Se’if 1א׳

השולח חובו על ידי שליח. ובו יב סעיפים: שלח לו חובו או פקדונו ע"י שליח אם אמר לו המלוה לשלחו על ידו ונאבדו פטור אפילו לא אמר לו פה אל פה אלא ששלח לו בכתב שלח לי ע"י פלוני ושלחם על ידו ונאבדו פטור והוא שיכיר שהוא כתב ידו אפילו שהשליח עכו"ם או חרש שוטה וקטן אפילו לא יחד לו אדם ידוע לומר שלח ע"י פלוני אלא כתב לו שלח לי ביד מי שתרצה ושלחם לו ונאבדו או כפר בהם השליח פטור והוא ששלח לו ביד אדם נאמן ובדרך שבני אדם [רגילים] להעביר שם ממונם אבל אם שלח לו ע"י מי שהוחזק כפרן או במקום סכנת דרכים שאין הרבים רגילים להעביר שם ממונם הרי פשע וחייב שעל דעת כן לא הרשהו אלא אם כן פירש לו:

One who sends his debt by an agent; it contains twelve se'ifim. He sent him his debt or his deposit by an agent: if the lender told him to send it by his hand, and it was lost, he is exempt. Even if he did not tell him face to face, but sent him in writing, "Send it to me by so-and-so", and he sent it by his hand and it was lost, he is exempt — and this is where he recognises that it is his handwriting — even if the agent is a gentile, or a deaf-mute, one who is not of sound mind, or a minor. Even if he did not specify a known person to him, saying, "Send it by so-and-so", but wrote to him, "Send it to me by whomever you wish", and he sent it to him, and it was lost, or the agent denied it, he is exempt — and this is where he sent it to him by a trustworthy man, and by a road by which people are accustomed to transport their money. But if he sent it to him by one established as a denier, or through a place of danger on the roads, where the many are not accustomed to transport their money, he has been negligent, and he is liable; for he did not authorise him on that understanding, unless he specified it to him.

Se’if 2ב׳

אפילו לא אמר לשליח אמור לפלוני שישלח על ידך מעות שבידו אלא אם אמר לו בפני עדים מעות יש לי ביד פלוני לך ואמור לו שדעתך לבא לכאן ואם יתנם לך הביאם לי ונתנם לו הלוה ונאבדו בדרך פטור אבל לא עשאו שליח אלא אמר לו יש לי מעות ביד פלוני ואינו שולחם לי אולי אינו מוציא שליח לשלחם לך והתראה אליו אולי ישלחם על ידיך לי לא הוי שליח ואם נתנם לו ונאבדו חייב באחריותם.

Even if he did not say to the agent, "Tell so-and-so to send by your hand the money that is in his hand", but said to him before witnesses, "I have money in so-and-so's hand; go and tell him that you intend to come here, and if he gives it to you, bring it to me", and the borrower gave it to him, and it was lost on the way — he is exempt. But if he did not make him an agent, but said to him, "I have money in so-and-so's hand, and he does not send it to me; perhaps he does not find an agent to send it; show yourself to him, perhaps he will send it to me by your hand" — he is not an agent, and if he gave it to him and it was lost, he bears the responsibility for it.

Se’if 3ג׳

לא עשאו שליח בעדים אלא מסר לו חותמו לסימן שהוא שלוחו ומסרו לו לאמר לך והבא לי מעותי והוא בא אצל הלוה לומר פלוני שלחני אליך שתשלח לו מעותיו והילך חותמו לסימן ועדים מעידים שהוא חותמו אבל אינם מעידים שעשאו שליח ושלחם לו ונאבדו לא נפטר הלוה: הגה ויחרים תחלה (על) מי ששלח שליח זה ולא יודה (טור ס"ו בשם הרמב"ם) וי"א שצריך לישבע תחלה כדין שאר נשבעין ונוטלין (טור בשם י"א):

He did not make him an agent before witnesses, but handed him his seal as a sign that he is his agent, handing it to him and saying, "Go and bring me my money"; and he comes to the borrower, saying, "So-and-so has sent me to you, that you should send him his money, and here is his seal as a sign"; and witnesses testify that it is his seal, but do not testify that he made him an agent; and he sent it to him and it was lost — the borrower is not quit. Hagah [Rema]: And he first pronounces a cherem (the severer form of the ban) on (whoever) sent this agent and does not admit it (Tur, se'if 6, in the name of the Rambam); and some say that he must first swear, as the law of others who swear and take (Tur, in the name of "some say").
