Se’if 1א׳

מי שמוחזק במטלטלין הידועים לאחר. ובו ז סעיפים: כל דבר המטלטל שהוא ביד האדם בחזקת שהוא שלו אפילו אם יביא המערער עדים שהוא שלו ואומר למוחזק הפקדתיו לך או השאלתיו לך נאמן המוחזק לומר אתה מכרתו לי או נתתו לי במתנה וישבע היסת ואם טען שלך הוא אבל משכון הוא בידי יכול לטעון עד כדי דמיו ונשבע בנקיטת חפץ ונוטל ואם טוען נתחייבת לי עד כדי דמיו מעסק משא ומתן שבינינו (טור ס"ג בשם הרא"ש) נכון הדבר שיברר ממה נתחייב לו שמא הוא סבור שנתחייב לו וכשיברר דבריו שמא אינו חייב לו:

One who is in possession of movables known to belong to another; it contains seven se'ifim. Any movable thing that is in a man's hand is in the presumption that it is his. Even if the challenger brings witnesses that it is his, and says to the one in possession: I deposited it with you, or: I lent it to you — the one in possession is believed to say: you sold it to me, or: you gave it to me as a gift; and he swears the oath of hesset (the oath the Sages imposed on one who denies a claim outright). And if he pleaded: it is yours, but it is a pledge in my hand — he can plead up to its value, and he swears holding a sacred object, and takes. And if he pleads: you became obliged to me up to its value from the business dealings between us (Tur, se'if 3, in the name of the Rosh) — it is proper that he make clear from what the other became obliged to him; perhaps he thinks that the other became obliged to him, and when he makes his words clear, perhaps the other does not owe him.

Se’if 2ב׳

אפילו אם מסר המערער החפץ למחזיק בעדים אם אין עדים שהוא עתה בידו נאמן בשבוע' היסת לומר החזרתיו לך וכן נאמן לומר לקוח הוא (בידי) במגו דהחזרתיו לך ואם אמר ליה אל תחזיר אלא בעדים והוא אומר החזרתיו לך נאמן במגו דנאנסו וישבע שבועה דאוריית' ואם טוען החזרתיו לך בפני פלוני ופלוני ומתו או הלכו להם למדינת הים נשבע היסת ונפטר ואם לא מסרו לו בעדים אפילו אם ראו אותו עתה בידו נאמן לומר לקוח הוא בידי אבל אם מסרו לו בעדים וגם ראוהו עתה בידו אינו נאמן ודוקא שהעדים מעידים שנתנו לו בתורת פקדון אבל אם מעידים שנתנו לו סתם יכול לומר בתורת מכר או מתנה נתנו לי:

Even if the challenger handed the article to the one in possession before witnesses, if there are no witnesses that it is now in his hand, he is believed with the oath of hesset to say: I returned it to you; and likewise he is believed to say: it is bought (in my hand), by a migo (a plea he could have made in which he would have been believed) of: I returned it to you. And if he said to him: do not return it except before witnesses — and he says: I returned it to you — he is believed by a migo of: it was lost by mishap, and he swears an oath by Torah law. And if he pleads: I returned it to you before so-and-so and so-and-so, and they died or went overseas, he swears the oath of hesset and is exempt. And if he did not hand it to him before witnesses, even if they now see it in his hand, he is believed to say: it is bought in my hand. But if he handed it to him before witnesses and they also now see it in his hand, he is not believed; and that is specifically where the witnesses testify that he gave it to him by way of a deposit; but if they testify that he gave it to him without specifying, he can say: he gave it to me by way of sale or gift.

Se’if 3ג׳

אם ראו עדים החפץ ביד המחזיק קודם שתבעו המערער לדין אפי' אם אמר בפניהם קודם שהראהו דעו כי הוא ממושכן לי בכדי דמיו קרינן ביה שפיר עדים וראה ויתרה בו בפני אותם עדים שלא יחזירהו לו אלא בפני פלוני ופלוני כדי שלא יוכל לטעון החזרתיו לך (וע' לעיל סי' ע"ב סעיף י"ח):

If witnesses saw the article in the hand of the one in possession before the challenger summoned him to judgment — even if, before he showed it to them, he said before them: know that it is pledged to me for its value — we rightly call this "witnesses who saw"; and he should warn him before those witnesses that he is not to return it to him except before so-and-so and so-and-so, so that he cannot plead: I returned it to you (and see above, siman 72, se'if 18).
