Se’if 1א׳
דין הערב שפרע למלוה כיצד נפרע מן הלוה. ובו ז סעיפים: ערב או קבלן שפרעו למלוה בפני עדים אם פרעו קודם שנודע אם פרעו הלוה וטוען הלוה שכבר פרעו אינו חייב לערב כלום אבל אם פרעו אחר שהביא המלוה ראיה שלא נפרע צריך הלוה ליתן לו כל מה שפרע בשבילו בין שנתחייב לוה למלוה בשטר בין שנתחייב לו בעל פה אפי' בלא עדים:
The law of the guarantor who paid the lender: how he is repaid from the borrower; it contains seven se'ifim. A guarantor or a kablan (a guarantor from whom the lender may collect directly) who paid the lender before witnesses: if he paid him before it was known whether the borrower had paid him, and the borrower pleads that he already paid him, he owes the guarantor nothing. But if he paid him after the lender brought proof that he had not been paid, the borrower must give him all that he paid on his behalf — whether the borrower was obliged to the lender by document or was obliged to him by word of mouth, even without witnesses.
Se’if 2ב׳
יש מי שאומר בד"א כשא"ל הלוה בעת שנעשה לו ערב ערבני ושלם אבל אם עמד מעצמו ונעשה לו ערב או קבלן וקדם ופרע למלוה ולא הרשהו הלוה לפרוע אין הלוה חייב לשלם לו כלום ואם אמר לו הלוה הכנס קבלן בעבורי אף ע"פ שלא הרשהו לשלם אם עמד הקבלן ופרע מדעתו אפי' עד שלא עמד המלוה עם הלוה בדין ולא נמצאו לו נכסים חייב לשלם לו אבל אמר ליה להכנס ערב ולא הרשהו לשלם אם משעמד המלוה עם הלוה בדין ולא נמצאו לו נכסים פרע הערב למלוה חייב הלוה לשלם לו ואם עד שלא עמד המלוה עם הלוה בדין ולא נמצאו לו נכסים פרעו הערב אין הלוה חייב לשלם לו כלום ויש מי שחולק ואומר שאפי' ערב שאינו קבלן שנכנס בערבות מאליו ופרע מאליו חוזר וגובה מהלוה: הגה ע' לעיל סוף סי' מ"ט דאין ערב משתעבד אלא במקום שיכול לגבות מהלוה:
There is one who says: in what case are these words said? Where the borrower said to him, at the time he became his guarantor: be my guarantor and pay. But if he stood up of his own accord and became his guarantor or kablan, and went ahead and paid the lender, and the borrower did not authorise him to pay, the borrower need not pay him anything. And if the borrower said to him: enter as kablan on my behalf — even though he did not authorise him to pay, if the kablan stood up and paid of his own accord, even before the lender stood in judgment with the borrower and no property was found for him, the borrower must pay him. But if he told him to enter as guarantor and did not authorise him to pay: if the guarantor paid the lender after the lender stood in judgment with the borrower and no property was found for him, the borrower must pay him; and if the guarantor paid him before the lender stood in judgment with the borrower and no property was found for him, the borrower need not pay him anything. And there is one who disagrees and says that even a guarantor who is not a kablan, who entered the guarantee of his own accord and paid of his own accord, goes back and collects from the borrower. Hagah [Rema]: See above, end of siman 49, that a guarantor is bound only where he can collect from the borrower.
Se’if 3ג׳
אין הערב גובה מהלוה עד שיביא עדים שפרע בשבילו אבל כל זמן שאין לו עדים אינו גובה ממנו כלום אפי' אם שטר החוב בידו ואם כתב המלוה לערב קבלתי ממך דמי החוב מהני ליה לגבות מהלוה וכגון שמפורש הערבות בשטר או שהלוה מודה בו דאל"כ במה אנו יודעים שהוא ערב:
The guarantor does not collect from the borrower until he brings witnesses that he paid on his behalf; but so long as he has no witnesses, he collects nothing from him, even if the document of debt is in his hand. And if the lender wrote for the guarantor: I have received from you the money of the debt — it avails him to collect from the borrower; that is, where the guarantee is set out in the document, or the borrower admits it, for otherwise, by what do we know that he is a guarantor?
