One who throws his debt, without specifying or in the manner of bills of divorce, and he threw it and it was lost; it contains two se'ifim. The money is at the borrower's risk until he repays it into the lender's hand or into the hand of his agent. And if he threw it in his presence and it was lost, he is liable. Even if he said, "Throw me my debt", and he threw it and it was lost, he is liable. But if he said to him, "Throw me my debt and be quit", and he threw it — even far from the lender — and it was lost before it reached his hand, he is exempt, for he authorised him to do so. If he said to him, "Throw me my debt in the manner of bills of divorce": if the money was nearer the borrower, it is still at his risk; if it was nearer the lender, the borrower is quit; half and half — if it was lost from there or stolen, the borrower pays half. Hagah [Rema]: How so? He threw it into the lender's four cubits — he is exempt. Outside his four cubits: if the lender can guard it and not the borrower, he is exempt; and if the borrower can guard it and not the lender, the borrower is liable; if both of them can guard it, it is half and half, and both are liable (Tur). But if neither of them can guard it, it is as though he threw it into a place of loss, and the borrower is liable (Beit Yosef).

במה דברים אמורים בסתם שלא גלה המלוה דעתו שאינו רוצה לקבלם לפיכך אם זרקו לו ונאבד חייב שאומר לו אילו נתתם לי הייתי שומרם אבל אם אמר לו הלוה הילך מעותיך ולא רצה המלוה לקבלם וזרקם לפניו אם הוא במקום שמלוה משתלמת שם נפטר ואינו צריך להביאם לב"ד דפרעון בעל כרחו פרעון וכן אם אמר לו הנה מעותיך צרורים בביתי בא וטול מעותיך (וע' לקמן סי' ע"ד ס"ו) והמלוה מסרב מלקחתם ונגנבו או נאבדו פטור הלוה אלא א"כ פשע בהם ונגנבו או אבדו: הגה ויש חולקים בזה (מרדכי שם פ' מי שאחזו) אם פרע לאשת המלוה אם היא בת דעת נפטר הלוה בכך כאילו נתנו למלוה עצמו (תשו' הרשב"א אלף צ"ו) ראובן שהיה חייב לשמעון וכשהגיע זמן הפרעון א"ל שמעון שיתעסק בהן למחצית שכר ונאנסו אח"כ ביד הלוה חייב בכל האונסין כמו בתחילה מאחר שהיו תחיל' באחריותו ולא נשתנה מכח דיבור בעלמא (מרדכי פ' החובל):

In what case are these words said? Without specification, where the lender did not reveal his mind that he does not wish to receive it; therefore, if he threw it to him and it was lost, he is liable, for the lender says to him, "Had you given it to me, I would have guarded it". But if the borrower said to him, "Here is your money", and the lender did not wish to receive it, and he threw it before him — if it is in the place where the lender is to be repaid, he is quit, and he need not bring it to the court, for repayment against his will is repayment. And likewise, if he said to him, "Here, your money is bound up in my house; come and take your money" (and see below, siman 74, se'if 6), and the lender refuses to take it, and it was stolen or lost — the borrower is exempt, unless he was negligent with it and it was stolen or lost. Hagah [Rema]: And some disagree about this (Mordechai there, chapter "One who was seized"). If he repaid the lender's wife, if she is a woman of understanding, the borrower is quit by this, as though he had given it to the lender himself (responsum of the Rashba, siman 1096). Reuven, who owed Shimon, and when the time of repayment arrived Shimon told him to trade with it for half the profit, and afterwards it was lost by mishap in the borrower's hand — he is liable for all mishaps as at the beginning, since at the beginning it was at his risk, and it did not change by force of mere speech (Mordechai, chapter "One who wounds").
