Se’if 1א׳
דין המחזיק שלא בפני המערער והוא במדינה אחרת או ברח. ובו ד סעיפים: החזיק בקרקע פחות משלש שנים אינה חזקה אפי' החזיק בפני המערער ואם החזיק ג' שנים הוי חזקה אפילו החזיק שלא בפני המערער והוא במדינה אחרת אם שיירות מצויות ממקום שמחזיק בו למקום שהמערער בו אבל אם היתה מלחמה ושבוש דרכים בין מקום זה למקום זה לא הוי חזקה ואפילו יש עדים שבא המערער כאן לשוק ושהה כאן ל' יום והיו אלו ל' יום בסוף ג' שנים בענין שאם לא ימחה עתה לא יהיה לו עוד זמן למחות אפילו הכי יכול לומר כל אותם ל' יום שהייתי בכאן הייתי טרוד בעסקי ולא ידעתי שהיית מחזיק בביתי ומיירי שהיה לו בית אחר לדור בו ויש מי שאומר שדין זה אינו אלא בכפרים שהעם טרודין בשוקים שלהם: הגה וי"א דמזה יש ללמוד דהכל הולך אחר סוף הג' שנים שאם היה בתחלתן במקום שאין יכול למחות ובסוף במקום שיוכל למחות הוי חזקה ואם היה בתחילתן במקום שיוכל למחות והלך למקום שאין יכול למחות לא הוי חזקה דמה שלא מיחה בתחלה יש לומר שסמך למחות בסוף ולשוב אלא שלא נזדמן לו (נ"י פרק חזקת):
The law of one who holds possession not in the presence of the challenger, when he is in another country or has fled; it contains four se'ifim. If he held land in possession less than three years, it is not presumptive possession, even if he held it in the presence of the challenger. And if he held it three years, it is presumptive possession, even if he held it not in the presence of the challenger and he was in another country — if caravans are found going from the place of the one in possession to the place where the challenger is. But if there was war and disruption of the roads between this place and that place, it is not presumptive possession. And even if there are witnesses that the challenger came here to the market and stayed here thirty days, and these thirty days were at the end of the three years, in such a manner that if he did not protest now he would have no further time to protest — even so, he can say: all those thirty days that I was here, I was busy with my affairs and did not know that you were holding possession of my house; and the case is where he had another house to dwell in. And there is one who says that this law applies only in villages, where the people are busy with their markets. Hagah [Rema]: And some say that from this one may learn that everything goes after the end of the three years: that if at their beginning he was in a place where he could not protest, and at the end in a place where he could protest, it is presumptive possession; and if at their beginning he was in a place where he could protest, and he went to a place where he could not protest, it is not presumptive possession; for as to his not protesting at the beginning, one may say that he was relying on protesting at the end and returning, but the opportunity did not come to him (Nimukei Yosef, chapter "The presumption of houses").
Se’if 2ב׳
אין כל אלו הדברים אמורים אלא כשהדבר ידוע שלא היה המערער במדינה אבל אם אינו ידוע אין שומעין לו במה שאמר שלא היה כאן עד שיברר בעדים:
All these things are said only when the matter is known, that the challenger was not in the country; but if it is not known, they do not listen to him in what he said, that he was not here, until he makes it clear by witnesses.
Se’if 3ג׳
ברח המערער מחמת סכנת נפשות אין מחזיקין בנכסיו שירא למחות פן יודע מקומו וירדפו אחריו אבל אם ברח מחמת ממון מחזיקין בנכסיו שאינו ירא כל כך:
If the challenger fled because of danger to life, they do not take possession of his property, for he is afraid to protest lest his whereabouts become known and they pursue him. But if he fled because of money, they take possession of his property, for he is not so afraid.
