Se’if 1א׳
אם מת המלוה או שביטל השליחות או ההרשאה. ובו ט סעיפים: אע"פ שלוה ששלח למלוה חובו בצוויו ע"י שלוחו ונאבד פטור כמו שנתבאר בסימן שקודם זה אם ירצה הלוה לא ישלחנו לו ע"י שלוחו אפי' אם יש עדים שעשאו שליח להביאו לו עד שיבא בהרשאה: הגה מיהו נוהגין האידנא שאם מעמיד לו ערב בעד הרשאה צריך לדון עמו אע"פ שאינו שלוחו כלל אם נראה לב"ד שהוא זכות למלוה דזכין לאדם שלא בפניו (פסקי מהרא"י סי' רי"ז) והטעם מפני שיש לחוש שמא ימות המלוה קודם שיתן לשליח ואם נאנסו בדרך יהיה חייב לשלם ליורשים כיון שלא נתנם לו עד שמת המלוה לפיכך עצה טובה ללוה או לנפקד שלא יתננו לשליח אלא א"כ בא בהרשאה שהקנה לו בקנין (עב"י) אגב קרקע מה שיש לו אצל פלוני: הגה [מיהו] אם ידוע שמת לא יתננו לשליח (תשובת הרא"ש כלל רס"ב):
If the lender died, or he cancelled the agency or the power of attorney; it contains nine se'ifim. Even though a borrower who sent the lender his debt at his instruction by his agent, and it was lost, is exempt, as was explained in the siman before this — if the borrower wishes, he need not send it to him by his agent, even if there are witnesses that he made him an agent to bring it to him, until he comes with a power of attorney. Hagah [Rema]: However, it is the custom nowadays that if he provides him a guarantor in place of a power of attorney, he must litigate with him, even though he is not his agent at all, if it seems to the court that it is a benefit for the lender, for one may confer a benefit on a man not in his presence (Piskei Maharai, siman 217). And the reason is that there is reason to fear lest the lender die before he gives it to the agent; and if it is lost by mishap on the way, he will be liable to pay the heirs, since he did not give it to him before the lender died. Therefore, it is good counsel for the borrower or the bailee not to give it to the agent unless he comes with a power of attorney, in which the lender conveyed to him by a kinyan (a formal act of acquisition) (see Beit Yosef) by agav (acquired along with land) of land what he has with so-and-so. Hagah [Rema]: However, if it is known that he died, he shall not give it to the agent (responsum of the Rosh, klal 262).

העושה שליח בעדים להביא לו מה שיש לו אצל פלו' וביטל השליחות קודם שיתן זה לשליח ולא ידע הנתבע בביטול ונתן לשליח ונאבדו פטור הנתבע: הגה וי"א דחייב אלא א"כ כתב ליה זיל דון ואפיק לנפשך (טור בשם הרא"ש):
One who makes an agent before witnesses to bring him what he has with so-and-so, and cancelled the agency before this one gave it to the agent, and the defendant did not know of the cancellation and gave it to the agent, and it was lost — the defendant is exempt. Hagah [Rema]: And some say that he is liable, unless he wrote to him, "Go, litigate, and take out for yourself" (Tur in the name of the Rosh).
Se’if 3ג׳
מי שהרשה לאחד ורצה לבטל השליחות ולהרשות לאחר רשאי: הגה ואם ירצה יוכל לומר שגם הראשון יהא שליחותו קיים וכל אחד משניהם יהיה מורשה בדבר (תשובת הרא"ש כלל ס"ב סי' ד') ואין הנתבע יכול לדחות למורשה לומר שמא המרשה ביטל שליחותך והרשה אחר שהרי זה אומר לו תן לי מה שיש בידך וזאת הרשאתי תהיה אצלך ואם ביטל שליחותו הוא הפסיד על עצמו והנתבע פטור שהרי בהרשאתו נתן וכן אם עמד המורשה בדין עם הנתבע ונתחייב המורשה אין המרשה יכול לסתור הדין בטענה שכשעמד עם זה בדין כבר ביטל שליחותו: הגה (טור בשם הרא"ש) מיהו אם ידע המורשה בביטול שליחותו אע"פ שהנתבע לא ידע דינו בטל וצריך לחזור ולדון (בית יוסף):
One who gave power of attorney to one man and wishes to cancel the agency and give power of attorney to another — he is permitted. Hagah [Rema]: And if he wishes, he can say that the first one's agency too shall stand, and each of the two shall be an attorney in the matter (responsum of the Rosh, klal 62, siman 4). And the defendant cannot put off the attorney, saying, "Perhaps the one who gave you power of attorney has cancelled your agency and given power of attorney to another"; for this one says to him, "Give me what is in your hand, and let this power of attorney of mine stay with you"; and if he cancelled his agency, he has brought the loss on himself, and the defendant is exempt, for he gave by his power of attorney. And likewise, if the attorney stood in judgment with the defendant and the attorney was found liable, the one who gave the power of attorney cannot overturn the judgment by pleading that when he stood in judgment with this one he had already cancelled his agency. Hagah [Rema]: (Tur in the name of the Rosh.) However, if the attorney knew of the cancellation of his agency, even though the defendant did not know, his judgment is void, and they must litigate again (Beit Yosef).
