pleads against me that I sold it or gave it, I will summon him to judgment — and likewise anything like this — this is a protest. But if he said to them: so-and-so who is using my courtyard is a robber — this is not a protest, for the one in possession says: when I heard (this), I said: perhaps he was merely reviling me; and therefore I did not take care of my document. Hagah [Rema]: And only the protest of a challenger of whom it is known that the land was his avails; but if the land was given to him (to this challenger) in secret, and it was not revealed that it is his, his protest is nothing, for the one in possession can say: I paid no heed to his protest, for I did not know that the land was his (Beit Yosef in the name of the Rashba).

מחאה בפני ב' כותבין אע"פ שלא אמר להם כתובו: הגה ויכתבו בלשון שליחות פלוני העדנו על עצמו ליכתוב לו שמיחה אבל לא יכתבו שמענו שמיחה דהוי עדות מפי כתבם (נ"י פ' חזקת הבתים) וכיון שמיחה בשנה ראשונה א"צ לחזור ולמחות בכל שנה ושנה אבל צריך שלא יהא בין מחאה למחאה ג' שנים גמורות שאם שהה בין מחאה למחאה ג' שנים לא עלתה לו מחאה:
A protest before two — they write it, even though he did not say to them: write. Hagah [Rema]: And they should write it in the language of agency: so-and-so had us bear witness about himself, to write for him that he protested; but they should not write: we heard that he protested, for that would be testimony from their writing (Nimukei Yosef, chapter "The presumption of houses"). And once he protested in the first year, he need not protest again every single year; but there must not be three full years between one protest and the next, for if he waited three years between one protest and the next, his protest is of no avail.
