Se’if 1א׳
דין הערב בשטר ועל פה ומתי נפרעין מן הערב. ובו כב סעיפים: המלוה את חבירו ואחר שהלוהו אמר לו אחר אני ערב או שתבע את הלוה בדין ואמר לו אחר הנח ואני ערב או שהיה חונק את חבירו בשוק ליתן לו ואמר לו הנח ואני ערב אין הערב חייב כלום ואפי' אמר בפני ב"ד אני ערב: הגה מיהו אם פרע למלוה בציווי הלוה חייב לשלם לו מה שנתן למלוה (הגהות מיי' פכ"ה ממלוה) אבל אם קנו מידו שהוא ערב ממון זה בין בפני ב"ד בין בינו לבין המלוה נשתעבד (האומר לחבירו אני ערב לך בעד יום אחד אינו כלום) (תשו' רשב"א סי' אלף קמ"ח):
The law of the guarantor by document and by word of mouth, and when payment is exacted from the guarantor; it contains twenty-two se'ifim. One who lends to his fellow, and after he lent to him another said to him: I am guarantor; or he claimed from the borrower in court and another said to him: leave him, and I am guarantor; or he was throttling his fellow in the market to make him pay him, and another said to him: leave him, and I am guarantor — the guarantor is not liable for anything, even if he said before the court: I am guarantor. Hagah [Rema]: However, if he paid the lender at the borrower's instruction, the borrower must pay him what he gave the lender (Hagahot Maimoni, chapter 25 of the Laws of Lender and Borrower). But if a kinyan (a formal act of acquisition) was made from him that he is guarantor for this money, whether before the court or between him and the lender, he is bound (one who says to his fellow: I am your guarantor for one day — it is nothing) (responsum of the Rashba, siman 1148).

אמר להם בשעת מתן מעות הלוהו ואני ערב נשתעבד הערב ואינו צריך קנין: הגה ואפי' לא נתערב בהדיא רק שאומר למלוה להלוות ללוה כי בטוח הוא ועשאו על פיו והיה שקר חייב לשלם לו דהוי כאילו נתערב לו (מהרי"ו סי' פ') וכן אם ב"ד עשו אותו ערב נשתעבד אע"פ שלא קנו מידו כגון שהיו ב"ד רוצים לגבות מהלוה ואמר להם הניחוהו ואני ערב לכם הואיל ויש לו הנאה שהאמינוהו ב"ד באותה הנאה שעבד עצמו:
If he said to them at the time of the giving of the money: lend him, and I am guarantor — the guarantor is bound, and a kinyan is not needed. Hagah [Rema]: And even if he did not explicitly become guarantor, but only told the lender to lend to the borrower, for he is reliable, and he did so on his word, and it was false, he must pay him, for it is as though he had become guarantor to him (Maharyu, siman 80). And likewise, if the court made him a guarantor he is bound, even though no kinyan was made from him — for example, where the court wished to collect from the borrower and he said to them: leave him, and I am guarantor to you; since he has a benefit in that the court trusted him, by that benefit he bound himself.
Se’if 3ג׳
אם על פיו החזיר שטר או משכון הוה ליה ערב בשעת מתן מעות: הגה וכן אם פטר הלוה על פי הערב ה"ל כערב בשעת מתן מעות (מרדכי פרק איזהו נשך ותוספתא פרק המקבל) וי"א דאם היו לערב מעות של לוה בידו בשעה שערב נשתעבד בכל ענין (מהרי"ו סימן ל'):
If at his word he returned a document or a pledge, he is as a guarantor at the time of the giving of the money. Hagah [Rema]: And likewise, if he released the borrower at the guarantor's word, it is as a guarantor at the time of the giving of the money (Mordechai, chapter "Which is interest", and Tosefta, chapter "One who receives"). And some say that if the guarantor had money of the borrower's in his hand at the time he became guarantor, he is bound in every case (Maharyu, siman 30).
