Se’if 1א׳
עבד ואשה וקטן שערבו ושנים שנעשו ערבים בשביל אחד ואחד בשביל שנים. ובו ו סעיפים: עבד או אשת איש שערבו לאחרים או נכנסו קבלנים ונתחייבו לשלם אין חייבים לשלם עד שישתחרר העבד ותתאלמן האשה או תתגרש אבל קטן שערב לאחרים אינו חייב לשלם אף לכשיגדיל (טור ס"ב בשם הגאונים):
A slave, a woman and a minor who became guarantors; and two who became guarantors for one, and one for two; it contains six se'ifim. A slave or a married woman who became guarantors for others, or entered as kablanim (guarantors from whom the lender may collect directly) and became liable to pay — they need not pay until the slave is freed and the woman is widowed or divorced. But a minor who became guarantor for others need not pay even when he grows up (Tur, se'if 2, in the name of the Geonim).
Se’if 2ב׳
אשה פנויה שערבה לאחרים ונשאת דינה כלוותה ונשאת שאם ערבה על פה (אינה) חייבת לשלם עד שתתאלמן או תתגרש ואם ערבה בשטר גובה ממנה ממה שהכניסה לבעלה:
An unmarried woman who became guarantor for others and then married — her law is as one who borrowed and then married: that if she became guarantor by word of mouth, she is (not) liable to pay until she is widowed or divorced; and if she became guarantor by document, one collects from her from what she brought in to her husband.
Se’if 3ג׳
שנים שערבו לא' כשיבא המלוה ליפרע מהערב יפרע מאיזה מהם שירצה ואם לא היה לאחד מהם כדי החוב חוזר ותובע מהשני שאר החוב ויש חולקים ואומרים שאם יכול להפרע משניהם לא יפרע מאחד מהם הכל אלא גובה מזה מחצה ומזה מחצה אלא א"כ אין לאחד מהם שאז גובה מהשני הכל ואם אמר ממי שארצה אפרע יפרע מאיזה מהם שירצה:
Two who became guarantors for one: when the lender comes to be paid from the guarantor, he is paid from whichever of them he wishes; and if one of them did not have the amount of the debt, he turns and claims the rest of the debt from the second. And there are those who disagree and say that if he can be paid from both of them, he shall not be paid all of it from one of them, but collects half from this one and half from that one, unless one of them has nothing, for then he collects all of it from the second. And if he said: from whichever I wish I shall be paid — he is paid from whichever of them he wishes.
