דין חזקת שדה הלבן והאילן. ובו כ סעיפים: שלש שנים שאמרו מיום ליום אפי' היו חסרים יום א' לא החזיק ומסלקין אותו ממנה במה דברים אמורים בקרקע שהם עושים פירות (תמיד) הבתים והחצירות והבורות והשיחין והמערות והחניות והפונדקאות והמרחצאות והשובכות ובתי הבדי' ובתי השלחין (פי' שעוצרין שם הזיתים ופי' בתי השלחין שדות שצריך להשקותן ביד תרגום עיף ויגע משלהי ולאי ואותיות אהח"ע מתחלפות ופי' שדה הבעל שדה שהגשמים משקין אותה והרי הן לה כבעל הנותן הריון לאשתו להולידה ולהצמיחה) שמשקין אותם תמיד וזורעים בהן ונוטעים והגנות והפרדסים וכן עבדים המהלכים אבל שדה הבעל שהיא שותה מי גשמים בלבד ושדה אילן אינה מיום ליום אלא כיון שאכל שלש תבואות ממין אחד הרי אלו כשלשה שנים כיצד היתה שדה תמרים וגדר שלש גדרות או שדה ענבים ובצר שלשה בצירות או שדה זיתים ומסק שלשה מסיקות הרי אלו כשלש שנים והחזיק ואפי' היו האילנות רצופים ולא היה ביניהם הרחק כראוי שהרי סופן ליבש הואיל ואכלן שלש' [תבואות] החזיק: הגה ויש אומרים דגם בשדה בעל ושדה אילן בעינן חזקה ג' שנים (טור בשם הרא"ש וה"ר יונה) וכנ"ל להורות:
The law of presumptive possession of a grain field and of a field of trees; it contains twenty se'ifim. The three years they spoke of are from day to day; even if they were short by one day, he has not taken possession, and they remove him from it. In what case are these words said? With land that yields its fruit (continually): the houses, the courtyards, the pits, the ditches, the caves, the shops, the inns, the bathhouses, the dovecotes, the olive-press houses and the irrigated fields (that is, the olive-press houses are where they press the olives; and "irrigated fields" are fields that must be watered by hand — the Targum of "faint and weary" is meshalhei ve-la'ei, and the letters alef, he, chet and ayin interchange; and "a rain-fed field", sedeh ha-ba'al, is a field that the rains water, and they are to it as a husband, a ba'al, who gives conception to his wife, to bring forth and to make sprout) — which they water continually, and sow in them and plant — and the gardens and the orchards, and likewise slaves who walk. But a rain-fed field, which drinks rainwater alone, and a field of trees — it is not from day to day; rather, once he has eaten three crops of one kind, these are as three years. How so? If it was a field of date palms and he cut three harvests of dates, or a field of grapes and he gathered three vintages, or a field of olives and he picked three olive harvests, these are as three years, and he has taken possession. And even if the trees were set close together, without the proper distance between them, so that in the end they will wither — since he ate three crops of them, he has taken possession. Hagah [Rema]: And some say that with a rain-fed field and a field of trees too we require three years' presumptive possession (Tur in the name of the Rosh and Rabbeinu Yonah); and so it seems to me right to rule.
Se’if 2ב׳
ג' שנים שאמרו צריך (שיהיו) רצופות זו אחר זו הרי שהחזיק בשדה וזרעה שנה והוביר שנה (פירוש הניחה שממה תרגום והאדמה לא תשם לא תבור) אפי' עשה כן כמה שנים לא החזיק:
The three years they spoke of must (be) consecutive, one after another. If he held a field in possession and sowed it one year and left it fallow one year (that is, he left it desolate; the Targum of "that the land be not desolate" is lo tevur) — even if he did so for several years, he has not taken possession.
Se’if 3ג׳
היה דרך בני אותו המקום להוביר אף ע"פ שמקצתם זורעים שנה אחר שנה ה"ז החזיק ואע"פ שהשלש שנים שאכל הן מפוזרות שהרי הוא אומר לא הוברתי אותה אלא כדי שתעשה הרבה בשעת הזריעה:
If the way of the people of that place is to leave fields fallow, even though some of them sow year after year, this one has taken possession, even though the three years in which he ate are scattered; for he says: I left it fallow only so that it would produce much at the time of sowing.
