מכריזין על נכסי יתומים. ובו ו סעיפים: כשבאים למכור מנכסי יתומים שמין ב"ד הקרקע ואח"כ מכריזין עליה שלשים יום רצופים ואם אין מכריזין רצופים אלא בכל שני וחמישי יכריזו ס' יום שני וחמישי שבהם ומכריזין בבקר ובערב בשעת הכנסת פועלים ובשעת הוצאת פועלי' (לשון הרמב"ם פי"ג ממלוה ד"ח) וכל מי שירצה לקנות יוליך הפועלי' לבקר לו ובשעה שמכריזין מסיימין את השדה במצרים ומודיעים כמה מוצאי' בה ובכמה שמו אותה ב"ד ומפני מה הם רוצים למכרה אם להגבות לבע"ח או לכתובת אשה ואם יאמר המלוה אני אקבל השדה בלא שומא בפרעון חובי והיורש אומר לא כי אלא ישומו אותה בית דין שומעין ליורש:

They announce the property of orphans; it contains six se'ifim. When they come to sell of the property of orphans, the court appraises the land, and afterwards they announce it for thirty consecutive days; and if they do not announce on consecutive days but on every Monday and Thursday, they announce for sixty days, the Mondays and Thursdays among them. And they announce in the morning and in the evening, at the hour the workers go in and at the hour the workers come out (the language of the Rambam, chapter 13 of the Laws of Lender and Borrower, law 8), so that whoever wishes to buy may take the workers to inspect it for him. And at the time they announce, they specify the field by its boundaries, and make known how much it yields and at how much the court appraised it, and for what reason they wish to sell it — whether to collect for a creditor or for a woman's ketubah (the sum settled upon her in her marriage contract). And if the lender says, "I will accept the field without appraisal in payment of my debt", and the heir says, "Not so; rather, let the court appraise it", they listen to the heir.

כשכותבים האדרכתא על נכסי יתומים בין גדולי' בין קטנים כותבים בה והכרנו שהנכסי' האלו הם של פלו' המת ואם לא כתבו כך הרי האדרכתא זו פסולה ואין אוכלים בה פירות אפי' אחר שישלימו ימי ההכרזה:

When they write the adrachta (a court writ empowering the lender to seize the borrower's property) on the property of orphans, whether adults or minors, they write in it, "And we have recognised that this property is so-and-so's, the deceased's"; and if they did not write so, this adrachta is invalid, and one may not eat produce by it, even after the days of the announcement are completed.

ב"ד שמכרו שלא בהכרזה נעשו כמי שטעו בדבר משנה וחוזרים ומוכרים בהכרזה. הגה י"א דאם מכרו הקרקעות בשעה שאין קונין כגון בשעת מגפה או מלחמה מה שעשו עשוי דאין לב"ד למכור אלא בשעת הגבייה ויש חולקין (ב"י שתי הדיעות) וב"ד שמכרו האחריות על היתומים וב"ד שהכריזוה כראוי ובדקו יפה ודקדקו בשומא אע"פ שטעו ומכרו שוה מנה בק"ק או ק"ק במנה הרי מכרן קיים אבל אם לא בדקו בשומא ולא כתבו אגרת בקורת שהיא דקדוק השומא וההכרז' וטעו והותירו שתות או פחתו שתות מכרן בטל פחות משתות מכרן קיים וכן אם מכרו קרקע בעת שאינם צריכין להכריז עליה (או) במקום שנהגו שלא להכריז לעולם (טור ס"ז) וטעו ופחתו שתות או הותירו שתות מכרן בטל אף ע"פ שהכריזו (ויש אומרים דכיון שהכריזו אע"פ שלא היו צריכים מכרן קיים) (טור בשם הרא"ש) ואם רצו ב"ד שלא לבטל המכר ויחזירו האונאה מחזירין לא יהיה כח הדיוט חמור מהם פחות משתות מכרן קיים והוי מחילה כדין ההדיוט אע"פ שלא הכריזו שאינם צריכי' (הכרזה) באותה העת איזהו העת שאינם צריכים הכרזה כשמוכרים לפרוע למי שהלוה לצורך קבורה או למזון האשה והבנות או ליתן מנת המלך וכן ב"ד שמכרו דברים שאינם טעונים הכרזה וטעו בשתות מכרן בטל פחות משתות מכרן קיים ואלו הם הדברי' שאין מכריזין עליהם העבדים והשטרות והמטלטלי' אלא שמין אותם בב"ד ומוכרים אותם מיד ואם השוק קרוב למדינה מוליכים אותו לשוק:

A court that sold without public announcement has become as those who erred in a matter stated in the Mishnah, and they go back and sell with announcement. Hagah [Rema]: Some say that if they sold the lands at a time when people do not buy — for instance, at a time of plague or of war — what they did is done, for the court has only to sell at the time of collection; and some disagree (Beit Yosef, both opinions). And a court that sold with the liability upon the orphans, and a court that announced it properly, and examined well, and were exact in the appraisal — even though they erred and sold what was worth a maneh for two hundred, or two hundred for a maneh, their sale stands. But if they did not examine the appraisal, and did not write a letter of inspection, which is the exactness of the appraisal and of the announcement, and they erred and added a sixth or took off a sixth, their sale is void; less than a sixth, their sale stands. And likewise, if they sold land at a time when they need not announce it (or) in a place where they were accustomed never to announce (Tur, se'if 7), and they erred and took off a sixth or added a sixth, their sale is void, even though they announced (and some say that since they announced, even though they did not need to, their sale stands) (Tur in the name of the Rosh). And if the court wishes not to void the sale, and they return the overcharge, they return it: let the power of a common person not be stricter than theirs. Less than a sixth, their sale stands, and it is a waiver, as the law of a common person, even though they did not announce, since they did not need (announcement) at that time. Which is the time when they do not need announcement? When they sell to repay one who lent for the needs of burial, or for the food of the wife and the daughters, or to give the king's portion. And likewise a court that sold things that do not require announcement and erred by a sixth — their sale is void; less than a sixth, their sale stands. And these are the things that they do not announce: the slaves, and the documents, and the movables; rather, they appraise them in the court and sell them at once; and if the market is near the city, they take it to the market.
