Se’if 1א׳

הכותב ללוקח שני דין ודברים אין לי עמך. ובו ד סעיפים: לוה שמכר נכסיו לשנים זה אחר זה וכתב בעל חוב ללוקח שני דין ודברים אין לי עמך וקנו מידו אינו יכול לטרוף מלוקח ראשון שהרי אומר לו הנחתי לך מקום לגבות אצל בעל חובך מהנכסים שקנה לוקח שני אחרי ואתה הפסדת על עצמך שהרי סילקת עצמך מהם והוא הדין לאשה בכתובתה אם כתבה לשני אבדה כתובתה ואינה יכולה לטרוף אבל אם כתבו לראשון טורפים מהשני: הגה ואם הראשון מכר הקרקע שקנה לאחר אינו טורפה מהשני כמו שאין טורפה אם נשארה ביד הראשון (טור וכ"כ הראב"ד בהשגתו שם והמגיד) .

One who writes to the second purchaser, "I have no claim or dispute with you"; it contains four se'ifim. A borrower who sold his property to two, one after the other, and the creditor wrote to the second purchaser, "I have no claim or dispute with you", and they made a kinyan (a formal act of acquisition) from him — he cannot seize from the first purchaser, for the first says to him, "I left you a place to collect from with your debtor, from the property that the second purchaser bought after me, and you have brought the loss on yourself, for you removed yourself from it". And the same holds for a woman as to her ketubah (the sum settled upon her in her marriage contract): if she wrote so to the second, she has lost her ketubah and cannot seize; but if they wrote so to the first, they seize from the second. Hagah [Rema]: And if the first sold the land that he bought to another, he does not seize it from the second, just as he does not seize it if it remained in the hand of the first (Tur; and so wrote the Raavad in his critique there, and the Maggid).

מכר הלוה שדה ללוקח ומכר אחריה שדה שניה ללוקח שני וכתב המלוה ללוקח שני דין ודברים אין לי עמך וקנו מידו הרי ב"ח טורף מהלוקח ראשון שדה ראשונה ולוקח ראשון טורף מלוקח שני שדה שניה שהרי קנה אחריו וב"ח טורף אותה מלוקח ראשון ולוקח שני מוציאה אותה מב"ח שהרי כתב לו (דין ודברים אין לי עמך) ולוקח ראשון חוזר וטורף משני וחוזרים חלילה עד שיעשו פשרה ביניהם וכן האשה בכתובתה והוא שהיה החוב כנגד שתי השדות:

The borrower sold a field to a purchaser, and after it sold a second field to a second purchaser, and the lender wrote to the second purchaser, "I have no claim or dispute with you", and they made a kinyan from him: the creditor seizes the first field from the first purchaser, and the first purchaser seizes the second field from the second purchaser, since he bought after him; and the creditor seizes it from the first purchaser, and the second purchaser takes it out from the creditor, since he wrote to him ("I have no claim or dispute with you"); and the first purchaser goes back and seizes from the second; and they go round and round until they make a compromise between them. And likewise a woman as to her ketubah. And this is where the debt was equal to the two fields.

וכן הדין אם החוב מנה ומכר לשני לקוחות לכל אחד במנה וכתב ב"ח ללוקח שני דין ודברים אין לי עמך ונמצא השדה שקנה הראשון שאינה שלו הרי הראשון טורף מהשני ובעל חוב טורף מהראשון ושני טורף מב"ח וחוזרין חלילה עד שיעשו פשרה ביניהם:

And the law is likewise if the debt was a maneh, and he sold to two purchasers, to each for a maneh, and the creditor wrote to the second purchaser, "I have no claim or dispute with you", and the field that the first bought was found not to be his: the first seizes from the second, and the creditor seizes from the first, and the second seizes from the creditor; and they go round and round until they make a compromise between them.
