Se’if 1א׳
מי שחזר בו אחר שנתרצ' להיות ערב. ובו יד סעיפים: מי שנתפייס להיות ערב קודם שיתן המלוה המעות ללוה יכול לחזור בו אפי' קנו מידו ואם לא חשש המלוה ונתן המעות ללוה אין לו על הערב כלום אבל ערב דלאחר מתן מעות כיון שקנו מידו אינו יכול לחזור בו (ואין חילוק בזה בין ערב לקבלן) (מרדכי ס"פ ג"פ):
One who retracted after he had consented to be a guarantor; it contains fourteen se'ifim. One who agreed to be a guarantor before the lender gave the money to the borrower can retract, even if a kinyan (a formal act of acquisition) was made from him; and if the lender took no care and gave the money to the borrower, he has nothing against the guarantor. But a guarantor after the giving of the money, once a kinyan was made from him, cannot retract (and there is no difference in this between a guarantor and a kablan, a guarantor from whom the lender may collect directly) (Mordechai, end of chapter "A plain bill of divorce").
Se’if 2ב׳
האומר לחבירו ערבת לי והוא אומר לא ערבתי או שאמר הערב ללוה אתה הרשיתני לערוב אותך וליתן והוא אומר מדעתך ערבת או לא ערבת כלל או שאמר הערב פרעתי המלוה בפניך והלוה אומר לא פרעת או שא"ל כן פרעת ונתתי לך מה שפרעת או שאמר המלוה ערבת לי ק"ק והוא אומר לא ערבתי אלא מנה בכל אלו הטענות וכיוצא בהן המע"ה או ישבע הנתבע שבועת היסת או שבועת התורה אם הודה במקצת:
One who says to his fellow: you became guarantor to me — and he says: I did not become guarantor; or the guarantor said to the borrower: you authorised me to become guarantor for you and to pay — and he says: you became guarantor of your own accord, or: you did not become guarantor at all; or the guarantor said: I paid the lender in your presence — and the borrower says: you did not pay; or he said to him: yes, you paid, and I gave you what you paid; or the lender said: you became guarantor to me for two hundred — and he says: I became guarantor only for a maneh — in all these pleas and the like, the one who takes from his fellow bears the burden of proof; or the defendant swears the oath of hesset (the oath the Sages imposed on one who denies a claim outright), or an oath by Torah law if he admitted part.
Se’if 3ג׳
ערב או קבלן שרואים שהלוה מבזבז נכסיו יכולים לתבעו שיוציאם מהערבות אע"פ שהוא בתוך הזמן (וכ"כ לעיל בסי' ע"ג ס"י במלוה עם הלוה):
A guarantor or a kablan who see that the borrower is squandering his property can claim from him that he get them out of the guarantee, even though it is within the term (and so it was written above, siman 73, se'if 10, concerning the lender with the borrower).
