דין העושה שדהו או עבדו אפותיקי. ובו ז סעיפים: העושה שדהו אפותיקי לב"ח או לאשה בכתובת' והוא שיכתוב להם מכאן תגבו ושטפה נהר הרי זה גובה משאר נכסים וטורף אותם (אבל כל זמן שהיא בידו אינו יכול לסלקו בנכסים אחרים רק במעות) (המגיד פ' י"ח מה' מלוה ור"ן) ויש חולקין (טור סעיף א') ואם התנה עמו שלא יהא לו פרעון אלא מזו אינו גובה משאר נכסים ואם מכרה לאחר ובא ב"ח זה לטרפה אינו יכול לסלקו בדמים (טור סי' קמ"ו) מאחר שהתנה עמו שלא יהא לו פרעון אלא מזו: הגה עשה שדהו אפותיקי מפורש שאמר ליה לא יהא לך פרעון אלא מזו ונמצא השדה לא היתה שלו יש אומרים דגובה משאר נכסים (רבינו ירוחם נתיב ו' חלק ג' בשם התו') אבל אם טרף ממנו בע"ח מוקדם אינו חוזר עליו (שם) עשה שדהו אפותיקי לבעל חובו או לאשה בכתובת' ומכרה הרי זו מכורה וכשיבא בעל חוב לגבות אם לא ימצא נכסים בני חורין יטרוף אותה בד"א כשמכרה לשעתה אבל אם מכרה ממכר עולם אינה מכור': הגה זהו דעת רמב"ם אבל רוב המפרשים חולקין וסבירא להו דאפי' יש כאן בנ"ח טורף מאפותיקי מפורש ואם מכר המכר קיים עד שעת טירפא וכן עיקר (טור והמגיד פי"ח וב"י):

The law of one who makes his field or his slave an apotiki; it contains seven se'ifim. One who makes his field an apotiki (a designated security) for a creditor, or for a woman for her ketubah (the sum settled upon her in her marriage contract) — and this is where he writes for them, "From this you shall collect" — and a river swept it away: this one collects from other property and seizes it (but so long as it is in his hand, he cannot remove him with other property, only with money) (the Maggid, chapter 18 of the Laws of Lender and Borrower, and the Ran); and some disagree (Tur, se'if 1). And if he stipulated with him that he should have no repayment except from this, he does not collect from other property; and if he sold it to another, and this creditor came to seize it, he cannot remove him with money (Tur, siman 146), since he stipulated with him that he should have no repayment except from this. Hagah [Rema]: He made his field an explicit apotiki, saying to him, "You shall have no repayment except from this", and the field was found not to have been his — some say that he collects from other property (Rabbeinu Yerucham, netiv 6, part 3, in the name of the Tosafot); but if an earlier creditor seized it from him, he does not go back against him (ibid.). One who made his field an apotiki for his creditor, or for a woman for her ketubah, and sold it — it is sold; and when the creditor comes to collect, if he does not find unencumbered property, he seizes it. In what case are these words said? When he sold it for its time; but if he sold it in a perpetual sale, it is not sold. Hagah [Rema]: This is the view of the Rambam; but most of the commentators disagree and hold that even if there is unencumbered property here, he seizes from an explicit apotiki, and if he sold it, the sale stands until the time of seizure; and so is the main view (Tur, and the Maggid, chapter 18, and Beit Yosef).

Se’if 2ב׳

משכונא אם משכנה לו סתם דינה כאפותיקי סתם ואם פי' לו לא יהא לך פרעון אלא ממנה דינה כאפותיקי מפורש:

A mashkanta (a mortgage in which the lender eats the produce of the land): if he pledged it to him without specifying, its law is as an unspecified apotiki; and if he specified to him, "You shall have no repayment except from it", its law is as an explicit apotiki.

Se’if 3ג׳

עשה שורו אפותיקי ומכרו אין ב"ח גובה ממנו וכן שאר המטלטלין מפני שאין להם קול ואפי' עשאם אפותיקי בשטר ואפי' ידע הלוקח שעשאה אפותיקי דלא פלוג רבנן:

He made his ox an apotiki and sold it — the creditor does not collect from it; and likewise other movables, because they have no publicity; and even if he made them an apotiki by document, and even if the purchaser knew that he had made it an apotiki, for the Rabbis did not distinguish.
