Se’if 1א׳
הביא המחזיק עדים ולא כיוונו עדותם בשנים. ובו ז סעיפים: עידי החזקה שהעיד האחד שאכלה חטים שני החזקה והשני העיד שאכלה שעורים עדותן קיימת שאין העד מדקדק בזה:
The one in possession brought witnesses, and their testimony did not agree as to the years; it contains seven se'ifim. Witnesses to presumptive possession, where one testified that he ate wheat from it in the years of presumptive possession and the second testified that he ate barley from it — their testimony stands, for a witness is not exact in this.
Se’if 2ב׳
העיד הא' שאכלה שנה ראשונ' שלישית וחמישית והשני העיד שאכלה בד"ו אין מצטרפין שבשנה שמעיד זה אינו מעיד בה זה ותחזור הקרקע והפירות:
If one testified that he ate it the first, third and fifth years, and the second testified that he ate it the second, fourth and sixth — they do not join, for in the year of which this one testifies, that one does not testify; and the land and the produce go back.
Se’if 3ג׳
לא מצא עדים אלא על ב' שנים צריך להחזיר הקרקע והפירות שאכל בין ששנים מעידים על השני שנים בין שעד אחד מעיד עליהם ומיהו פירות של שנה שלישית אין צריך להחזיר שאם נאמין לו שאכלם נצטרך להחזיקו בקרקע וכן אם הביא עד א' שאכלה ג' שנים מחזיר הקרקע ולא הפירות מהאי טעמא ואין צריך לומר כשאין עדים כלל על אכילת הפירות שמחזיר הקרקע ולא הפירות.
If he found witnesses only for two years, he must return the land and the produce that he ate — whether two testify concerning the two years or one witness testifies concerning them. However, the produce of the third year he need not return; for if we believed him that he ate them, we would have to keep him in possession of the land. And likewise, if he brought one witness that he ate it three years, he returns the land and not the produce, for this reason; and needless to say, where there are no witnesses at all to the eating of the produce, he returns the land and not the produce.
