Se’if 1א׳
דין בע"ח עם הלוקח אם יכול לדחותו אצל הלוה. ובו ז סעיפים: מלוה שיודע לקוחות שקנו מהלוה אחר שהלוה הולך וטורף מהם (בב"ד אבל אם טרף שלא בב"ד אינו כלום) (ב"י בשם תשובה שבסוף חזה התנופה) וקורעים ב"ד שטר האדרכתא וכותבין לו שטר טרפא וכותבים בטרפא שקרעו שטר האדרכתא:
The law of the creditor with the purchaser, whether he can put him off onto the borrower; it contains seven se'ifim. A lender who knows of purchasers who bought from the borrower after he lent goes and seizes from them (through the court; but if he seized not through the court, it is nothing) (Beit Yosef in the name of a responsum at the end of Chazeh haTenufah); and the court tears up the document of adrachta (a court writ empowering the lender to seize the borrower's property) and writes him a document of tirpa (a writ of seizure), and they write in the tirpa that they tore up the document of adrachta.

כשימצא המלוה ללוקח כופין אותו לדון עמו ואינו יכול לומר לו לך אצל הלוה וכשיתחייב לך בדין יכתבו לך טירפא על הלקוחות אז אפרע לך אלא ילך הוא אצל הלוה ויזקיקו לבא לדין ומיהו היכא דאיתא מודעינן ליה כגון שאינו רחוק יותר ממהלך יום אחד ואם מבקש הלוקח זמן לחזור אחריו נותנים לו עד שלשים יום ובלבד להוציא הדין לאמיתו ושלא לבא בעקיפין:
When the lender finds the purchaser, they compel him to litigate with him, and he cannot say to him, "Go to the borrower, and when he is obliged to you in judgment they will write you a tirpa on the purchasers; then I will pay you"; rather, he himself goes to the borrower and makes him come to judgment. However, where the borrower is present we inform him — for instance, where he is not farther than a day's journey. And if the purchaser seeks time to go after him, they give him up to thirty days — provided it is to bring out the judgment in its truth, and not to come by crooked ways.

אם רוצה הלוקח לסלק המלוה במעות הרשות בידו וישאר לו הקרקע ויחזור וישאל מהמוכר מה שפרע למלוה בשבילו ואם עשאה אפותיקי מפורש דאמר ליה לא יהיה לך פרעון אלא מזו אינו יכול לסלקו במעות אם קנה שתי שדות זו אחר זו כל אחת במנה והחוב שהיה למלוה על הלוה היה ק"ק וטרף ממנו במנה שדה שקנה ראשון וכשבא לטרוף השניה במנה הנשאר הביא לו ק"ק ואמר ליה אם תרצה שדה ראשונ' שגבית כבר בכל המאתים הרי טוב ואם לאו קח ק"ק והסתלק הדין עמו ואם רצה המלוה וקבלה בק"ק אין הלוקח חוזר על המוכר וגובה ממנו אלא מנה: הגה וי"א דאם עשו ב"ד תחלה שומא והכרזה שוב אין הלוקח יכול לסלקו דשומא לא הדרא ללוקח (טור בשם רבינו יונה והרא"ש) וע"ל סימן ק"ג סעיף ט' וכל זה מיירי בלוקח א' שלקח ב' השדות אבל בב' לוקחין אין השני יכול לומר דיקבל שדה האחד יותר משוויו או לסלקו במעות דלאו בעל דברים דידיה הוא (נ"י פ' מי שהיה נשוי ור' ירוחם):
If the purchaser wishes to remove the lender with money, he has the right, and the land remains his, and he goes back and asks from the seller what he paid the lender on his account. And if the borrower made it an explicit apotiki (a designated security), saying to him, "You shall have no repayment except from this", he cannot remove him with money. If he bought two fields one after the other, each for a maneh, and the debt that the lender had upon the borrower was two hundred, and he seized from him for a maneh the field that he bought first, and when he came to seize the second for the remaining maneh he brought him two hundred and said to him, "If you wish to have the first field, which you already collected, for the whole two hundred, well and good; and if not, take two hundred and withdraw" — the law is with him. And if the lender wished and accepted it for two hundred, the purchaser does not go back against the seller and collect from him except a maneh. Hagah [Rema]: And some say that if the court first made an appraisal and public announcement, the purchaser can no longer remove him, for an appraisal does not revert to a purchaser (Tur in the name of Rabbeinu Yonah and the Rosh); and see above, siman 103, se'if 9. And all this speaks of one purchaser who bought the two fields; but with two purchasers, the second cannot say that he should accept the one field for more than its value, or remove him with money, for he is not the party with whom he has any dealings (Nimukei Yosef, chapter "One who was married", and Rabbeinu Yerucham).
