Se’if 1א׳
השולח חובו או פקדונו ע"י שליח. ובו י סעיפים: ראובן שהיה חייב מנה לשמעון או שהיה לו פקדון בידו ואמר ללוי הולך מנה זה לשמעון אם בא לחזור וליטלו ממנו אינו יכול דהולך כזכי דמי ומיד כשהגיע ליד לוי זכה בשבילו לשמעון לפיכך בין מת לוה או מלוה יתנוהו ליורשי שמעון ומ"מ ראובן חייב באחריותו עד שיגיע ליד שמעון: הגה וה"ה אם אמר שא מנה זו לפלוני או יהא מנה זו לפלוני כולם הוי כהולך והוי כזכי (ר"ן ספ"ק דגיטין) אבל אמר החזר לפלוני לא הוי כהולך ולא הוי כזכי (ב"י בשם הריטב"א) ואם החזיר לוי המנה לראובן והעני (ראובן) אח"כ ולא היה לו ממה לפרוע בענין שהפסיד שמעון שלו לוי חייב לשלם שהוא פשע במה שהחזירו לראובן ואם מחמת אונסו החזירו לראובן שאיים עליו בדבר שיש בידו לעשות עד שהוצרך להחזיר פטור ויש אומרים שכשהחזיר לו המנה לראובן שניהם חייבים באחריותו עד שיגיע ליד שמעון כל חובו: הגה ראובן שהיה לו מעות ביד שמעון ואמר ללוי לקבלן משמעון והלך לוי וקבלן ואח"כ אמר שמעון ללוי שיחזיר לו מעותיו שקבל בשביל ראובן [כי בטעות פרעו] ואם לא יחזירם יכפור לו חוב שחייב שמעון ללוי ממקום אחר והנה לוי אומר לראובן לא קבלתי בשבילך כדי שאפסיד את שלי ורוצה להחזירם וראובן אומר שלא יחזירם מאחר שכבר עשה שליחותו וזכה בשבילו הדין עם ראובן (מרדכי והגהות אשירי ספ"ק דגיטין):
One who sends his debt or his deposit by an agent; it contains ten se'ifim. If Reuven owed Shimon a maneh, or had a deposit of his in his hand, and said to Levi: take this maneh to Shimon — if he comes to retract and take it back from him, he cannot, for "take" is as "acquire", and as soon as it reached Levi's hand he acquired it on Shimon's behalf. Therefore, whether the borrower or the lender dies, they give it to Shimon's heirs. Nevertheless Reuven bears liability for it until it reaches Shimon's hand. Hagah [Rema]: And the same applies if he said: carry this maneh to so-and-so, or: let this maneh be so-and-so's — all of them are as "take" and are as "acquire" (the Ran, end of the first chapter of Gittin); but if he said: return it to so-and-so, it is neither as "take" nor as "acquire" (Beit Yosef in the name of the Ritva). And if Levi returned the maneh to Reuven, and Reuven afterwards became poor and had nothing from which to pay, in such a way that Shimon lost what was his, Levi must pay, for he was negligent in returning it to Reuven; and if he returned it to Reuven because of duress — that Reuven threatened him with something within his power to do, until he had to return it — he is exempt. And some say that when he returned the maneh to Reuven, both of them bear liability for it until the whole of his debt reaches Shimon's hand. Hagah [Rema]: Reuven had money in Shimon's hand and told Levi to receive it from Shimon; and Levi went and received it, and afterwards Shimon told Levi to return to him the money he had received on Reuven's behalf, for he had paid it by mistake, and if he would not return it he would deny him a debt that Shimon owed Levi from another source. And now Levi says to Reuven: I did not receive it on your behalf so that I should lose what is mine — and he wishes to return it; and Reuven says that he is not to return it, since he has already carried out his agency and acquired it on his behalf — the law is with Reuven (Mordechai and Hagahot Asheri, end of the first chapter of Gittin).

הא דבפקדון אינו יכול לחזור וליטול מיד לוי דוקא כשהוחזק הנפקד כפרן דאז זכות למפקיד שתצא מתחת ידו אבל לא הוחזק כפרן יכול הוא לחזור וליטלן ואי שווייה מריה דפקדון שליח להביא לו כיון דגלי דעתיה דניחא ליה דליתביה ליה אם בא לחזור אינו חוזר ואפילו בממציא לו שליח דלא מיפטר בהכי שומר מאחריות או אפי' לא ממצי ליה שליח אלא דשליח מהימן גבי מפקיד ובכל יומא הוה מפקיד גביה אם בא לחזור אינו חוזר:
That which was said, that with a deposit he cannot retract and take it from Levi's hand — this is specifically when the bailee is established as a denier, for then it is a benefit for the depositor that it should leave his hand; but if he is not established as a denier, he can retract and take it. And if the owner of the deposit made him an agent to bring it to him, then since he has revealed his mind that he is pleased that he should give it to him, if he comes to retract, he does not retract; and even where he provides him an agent — for the bailee is not thereby freed from liability — or even where he did not provide him an agent, but the agent is trusted by the depositor and the depositor deposits with him every day: if he comes to retract, he does not retract.
Se’if 3ג׳
אם אמר שליח למלוה הנה מעותיך ששלח לך פלוני בחובך בידי אך אני רוצה להחזיק בהם בשביל חוב שיש לי בידך אם המלוה מודה לשליח שיש לו בידו ואין לו שאר נכסים שיגבה מהם זה חובו והגיע זמן הלואתו אין כח ביד המלוה לערער על המשלח ולומר הפסדתני מעותי שמסרתם ליד מי שאינו יכול להוציאם מידו שהרי המשלח יאמר אף אם היו עדיין בידי היו מוציאין מידי מדרבי נתן הואיל ואין לך נכסים אחרים אבל אם יש לו נכסים אחרים המשלח כופה לשליח ליתנם למלוה שכל זמן שלא נתנם לו לא נפטר המשלח מהחוב והשליח חוזר וגובה אותו ממנו (מהמלוה) וכ"ש אם אין המלוה מודה לשליח שחייב ליתנם לו אפי' אם אין לו נכסים אחרים:
If the agent said to the lender: here, the money that so-and-so sent you for your debt is in my hand, but I wish to hold on to it for a debt that you owe me — if the lender admits to the agent that he owes it to him, and he has no other property from which this one could collect his debt, and the time of his loan has arrived, the lender has no power to contest against the sender and say: you have lost me my money, for you handed it into the hand of one from whom I cannot get it out; for the sender will say: even if it were still in my hand, they would take it out of my hand by the rule of Rabbi Natan, since you have no other property. But if he has other property, the sender compels the agent to give it to the lender, for so long as he has not given it to him the sender is not quit of the debt; and the agent goes back and collects it from him (from the lender). And all the more so if the lender does not admit to the agent — he must give it to him, even if he has no other property.
