דין הפורע חובו של חבירו או שמשכנו בשביל חבירו. ובו ב סעיפים: הפורע חובו של חבירו שלא מדעתו אפי' היה בשטר ואפי' היה עליו משכון ונטלו זה שפרע אין הלוה חייב לשלם לו ונוטל משכונו בחנם והרי אבד זה הנותן מעותיו ואפי' אם היה המלוה דוחקו לפרוע (שמא) היה הלוה מפייס את המלוה ומוחל לו: הגה וכן נ"ל עיקר ודלא כיש חולקין ואומרים דחייב לשלם (טור בשם ר"ת והרא"ש) ויש אומרים דוקא כשפורע לישראל אבל אם פרע לעכו"ם חייב לכו"ע וכ"ש אם פדה משכונו מן העכו"ם דחייב לשלם לו (תשובת מהרי"ל סי' פ"ב) וכן ראוי להורות וע' ביו"ד סוף סימן רנ"ב הפודה חבירו מן השביה אם חייב לשלם יש מי שאומר שכל זה שלא היה לו משל חבירו בידו אבל אם היה בידו משל חבירו ופרע חובו מה שעשה עשה (מהרי"ו סי' קס"ו) וי"א דאפי' נתן משכון שלו בשביל חבירו הואיל ואם רצה היה יכול לתת של חבירו אע"פ שלא נתנו חייב לשלם לו (הגהות מרדכי פ"ג דבתרא):
The law of one who pays his fellow's debt, or who pledged something on his fellow's behalf; it contains two se'ifim. One who pays his fellow's debt without his knowledge — even if it was by document, and even if there was a pledge for it and this one who paid took it — the borrower need not pay him, and he takes his pledge for nothing, and this giver has lost his money; and even if the lender was pressing him to pay, (perhaps) the borrower would have appeased the lender and he would have waived it for him. Hagah [Rema]: And so it seems to me the principal view, and not as those who disagree and say that he must pay (Tur in the name of Rabbeinu Tam and the Rosh). And some say: specifically where he pays an Israelite; but if he paid a gentile, he must pay according to everyone; and all the more so if he redeemed his pledge from the gentile, that he must pay him (responsum of the Maharil, siman 82); and so it is fitting to rule. And see in Yoreh De'ah, end of siman 252, whether one who redeems his fellow from captivity must pay. There is one who says that all this is where he had nothing of his fellow's in his hand; but if he had something of his fellow's in his hand and paid his debt, what he did is done (Maharyu, siman 166). And some say that even if he gave a pledge of his own on his fellow's behalf, then since, had he wished, he could have given his fellow's, even though he did not give it, the fellow must pay him (Hagahot Mordechai, chapter 3 of Bava Batra).

מי שנתפס על חבירו ולקח עכו"ם ממונו בגלל חבירו אין חבירו חייב לשלם: הגה מלמד שהיה אצל בעל הבית והלוה לעכו"ם על משכונות ויצא משם ולא פשר עצמו עם העכו"ם ויצא משם והניח קצת מעותיו ביד בעל הבית ורוצה לעכבם כי הוצרך להתפשר עם העכו"ם אין יכול לעכבם (הגהות מרדכי סוף בבא בתרא) (ועיין לעיל סוף סי' קכ"ו) אין לך מי שנתפס על חבירו ויהיה חבירו חייב לשלם לו חוץ מן הנתפס מפני המס הקצוב על כל איש ואיש בכל שנה או הנתפס על התשורה שנותן כל איש ואיש למלך בעברו עליהם הוא או חיילותיו ה"ז חייב לשלם לו והוא שיקחו ממנו בפירוש בגלל פלו' בפני עדים: הגה ואחד שנתפס מכח מס של קהל אחר ותפס משל א' מן הקהל יכול לתפסו בשביל כל הקהל כי כולם אחראין וערבאין זה בשביל זה ולכן א"צ לגבות מכל אחד חלקו (טור) וי"א דאין אדם נתפס בעד מס חבירו אלא קודם שנתפייס המלך אבל אם כבר נתפייס המלך אין אדם נתפס על חבירו (הגהות דב"ב ומהרי"ו סי' ק"ו) מיהו פרנסי הקהל שהלוו לצורך המס יכולין לפרוע בעד כל הקהל וכל אחד צריך ליתן חלקו (נ"י בשם הרשב"א) והא דאין אדם נתפס על חבירו היינו שאין תקנה בעיר אבל אם יש תקנה בעיר הולכין אחר המנהג. ומ"מ אם קצתם עשו שלא כהוגן והעליל השר עליהם אין אחרים צריכים ליתן לזה דודאי אדעתא דהכי לא נשתתפו אם לא שפירשו בהדיא (ב"י סי' קס"ג בשם הרשב"א) וע"ל סוף סי' קכ"ו מי שנאנס בעד חבירו מכח מלוה או פקדון וע"ל סי' קס"ג:
One who was seized on his fellow's account, and a gentile took his money on account of his fellow — his fellow need not pay. Hagah [Rema]: A teacher who was with a householder, and lent to gentiles on pledges, and left there without settling with the gentile, and left some of his money in the householder's hand, and the householder wishes to hold it back because he had to settle with the gentile — he cannot hold it back (Hagahot Mordechai, end of Bava Batra) (and see above, end of siman 126). There is no one who was seized on his fellow's account whose fellow must pay him, except one who was seized on account of the tax fixed on every single man each year, or one seized over the tribute that every single man gives the king when he or his troops pass through them — this one the fellow must pay, provided that they took it from him explicitly on account of so-and-so, before witnesses. Hagah [Rema]: And one who was seized on account of the tax of another community, and seized property of one of that community, can seize it on behalf of the whole community, for all of them are answerable and guarantors for one another; and therefore he need not collect from each one his share (Tur). And some say that a man is not seized for his fellow's tax except before the king has been appeased; but if the king has already been appeased, a man is not seized on his fellow's account (Hagahot on Bava Batra, and Maharyu, siman 106). However, the leaders of the community who borrowed for the needs of the tax can pay on behalf of the whole community, and each one must give his share (Nimukei Yosef in the name of the Rashba). And that which was said, that a man is not seized on his fellow's account — that is where there is no enactment in the city; but if there is an enactment in the city, they follow the custom. And in any case, if some of them acted improperly and the ruler brought a false charge against them, the others need not give to this one, for certainly they did not become partners with this in mind, unless they stated it explicitly (Beit Yosef, siman 163, in the name of the Rashba).
