Se’if 1א׳

דין מלוה בשטר גובה ממשעבדי והמלוה על פה. ובו כד סעיפים: המלוה את חבירו על פה אינו גובה אלא ממה שימצא ביד הלוה אבל אינו טורף לא מהלקוחות שקנו ממנו ולא ממתנות שנתן אבל מכל מה שימצא בידו גובה בין קרקע בין מטלטלים אפי' קנאם אחר הלואה אבל המלוה בשטר טורף מהלקוחות וממקבלי המתנה שקנו ושקבלו ממנו קרקע אחר הלואה אפי' אם אינו מפורש בשטר כן אבל אם פירש בפירוש שהלוה לו על תנאי שלא יטרוף מהלקוחות ולא ממקבלי מתנה תנאו קיים ואינו טורף מהם.

The law of a loan by document, that it collects from encumbered property; and the loan by word of mouth; it contains twenty-four se'ifim. One who lends to his fellow by word of mouth collects only from what is found in the borrower's hand; but he does not seize, neither from the purchasers who bought from him nor from gifts that he gave. But from all that is found in his hand he collects, whether land or movables, even if he acquired them after the loan. But one who lends by document seizes from the purchasers and from the recipients of gifts who bought and who received land from him after the loan, even if it is not stated so in the document. But if he stated explicitly that he lent to him on condition that he should not seize from the purchasers or from the recipients of gifts, his condition stands, and he does not seize from them.

Se’if 2ב׳

הקדשות הרי הם כמשועבדי' ואין נפרעים מהם כל שיש לו בני חורין אם קדם המכר או המתנה להלואה דבר פשוט הוא שאינו טורף מהם אלא א"כ יש הוכחה שלא נתכוין במכר ומתנה אלא להבריחם מבעל חוב וכמו שנתבאר בסימן צ"ט שהמתנה בטלה ואפי' קדמה להלואה בעל חוב גובה ממנה אפי' אם היא מלוה על פה:

Consecrated things are as encumbered property, and they are not repaid from them so long as he has unencumbered property. If the sale or the gift preceded the loan, it is a plain matter that he does not seize from them, unless there is evidence that he intended by the sale and the gift only to put them beyond the creditor's reach; and it is as was explained in siman 99, that the gift is void, and even though it preceded the loan, the creditor collects from it, even if it is a loan by word of mouth.

Se’if 3ג׳

אם נתנו ללוה מתנה על תנאי שלא תחול עליה שום שעבוד לא חוב ולא כתובה שקדם למתנה ולא יחול עליו להבא התנאי קיים ולא יגבה בעל חוב ממנה אפילו כתב לו דאקנה אבל אם קנה קרקע והתנה עמו המוכר על מנת שלא יחול עליו שום שעבוד אינו מועיל וב"ח (של לוקח) גובה ממנה.

If they gave the borrower a gift on condition that no lien should take effect upon it — neither a debt nor a ketubah (the sum settled upon her in her marriage contract) that preceded the gift, and none should take effect upon it in future — the condition stands, and the creditor does not collect from it, even if he wrote de-akni (a clause binding property he would acquire later) for him. But if he bought land and the seller stipulated with him on condition that no lien should take effect upon it, it does not avail, and the creditor (of the purchaser) collects from it.
