Se’if 1א׳

מאיזה ענין נפרע מלוה מיורשיו ואיזה שבועה אדם מוריש לבניו. ובו כא סעיפים: מלוה על פה אינה נגבית מהיורשים אלא בא' מג' דרכים ואלו הם כשחייב מודה בהן וצוה בחוליו שיש לפלוני חוב עליו עדיין או שהיתה הלואה לזמן ועדיין לא הגיע הזמן או שנדוהו עד שיתן ומת בנידויו כל אלו גובים מהיורשים בלא שבועה אבל אם באו עדים שהיה אביהם חייב לזה מנה אינו גובה מהיורש כלום שמא פרעו: הגה מיהו אם טענו היתומים לא לוה אבינו מעולם הוי כאלו אמרו לא נפרע החוב ומאחר דאיכא עדים שלוה חייבים לשלם (בה"ת וטור סעיף ל"ג וכמו שיתבאר לקמן סעיף ט"ו סימן זה) וכן אם הוציא כתב יד אביהם שהוא חייב לו אינו גובה בו כלום שמא פרעו (וע"ל סי' ס"ט ס"ה) ואם מת המלוה והיורשים באים לגבות מיורשי הלוה אם היא על אחת מג' דרכים אלו יורשים גובים מהם בלא שבועה אע"פ שמת לוה בחיי מלוה ואם אינה על אחת מג' דרכים אלו אפי' יורשי הלוה אין טוענים כלל אינם גובין מהם דאנן טענינן להו שמא פרע אביהם: הגה ואם הוציאו על רפואות בחליו יש לו דין שאר חוב שאם ידוע כמה הוציאו ושלא נפרעו בחייו נפרעין מן היתומים אבל בלאו הכי אין נפרעין ואשתו אינה נאמנת (תשובת הרא"ש כלל פ"ה סי' ב'):

In what case a lender is repaid from his heirs; and what oath a man bequeaths to his sons; it contains twenty-one se'ifim. A loan by word of mouth is collected from the heirs only in one of three ways, and these are they: when the one who owes admits it and gave instruction in his illness that so-and-so still has a debt upon him; or the loan was for a term and the term had not yet arrived; or they placed him under a ban until he should pay, and he died under his ban. In all these they collect from the heirs without an oath. But if witnesses came that their father owed this man a maneh, he collects nothing from the heir, lest he repaid him. Hagah [Rema]: However, if the orphans pleaded, "Our father never borrowed", it is as though they said the debt was not repaid, and since there are witnesses that he borrowed, they are obliged to pay (Ba'al haTerumot, and Tur, se'if 33; and as will be explained below, se'if 15 of this siman). And likewise, if he produced their father's handwritten note that he owes him, he collects nothing by it, lest he repaid him (and see above, siman 69, se'if 5). And if the lender died and the heirs come to collect from the borrower's heirs: if it is by one of these three ways, the heirs collect from them without an oath, even though the borrower died in the lender's lifetime; and if it is not by one of these three ways, even if the borrower's heirs make no plea at all, they do not collect from them, for we plead for them, "Perhaps their father repaid". Hagah [Rema]: And if they spent on medicines in his illness, it has the law of any other debt: if it is known how much they spent, and that they were not repaid in his lifetime, they are repaid from the orphans; but otherwise they are not repaid; and his wife is not believed (responsum of the Rosh, klal 85, siman 2).

יש מי שאומר שמי שנתחייב ממון בב"ד בעבור מלשינות ומת גובה מהיורשים אבל אם חייבוהו קנס לא קנסו בנו אחריו (ע"ל סימן שפ"ה ס"א):

There is one who says that one who was obliged to pay money by a court on account of informing, and died — it is collected from the heirs; but if they imposed a fine on him, they did not fine his son after him (see below, siman 385, se'if 1).

אין נפרעים מיורשים קטנים בעודם קטנים שאינם בני י"ג שנה שום הלואה מחוב אביהם ואפילו היה עליו שטר מקויים ואפילו היה בו נאמנות ואפי' היה בו כל תנאי שבעולם שמא יש להם ראיה ששוברים בה השטר אלא א"כ היה במלוה זו אחד מג' דרכים הנזכרים לעיל בסמוך (בס"א) ואפילו היתה מלוה על פה גובה מיתומים קטנים בא' מג' דרכים הנזכרים ודהיתה תוך זמן צריך שנתקבל העדות בחיי אביהם שהוא תוך זמן שאם לא כן אין מקבלין עדות על קטן אפילו בפניו ואם הם גדולים והוציא עליהם שטר מקויים אפי' אין שם א' מג' דרכים אלו גובה מהם בלא שבועה אם יש בו נאמנות מפורש שהאמינו עליו ועל יורשיו או על באי כחו שיורשיו בכלל באי כחו אבל אם אין שם כתוב בשטר נאמנות ואפי' כתוב בו נאמנות סתם ולא פירש על יורשיו או על באי כחו צריך לישבע כעין של תורה בנקיטת חפץ וגובה ואפילו תפס משלהם בלא שבועה משביעין ליה ואי לא בעי לאשתבועי דינו כמו שנתבאר בסימן פ"ב (ופ"ז ס"י):

They do not collect from minor heirs, while they are minors who are not thirteen years old, any loan of their father's debt — even if there was a confirmed document upon him, and even if there was a clause of trust (a clause making the lender believed as to non-payment) in it, and even if every condition in the world was in it — lest they have proof with which to break the document; unless this loan was in one of the three ways mentioned just above (in se'if 1). And even if it was a loan by word of mouth, it is collected from minor orphans in one of the three ways mentioned; and as to its being within the term, the testimony must have been received in their father's lifetime that it is within the term, for if not, testimony is not received against a minor even in his presence. And if they are adults, and he produced against them a confirmed document, even if there is none of these three ways, he collects from them without an oath if there is in it an explicit clause of trust — that he trusted him as to himself and his heirs, or as to those who come in his right, for his heirs are included among those who come in his right. But if a clause of trust is not written there in the document — and even if a general clause of trust is written in it and he did not specify "as to his heirs" or "as to those who come in his right" — he must swear in the manner of the Torah's oath, holding a sacred object, and collect. And even if he seized from theirs without an oath, they make him swear; and if he does not wish to swear, his law is as was explained in siman 82 (and 87, se'if 10).
