דין סיוע המערער למחזיק בהזקתו ואם היה הסיוע בטעות. ובו ג סעיפים: אע"פ שאין חזקה בפחות מג' שנים אם הביא המחזיק עדים שהמערער הגביה סל פירות משדה זו על כתפו של המחזיק להוליכם לביתו של המחזיק לעצמו הוי חזקה מיד: הגה וי"א דה"ה אם המחזיק שלח דורון למערער מפירות שאוכל וקבלן ממנו הוי חזקה (מיד) שאם היה הקרקע שלו לא ה"ל לקבלן בתורת דורון אלא היה לו ליקח הכל (טור בשם ר"ח) ומכאן יש ללמוד ראובן ושמעון שיש להם ערעור ביחד על חזקת ישוב וקנה ראובן משמעון החזקה לשנה הרי הישוב לשמעון שאילו היתה החזקה לראובן לא היה קונה משמעון לשנה וה"ה בכל כיוצא בזה (מרדכי סוף פ' חזקת) וה"ה אם שכרו ממנו כדלקמן סימן קמ"ז: ואם טען המערער לפירות הורדתיו ושלו היו הפירות אבל הגוף לא מכרתי נאמן ואין בזה שום חזקה והני מילי בתוך ג' אבל אם יטעון לאחר ג' לפירות הורדתיו אין שומעין לו לפיכך אם הורידו לפירות צריך למחות בתוך שלשה להודיע שלפירות הורידו:

The law of the challenger's assistance to the one in possession in his possession, and if the assistance was in error; it contains three se'ifim. Even though there is no presumptive possession in less than three years, if the one in possession brought witnesses that the challenger lifted a basket of produce from this field onto the shoulder of the one in possession, to carry it to the house of the one in possession for himself, it is presumptive possession at once. Hagah [Rema]: And some say that the same applies if the one in possession sent the challenger a present of the produce that he eats, and he accepted it from him: it is presumptive possession (at once); for had the land been his, he would not have accepted it by way of a present, but would have taken the whole (Tur in the name of Rabbeinu Chananel). And from this one may learn: Reuven and Shimon, who have a dispute together over a right of settlement, and Reuven bought the right from Shimon for a year — the settlement right is Shimon's; for had the right been Reuven's, he would not have bought it from Shimon for a year; and the same applies in every case like this (Mordechai, end of chapter "The presumption of houses"). And the same applies if he hired it from him, as below, siman 147. And if the challenger pleaded: I let him in for the produce, and the produce was his, but the land itself I did not sell — he is believed, and there is no presumptive possession in this at all. And these words apply within three years; but if he pleads after three years: I let him in for the produce — they do not listen to him. Therefore, if he let him in for the produce, he must protest within three years, to make known that he let him in for the produce.

נפל הכותל שבין ראובן ושמעון ובנה ראובן הכותל והכניסו לגבול שמעון שטעה שלא היה מכיר מקום הראשון של הכותל אע"פ שסייעו שמעון בבנין לא הוי חזקה להחזיק במה שלקח מגבול שמעון כיון שהיה הסיוע בטעות אבל אם שמעון המסייע מודה שידע שהכניס ראובן בתוך שלו הוי חזקה אע"פ שלא ידע ראובן הבונה וקנה המקום שהכניס לתוך של שמעון מיד:

If the wall between Reuven and Shimon fell, and Reuven built the wall and brought it into Shimon's boundary, because he erred and did not recognise the former place of the wall — even though Shimon assisted him in the building, it is not presumptive possession, to hold what he took of Shimon's boundary, since the assistance was in error. But if Shimon, who assisted, admits that he knew that Reuven was bringing it into what was his, it is presumptive possession, even though Reuven the builder did not know; and he acquired at once the place that he brought into Shimon's.

אם ראובן פתח חלון לחצר שמעון בפניו יש אומרים דלא הוי חזקה אפילו סייעו בפתיחתה ולהרמב"ם כיון שידע הניזק בפתיחת החלון ולא מיחה אינו יכול לחזור ולערער:

If Reuven opened a window onto Shimon's courtyard in his presence, some say that it is not presumptive possession, even if he assisted him in opening it; and according to the Rambam, since the injured party knew of the opening of the window and did not protest, he cannot go back and contest it.
