Se’if 1א׳

הפורע חובו במעמד שלשתן. ובו כג סעיפים: ראובן שהיה לו מנה ביד שמעון בין מלוה בין פקדון ואמר ליה במעמד שלשתן מנה שיש לי בידך תנהו ללוי בין שנתנו לו במתנה בין שנתנו לו בפרעון חובו קנה ואין ראובן ולא שמעון יכולים לחזור בהם אף ע"פ שעדיין עסוקין באותו ענין וכן אין הנותן יכול לחזור ולמוחלו למי שהוא בידו ואפי' נולד לוי לאחר שהלוה ראובן לשמעון קנה:

One who pays his debt in the presence of the three of them (the creditor, the debtor and the one who receives, together); it contains twenty-three se'ifim. If Reuven had a maneh in Shimon's hand, whether a loan or a deposit, and said to him in the presence of the three of them: the maneh that I have in your hand, give it to Levi — whether he gave it to him as a gift or gave it to him in payment of his debt, Levi has acquired it, and neither Reuven nor Shimon can retract, even though they are still engaged in that same matter. And likewise the giver cannot retract and waive it for the one in whose hand it is. And even if Levi was born after Reuven lent to Shimon, he has acquired.

Se’if 2ב׳

בד"א כשהיה לראובן מנה ביד שמעון אבל אם לא היה לו מנה בידו אלא שא"ל תן מנה ללוי בשבילו ואפרענו לך לא קנה וכל א' משלשתן יכולין לחזור בו (ואפי' מחל המלוה ללוה יכול לחזור בו כל זמן שלא קנה בקנין) (ר"י נ"ט) ואפי' פרע שמעון ללוי מקצת החוב ומ"מ אם נתנו לו חוזר וגובה מראובן מאחר שעל פיו נתן: הגה וכן אם המקבל פטר הנותן לגמרי צריך זה שהמעות בידו ליתנם למקבל דהא לא גרע מערב דעלמא (נ"י ומרדכי פ' איזהו נשך):

In what case are these words said? When Reuven had a maneh in Shimon's hand; but if he had no maneh in his hand, but said to him: give a maneh to Levi on my behalf and I will repay it to you — Levi has not acquired, and each one of the three can retract (and even if the lender waived it for the borrower, he can retract so long as it was not acquired by a kinyan, a formal act of acquisition) (Rabbeinu Yerucham, netiv 9) — even if Shimon paid Levi part of the debt. Nevertheless, if he gave it to him, he goes back and collects from Reuven, since he gave it at his word. Hagah [Rema]: And likewise, if the recipient released the giver entirely, the one in whose hand the money is must give it to the recipient, for this is no worse than an ordinary guarantor (Nimukei Yosef and Mordechai, chapter "Which is interest").

אמר ראובן לשמעון סתם במעמד שלשתן תן מנה ללוי ולא א"ל מנה שיש לי בידך תנהו ללוי ושמעון מודה שיש לראובן מנה בידו אלא שאומר שכיון שלא פירש מנה שיש לי בידך לא היה דעתו על מנה שיש לו בידי אלא שאלוה לו מנה ואתננו לך אין בדבריו כלום דמסתמא על מנה שיש לו אמר וקנה וי"א שלא קנה:

If Reuven said to Shimon, without specifying, in the presence of the three of them: give a maneh to Levi — and did not say to him: the maneh that I have in your hand, give it to Levi — and Shimon admits that Reuven has a maneh in his hand, but says that since he did not specify "the maneh that I have in your hand", his intention was not on the maneh he has in my hand, but rather that I should lend him a maneh and give it to you — there is nothing in his words, for presumably he spoke of the maneh that he has, and Levi has acquired. And some say that he has not acquired.
