הרשאה על מה נכתבת וכיצד נכתבת. ובו טו סעיפים: מדינא דגמרא אין כותבין הרשאה אלא לתבוע פקדונו שביד חבירו ולא כפר לו ואם היה פקדון של מעות צריך להקנות לו אגב קרקע וכן יכול להרשות לתבוע קרקע אפי' כפר בה וכן מלוה בשטר אפי' כפר בה שכשם שיכול להקנות השטר ושעבודו בכתיבה ומסירה כך יכול להרשות עליו ולמסור השטר בידו כדי שיגבהו וצריך לכתוב לו קנה לך איהו וכל שעבודיה דאית ביה אבל אין כותבין הרשאה על פקדון שביד חבירו שכפר בו וכן אין כותבין הרשאה על מלוה שבעל פה אבל הגאונים תקנו שכותבין הרשאה אף על המלוה בין בשטר בין בעידי קנין אע"פ שכפר בה בב"ד כדי שלא יטול כל אחד ממון חבירו וילך לו למדינה אחרת אבל על מלוה על פה שכפר לא תקנו שיכתבו הרשאה ומ"מ לא גרע משליח שעשאו בעדים שנתבאר בסי' קכ"ב (ב"י וטור ס"ד בשם הרמב"ם ורא"ש פ' מרובה ע"ל סי' קכ"ב ס"ס ד') וי"א שעל הכל כותבין לא שנא פקדון וגזל לא שנא מלוה בשטר ובעל פה ואע"ג דכפריה (וכן נוהגין מרדכי וב"י):
For what a power of attorney is written, and how it is written; it contains fifteen se'ifim. By the law of the Gemara they write a power of attorney only to claim one's deposit that is in the hand of his fellow, where he has not denied it to him; and if it was a deposit of money, he must transfer it to him by agav (acquired along with land) of land. And likewise one can give a power of attorney to claim land, even if the other denied it; and likewise a loan by document, even if he denied it — for just as he can transfer the document and its lien by writing and delivery, so he can give a power of attorney over it and deliver the document into the attorney's hand so that he may collect it; and he must write for him: acquire it for yourself, it and all the liens that are in it. But they do not write a power of attorney for a deposit in the hand of his fellow which he has denied, and likewise they do not write a power of attorney for a loan by word of mouth. But the Geonim enacted that they write a power of attorney even for a loan, whether by document or by witnesses to a kinyan (a formal act of acquisition), even though he denied it in court, so that not everyone should take his fellow's money and go off to another country. But for a loan by word of mouth that he denied, they did not enact that a power of attorney be written; nevertheless it is no worse than an agent whom he appointed before witnesses, as was explained in siman 122 (Beit Yosef and Tur, se'if 4, in the name of the Rambam and the Rosh, chapter "Greater"; see above, siman 122, end of se'if 4). And some say that they write it for everything — no difference whether a deposit or robbery, no difference whether a loan by document or by word of mouth — and even though he denied it (and so is the practice; Mordechai and Beit Yosef).
Se’if 2ב׳
מי שהיה לו שבועה על חבירו אינו יכול להרשות אחר עליו ולהשביעו שאינו דבר שנקנה בקנין שאינו אלא דברים בעלמא: הגה וה"ה מי שהיה לו תביעה על חבירו וכתב לו הרשאה על התביעה שיש לו אצל חבירו אין הרשאה כלום (מרדכי פ' מי שמת) דהתביעה אינה דבר שיוכל להקנות אלא צריך לכתוב ההרשאה על הממון שעליו התביעה (ד"ע בפי' המרדכי):
One who had an oath owed him by his fellow cannot give another a power of attorney over him to make him swear, for it is not a thing that is acquired by a kinyan, since it is nothing but mere words. Hagah [Rema]: And the same applies to one who had a claim against his fellow and wrote another a power of attorney over the claim he has against his fellow: the power of attorney is nothing (Mordechai, chapter "One who died"), for the claim is not a thing that he can transfer; rather he must write the power of attorney over the money on which the claim rests (his own opinion, in explanation of the Mordechai).
Se’if 3ג׳
המרשה לאחד ואח"כ הרשה לאחר ושניהם באים בהרשאתו לפנינו אין לנתבע להשיב אלא לשני:
One who gave a power of attorney to one man and afterwards gave a power of attorney to another, and both of them come before us with his power of attorney — the defendant need answer only the second.
