אין בע"ח טורף מהמשועבדים ממה שקנה. ובו ה סעיפים: אין בעל חוב טורף ממשעבדי אא"כ היו נכסים ללוה בשעה שלוה ומכרם או נתנם אח"כ אבל אם קנאם אחר שלוה ומכרם לא נשתעבדו לבעל חובו ואינו גובה אותם מהלקוחות ומיהו בעודם ביד הלוה גובה מהם אע"פ שקנאם אחר שלוה ואם שעבד נכסיו שקנה ושיקנה אז חל השעבוד גם על מה שיקנה אח"כ ואם קנה אח"כ ומכרו בעל חוב גובה ממנו ודוקא שפירש לו בפירוש אבל אם לא כתב לו דאקנה לא: הגה וי"א כיון דקיי"ל אחריות טעות סופר הוא כל מה שראוי להשתעבד אמרינן ביה טעות סופר ואפי' דאקנה נמי (טור בשם הרא"ש והרשב"א פרק מי שמת) מיהו אם כתב לו מקצת אחריות ולא פירש לו דאקנה י"א דלא אמרינן עוד טעות סופר דהואיל ופירש קצתן מה שכתב כתב ומה שלא כתב לא כתב (נ"י פרק מי שמת) י"א דאף אם כתב לו דאקנה יכול לחזור בו כל זמן שלא קנה (נ"י פ' חזקת הבתים ומרדכי פ' מי שמת) ויש חולקין (כ"כ נ"י שם):

A creditor does not seize from encumbered property what the borrower acquired afterwards; it contains five se'ifim. A creditor does not seize from encumbered property unless the property was the borrower's at the time he borrowed, and he sold it or gave it afterwards; but if he acquired it after he borrowed and sold it, it was not encumbered to his creditor, and he does not collect it from the purchasers. However, while it is in the borrower's hand, he collects from it, even though he acquired it after he borrowed. And if he bound his property that he has acquired and that he will acquire, then the lien takes effect also on what he will acquire afterwards, and if he acquired afterwards and sold it, the creditor collects from it — and specifically where he specified it to him explicitly; but if he did not write de-akni (a clause binding property he would acquire later) for him, no. Hagah [Rema]: And some say that since we hold that liability is a scribe's error, whatever is fit to be encumbered we call a scribe's error, even de-akni too (Tur in the name of the Rosh and the Rashba, chapter "One who died"). However, if he wrote partial liability for him and did not specify de-akni for him, some say that we no longer say it is a scribe's error, for since he specified part, what he wrote he wrote and what he did not write he did not write (Nimukei Yosef, chapter "One who died"). Some say that even if he wrote de-akni for him, he can retract so long as he has not acquired (Nimukei Yosef, chapter "The presumption of houses", and Mordechai, chapter "One who died"); and some disagree (so wrote Nimukei Yosef there).

Se’if 2ב׳

אם לא כתב לו דאקנה ומכר נכסיו אחר שלוה והמלוה בא לטרוף מהלקוחות וטוען שאלו הנכסים היו ביד הלוה ולוקח טוען לאחר שלוה קנה ומכר י"א שעל המלוה להביא ראיה שהיה אלו הנכסים ביד הלוה בשעת הלואה וי"א שאם יש עדים שהלוה קנה קרקע זה ומכרו צריך המלוה להביא עדים שקנאו הלוה קודם שעבודו אבל אם יש עדים שהלוה היה מוחזק בו ושהיה שלו צריך הלוקח להביא ראיה שקנאו הלוה ואימתי קנאו ואם לאו ב"ד מעמידין אותו על חזקתו ונאמר שהיה שלו ושל אבותיו מעולם (ונ"ל דסברא הראשונה עיקר):

If he did not write de-akni for him, and he sold his property after he borrowed, and the lender comes to seize from the purchasers and pleads that this property was in the borrower's hand, and the purchaser pleads that he acquired it after he borrowed and sold it: some say that it is upon the lender to bring proof that this property was in the borrower's hand at the time of the loan; and some say that if there are witnesses that the borrower acquired this land and sold it, the lender must bring witnesses that the borrower acquired it before his lien; but if there are witnesses that the borrower was in possession of it and that it was his, the purchaser must bring proof that the borrower acquired it, and when he acquired it; and if not, the court establishes it on its presumption, and we say that it was his and his fathers' always (and it seems to me that the first view is the main one).

Se’if 3ג׳

נותן נכסיו מהיום ולאחר מיתה ולא נודעו הנכסים שהיו לו באותה שעה י"א שעל המקבל מתנה להביא ראיה שהיו אותם נכסים בידו בשעת מתנה וי"א שאם לא נודע שקנה נכסים אח"כ הכל בחזקת מקבל מתנה (והסברא הראשונה עיקר ועי' לקמן ס"ס ר"נ ובסימן ק"ד כן נ"ל) .

One who gives his property from today and after death, and the property that he had at that time is not known: some say that it is upon the recipient of the gift to bring proof that this property was in his hand at the time of the gift; and some say that if it is not known that he acquired property afterwards, all is in the presumptive possession of the recipient of the gift (and the first view is the main one; and see below, end of siman 250, and in siman 104; so it seems to me).
