Siman 136 of 427 in Choshen Mishpat — 2 se'ifim

Guarantors· siman 136

Choshen Mishpat is set from the Lemberg 1898 edition, which is unpointed, so the vowels switch has nothing to remove here.

Se’if 1א׳

One whose vessels were exchanged in the house of mourning or of feasting; it contains two se'ifim. One whose vessels were exchanged for him at the craftsman's house — this one may use them until the owner of the vessel comes and takes his own. And that is specifically where the craftsman himself gave it to him; but if it was only his wife and his children who gave them to him, no. And even with the craftsman himself, it is specifically where he said to him without specifying: here is a cloak; but if he said to him: here is your cloak, no.

Se’if 2ב׳

If his vessels were exchanged for him in the house of mourning or in the house of feasting, he shall not use them. Hagah [Rema]: And when the owner of the article comes, he must give the article to its owner, even though his own was lost; and likewise with a gentile washerwoman who washes for many and brought one person something that is not his (Terumat haDeshen, siman 319).
