Se’if 1א׳
דין המחזיק בקרקע של חבירו ודין חזקת הבתים וחניות. ובו טו סעיפים: קרקע בחזקת בעליה עומדת שקרקע הידוע לראובן בעדים שיודעים שהיה בחזקתו אפילו יום אחד והוא עתה בחזקת שמעון ומחזיק בו ואוכל פירותיו וטוען שלקחו וראובן מערער לומר שהיא גזולה בידו נאמן וישבע שבועת היסת ונוטל את שלו אא"כ החזיק בו שמעון כראוי ובטענה אז אין מוציאין אותו מידו אלא נשבע (היסת) ועומד בשלו ואם אין עדים לראובן שהיה שלו אין צריך שמעון חזקה אלא נשבע ועומד בשלו אע"פ שלא החזיק בו (ועיין לעיל ריש סי' צ"ה דאין נשבעים על קרקעות רק היסת):
The law of one who is in possession of his fellow's land, and the law of presumptive possession of houses and shops; it contains fifteen se'ifim. Land stands in the presumptive possession of its owners. For land known to be Reuven's by witnesses who know that it was in his possession even one day, and it is now in Shimon's possession, and he holds it and eats its produce and pleads that he bought it, and Reuven contests it, saying that it is robbed in his hand — Reuven is believed, and he swears the oath of hesset (the oath the Sages imposed on one who denies a claim outright) and takes what is his; unless Shimon held it in possession properly and with a plea, for then they do not take it out of his hand, but he swears (the oath of hesset) and stands on what is his. And if Reuven has no witnesses that it was his, Shimon needs no presumptive possession, but swears and stands on what is his, even though he did not hold it in possession (and see above, beginning of siman 95, that one does not swear concerning lands except the oath of hesset).
Se’if 2ב׳
זה שהחזיק שלשה שנים אין מוסרין אותו לשבועה אבל אם רצה להחרים סתם על כל מי שהחזיק בשלו שלא כדין הרשות בידו: הגה זהו סברא אחרת וחולקת על מה שכתוב ראשונה שאע"פ שהחזיק כראוי ובטענה נשבע ועומד בשלו (וכן הוא בסמוך סעיף ד'): (והיא סברת הרמב"ם פי"א מטוען בטור בסי' זה):
This one who held it in possession three years — they do not submit him to an oath; but if the other wishes to pronounce a general cherem (the severer form of the ban) against whoever holds what is his unlawfully, he has the right. Hagah [Rema]: This is another view, and it disagrees with what was written first, that even though he held it in possession properly and with a plea, he swears and stands on what is his (and so it is shortly, in se'if 4) (and it is the view of the Rambam, chapter 11 of the Laws of Claimant and Defendant, in the Tur in this siman).
Se’if 3ג׳
טען שמעון שיש לו שטר שמכרה לו וראובן אומר ששטרו מזויף או שטר אמנה יתקיים השטר בחותמיו (וע"ל ס"ס מ"ו) ואם לא נתקיים מוציאין השדה מידו:
If Shimon pleaded that he has a document that Reuven sold it to him, and Reuven says that his document is forged, or is a trust document (one written in trust before any money was given), the document shall be confirmed through its signatories (and see above, end of siman 46); and if it was not confirmed, they take the field out of his hand.
