Se’if 1א׳
דין שנים האוחזין בטלית וחלוקים עליו. ובו ח סעיפים: שנים שהיו אוחזים בכלי א' או שהיו רוכבים על גבי בהמה אחת (וע' לקמן סי' רע"א איזה רוכב אינו קונה) (ע"ל סי' קנ"ה ס"ה) או שהיה אחד רוכב ואחד מנהיג או יושבים בצד ערימה של חיטים המונחים בסימטא או בחצר של שניהם (מיהו אם הבית של אחד ולקח את חבירו אצלו וחלוקים על הנכסים שבבית הרי הם בחזקת המוחזק בבית) (ריב"ש סי' רס"ד) זה אומר הכל שלי וזה אומר הכל שלי כל אחד מהם נשבע (בנקיטת חפץ) שיש לו בזה הדבר ושאין לו בה פחות מחציו ויחלוקו ואם אמר אחד לחבירו השבע וטול כולו שומעין לו ואם גם השני אינו רוצה לישבע חולקין בלא שבועה: הגה שנים שהיו חלוקין על גג שעל ביתם וכל אחד אומר כולה שלי הרי הוא כאילו שניהם תופסים בו וחולקין (ריב"ש סי' תל"ד):
The law of two who hold a cloak and dispute over it; it contains eight se'ifim. Two who were holding one vessel, or were riding on one animal (and see below, siman 271, which rider does not acquire) (see below, siman 155, se'if 5), or one was riding and one leading; or they were sitting beside a heap of wheat lying in an alley or in the courtyard of both of them (however, if the house is of one of them, and he took his fellow in with him, and they dispute over the goods in the house, they are in the presumptive possession of the one who holds the house) (Rivash, siman 264) — this one says: it is all mine, and that one says: it is all mine — each of them swears (holding a sacred object) that he has a share in this thing, and that he has in it no less than half, and they divide. And if one said to his fellow: swear and take all of it — they listen to him. And if the second too does not wish to swear, they divide without an oath. Hagah [Rema]: Two who were disputing over the roof on top of their house, and each one says: all of it is mine — it is as though both of them are holding it, and they divide (Rivash, siman 434).

ואם זה אומר כולה שלי וזה אומר חציה שלי האומר כולה שלי ישבע שיש לו בה ושאין לו בה פחות משלשה חלקים והאומר חציה שלי ישבע שיש לו בה ושאין לו בה פחות מרביע זה נוטל שלשה חלקים וזה נוטל רביע: הגה ואם הוא דבר הראוי לחלוק יוכל ליטול החצי שמודה לו בלא שבועה ונשבע כל אחד אח"כ שאין לו בנשאר פחות מחציו (המ"מ בפרק ט' מטוען בשם הרשב"א):
And if this one says: all of it is mine, and that one says: half of it is mine — the one who says "all of it is mine" swears that he has a share in it and that he has in it no less than three parts, and the one who says "half of it is mine" swears that he has a share in it and that he has in it no less than a quarter; this one takes three parts and that one takes a quarter. Hagah [Rema]: And if it is a thing fit to be divided, he can take the half that the other admits to him without an oath, and afterwards each one swears that he has no less than half of the remainder (the Maggid Mishneh, chapter 9 of the Laws of Claimant and Defendant, in the name of the Rashba).

במה דברים אמורים כשאוחזין בשפת הטלית שאין ביד שום אחד ממנה שלש (אצבעות) על שלש אז חולקין אותה אפילו שהטלית מוזהבת והזהב לצד אחד מהם ואינו יכול לומר חלוק אותה לרחבה שיבא הזהב לחלקי אלא חולקים אותה לארכה כדי שיבא לשניהם בשוה אבל אם כל אחד קצתה בידו וזה אומר כולה שלי וזה אומר כולה שלי זה נוטל עד מקום שידו מגעת וזה נוטל עד מקום שידו מגעת והשאר חולקים בשוה ונשבעים על הדרך שנתבאר ויש לכל אחד לגלגל על חבירו שכל מה שנטל כדין נטל:
In what case does the above apply? When they are gripping the edge of the garment, such that neither of them is holding 3 (fingers) by 3 -- then we split it, even if the garment is embroidered with gold and the gold is nearer to one of them, yet he cannot say "split it horizontally; so that the gold will be in my portion", rather we split it lengthwise, so that they will receive it equally. But if each has some of it in his hand, and he says "all of it is mine" and he says "all of it is mine", he receives until the point that his hand reaches and he receives until the point that his hand reaches, and the remainder is split equally, and they swear upon it, as we shall explain, and each one of them can make the other swear that what they took they took lawfully, by way of the oath upon the remainder.
