כיצד כותבין לו הטירפא. ובו ב סעיפים: לוקח שטרפו ממנו השדה כותבים לו ב"ד טירפא היאך טרפוהו ממנו בשביל חוב של המוכר וחוזר וטורף מהמוכר: הגה ואין הבעל חוב צריך לכתוב לו הרשאה או שטר הודאה שטרף ממנו (ב"י סי' קי"א בשם הרשב"א) ואם קנאה בת"ק והוקרה אם היתה שוה אלף כותבים לו טירפא באלף וכן אם היתה שוה אלף בשעה שלקחה ובשעת טירפא לא היתה שוה אלא ת"ק או שהיתה שוה אלף ולקחה בת"ק בכולם כותבין לו טירפא באלף וכל הדין שיש למלוה עם הלוקח כן דינו של לוקח ראשון שטרף ב"ח ממנו ובא הוא לטרוף מהלקוחות שקנו אחריו אפי' לא מכר לו בשטר אלא בעדים בעלמא אפילו לא פירש לו האחריות: הגה י"א דדוקא מוכר אבל נתן מתנה בעדים אינו טורפה בלא שטר דמתנה אין לה קול אלא בשטר (המגיד פ' י"א דמלוה) והא דטורף בלא מכר לו בשטר אלא בעדים בעלמא דוקא כשהעדים מעידים שלא חתמו על שום שטר מזה המכר וגם לא היו שם עדים אחרים כי אם הם ומכל מקום ב"ד כותבים לו היאך נטרף ממנו לראיה שיתבע הלוה שמכר לו:

How they write him the tirpa; it contains two se'ifim. A purchaser from whom they seized the field — the court writes him a tirpa (a writ of seizure) of how they seized it from him on account of the seller's debt, and he goes back and seizes from the seller. Hagah [Rema]: And the creditor need not write him a power of attorney or a document of admission that he seized from him (Beit Yosef, siman 111, in the name of the Rashba). And if he bought it for five hundred and it rose in price — if it was worth a thousand, they write him a tirpa for a thousand. And likewise, if it was worth a thousand at the time he bought it, and at the time of the seizure it was worth only five hundred; or it was worth a thousand and he bought it for five hundred — in all of them they write him a tirpa for a thousand. And every law that the lender has with the purchaser, so is the law of a first purchaser from whom a creditor seized and who comes to seize from the purchasers who bought after him — even if he did not sell to him by document but merely before witnesses, even if he did not specify liability to him. Hagah [Rema]: Some say that this is specifically a seller; but one who gave a gift before witnesses does not seize it without a document, for a gift has no publicity except by document (the Maggid, chapter 11 of the Laws of Lender and Borrower). And that he seizes where he did not sell to him by document but merely before witnesses — this is specifically where the witnesses testify that they did not sign any document of this sale, and also there were no other witnesses there but they. And in any case the court writes for him how it was seized from him, as proof, so that he may claim from the borrower who sold to him.

אם לקח בפירוש שלא באחריות ומבקש מהמלוה שיתן לו כחו מהשטר חוב כדי שיוכל לתבוע הוא מהלו' אם כבר טרף ממנו שוב אינו יכול לעשות לו ממנו לא הרשאה ולא מכר שכבר נמחל שעבודו ונתבטל אבל קודם שיטרוף בו יכול לפייסו שיתן לו כחו אבל אין כותבין לו טירפא שהרי קנה בפירוש שלא באחריות:

If he bought explicitly without liability, and asks the lender to give him his power from the document of debt, so that he himself may claim from the borrower: if he has already seized from him, he can no longer make him, of it, either a power of attorney or a sale, for his lien has already been waived and become void; but before he seizes by it, he can persuade him to give him his power. But they do not write him a tirpa, for he bought explicitly without liability.
