דין הפירות והשבח בטורף מלוקח ויתומים. ובו ו סעיפים: כשבא ב"ח לטרוף מהלוקח אם כתב לו הלוה דאקנה טורף ג"כ השבח שהשביח השדה בין שבח ששבחו הנכסים מאליהם כגון שעלו בו אילנות או נתייקרה בין שבח שהשביחו מחמת הוצאה אלא שאם שבחו מאליהם טורף כל השבח: הגה וי"א דבכל ענין אינו גובה רק חצי השבח (טור בשם הרא"ש והמגיד פכ"א דמלוה וכן נראה לי עיקר) מיהו אם כתב ללוקח בהדיא שלא יגבה מדאקנה אין ללוקח בשבח כלום (הרא"ש פ"ק דמציעא) ואם השביחו מחמת הוצאה טורף חצי השבח היתר על ההוצאה: הגה וי"א דאין הבעל חוב נותן לו הוצאה כלל מאחר דהחוב שלו נגד הקרן עם השבח (טור בשם הרא"ש וע' בב"י) וחוזר הלוקח וגובה הקרן מנכסי המוכר אף מהמשועבדי' שמכר או נתן מאחר זמן שמכר לו השדה אבל השבח שטרף ממנו בע"ח אינו גובה אותו מנכסי המוכר אלא מבני חורין: וכל זה לא מיירי אלא בשבח ששבחו הנכסים בעודו המוכר חי אבל אם שבחו הנכסים לאחר מיתת המוכר אין לבעל חוב בו כלום ונשאר כולו ללוקח (נ"י פ"ק דמציעא) וכל הפירות שאכל הלוקח אינם נטרפים ממנו אבל כל הפירות המחוברים לקרקע אע"פ שאינם צריכים לקרקע כענבים שהגיעו להבצר הרי בע"ח גובה מהם כמו שגובה מן השבח ואם רוצה הלוקח לסלקו יכול לסלקו בין מן השדה בין מן השבח אם לא עשאה אפותיקי אבל אם עשאה אפותיקי מפורש שאמר לו לא יהא לך פרעון אלא מזו א"י לסלקו:

The law of the produce and the improvement, for one who seizes from a purchaser and from orphans; it contains six se'ifim. When a creditor comes to seize from the purchaser: if the borrower wrote de-akni (a clause binding property he would acquire later) for him, he seizes also the improvement by which the field improved — whether improvement by which the property improved of itself, such as trees coming up in it or its rising in price, or improvement that they made on account of expense; except that if it improved of itself, he seizes all the improvement. Hagah [Rema]: And some say that in every case he collects only half the improvement (Tur in the name of the Rosh, and the Maggid, chapter 21 of the Laws of Lender and Borrower; and so it seems to me to be the main view). However, if he wrote explicitly to the purchaser that he should not collect from de-akni, the purchaser has nothing in the improvement (the Rosh, the first chapter of Bava Metzia). And if they improved it on account of expense, he seizes half the improvement that exceeds the expense. Hagah [Rema]: And some say that the creditor gives him no expense at all, since his debt is against the principal together with the improvement (Tur in the name of the Rosh; and see Beit Yosef). And the purchaser goes back and collects the principal from the seller's property, even from encumbered property that he sold or gave after the time he sold him the field; but the improvement that the creditor seized from him he does not collect from the seller's property except from unencumbered property. And all this speaks only of improvement by which the property improved while the seller was alive; but if the property improved after the seller's death, the creditor has nothing in it, and it remains entirely the purchaser's (Nimukei Yosef, the first chapter of Bava Metzia). And all the produce that the purchaser ate is not seized from him; but all the produce attached to the ground, even though it no longer needs the ground — such as grapes that have come to be harvested — the creditor collects from them as he collects from the improvement. And if the purchaser wishes to remove him, he can remove him, whether from the field or from the improvement, if the borrower did not make it an apotiki (a designated security); but if he made it an explicit apotiki, saying to him, "You shall have no repayment except from this", he cannot remove him.

בעל חוב שטרף בחובו מיד הלוקח מה שראוי לו מן הקרן וחצי השבח רואין הנשאר מהקרקע אם יש בו תועלת ללוקח כגון שנשאר לו בשדה בית ט' קבין ובגינה בית חצי קב ישתתפו בה שניהם ואם לא נשאר לו דבר שאלו יחלק יהיה שם כולו עליו נותן לו בע"ח את דמיו: הגה אם ירצה הלוקח (טור ס"ז) וי"א שה"ה אם לא היו דמי החוב רק נגד הקרן ולא נגד השבח שאז נשאר כל השבח ללוקח נמי דינא הכי ודוקא שלא עשאו המוכר אפותיקי אבל אם עשאו אפותיקי (טור ס"א) גובה ב"ח אף (כל) השבח רק שנותן ללוקח הוצאותיו ואם ההוצאה מרובה על השבח אין הוצאה רק כדי השבח בלחוד (טור בשם הרא"ש והמגיד פכ"א דמלוה):

A creditor who seized for his debt from the purchaser's hand what is due to him of the principal and half the improvement: they look at what remains of the land — if there is benefit in it for the purchaser, for instance there remained to him in a field an area of nine kav, and in a garden an area of half a kav, the two of them become partners in it; and if there did not remain to him something which, were it divided, would still bear the name of the whole, the creditor gives him its value. Hagah [Rema]: If the purchaser wishes (Tur, se'if 7). And some say that the same applies if the money of the debt was only against the principal and not against the improvement, so that all the improvement remains the purchaser's — the law is so too. And this is specifically where the seller did not make it an apotiki; but if he made it an apotiki (Tur, se'if 1), the creditor collects even (all) the improvement, only that he gives the purchaser his expenses; and if the expense is more than the improvement, there is expense only up to the amount of the improvement alone (Tur in the name of the Rosh, and the Maggid, chapter 21 of the Laws of Lender and Borrower).

כל הדברים לא נאמרו אלא בלוקח אבל מקבל מתנה ששבחה מחמת הוצאה אין ב"ח גובה משבחה כלום אלא רואים כמה היתה שוה בשעת מתנה וגובה ואם שבחה מאליה ב"ח גובה את כולה: הגה וי"א דאפילו השבח דממילא נמי לא טריף (טור בשם הרז"ה והרא"ש) אלא א"כ עשאו אפותיקי שדינו כמו ביתומים שיתבאר בסמוך (המגיד פ' כ"א) ואם קיבל הנותן אחריות המתנה הרי ב"ח גובה ממנה כדרך שגובה מהלוקח: הגה ולוקח שפירש בהדיא שאין לו אחריות על המוכר דינו כמקבל מתנה (המגיד פכ"א):

All these things were said only of a purchaser; but a recipient of a gift that improved on account of expense — the creditor collects nothing of its improvement; rather, they see how much it was worth at the time of the gift, and he collects. And if it improved of itself, the creditor collects all of it. Hagah [Rema]: And some say that even the improvement that comes of itself he does not seize either (Tur in the name of the Razah and the Rosh), unless he made it an apotiki, for then its law is as with orphans, which will be explained just below (the Maggid, chapter 21). And if the giver accepted liability for the gift, the creditor collects from it in the way that he collects from the purchaser. Hagah [Rema]: And a purchaser who stated explicitly that he has no liability upon the seller — his law is as a recipient of a gift (Maggid, chapter 21).
