כופין את היתומים לפרוע חוב אביהם. ובו יב סעיפים: מצוה על היורשים לפרוע חוב אביהם וכופים אותם בכך כמו שכופים את אביהם במה ד"א כשהניח קרקעות אבל אם לא הניח אלא מטלטלים אין כופין אותם לפרוע חוב אביהם מהם אבל מצוה עליהם לפרוע חוב אביהם מהם זהו מן הדין אבל הגאונים תקנו שיהא בעל חוב גובה מהיורשי' מטלטלים שהניח אביהם הילכך האידנא כופין אותם לפרוע חובות אביהם אפילו היא מלוה על פה אף מהמטלטלים שהניח אביהם אפילו קנאם הלוה אחר שלוה ולא כתב דאקני (ע"ל סי' קי"א) דיורש במקום אביו קאי וכן חייבים לפרוע חוב אביהם ממלוה שהיתה לאביהם ביד אחרים בין גבו קרקע בין גבו מעות ואם ירשו קרקע ומטלטלים ואין מפורש בשטר שיגבה מטלטלי בין בחייו בין במותו והיורשי' רוצים להגבות לבע"ח קרקע והוא רוצה לגבות מטלטלים הדין עם היורשים אבל אם לא ירשו כלום מאביהן אין חייבים לפרוע חוב אביהם ואפי' מצוה ליכא: הגה ירש קצת נכסים אין צריך לפרוע רק מה שירש (ריב"ש סי' תע"ח) ואם אומר איני יורש ואיני משלם עיין לקמן ס"ס רע"ח אם שומעין לו:

They compel the orphans to pay their father's debt; it contains twelve se'ifim. It is a mitzvah for the heirs to pay their father's debt, and they are compelled to do so, as their father is compelled. In what case are these words said? When he left lands. But if he left only movables, they are not compelled to pay their father's debt from them; but it is a mitzvah for them to pay their father's debt from them. This is by the letter of the law; but the Geonim enacted that the creditor should collect from the heirs the movables that their father left. Therefore, nowadays they compel them to pay their father's debts — even if it is a loan by word of mouth, even from the movables that their father left, even if the borrower acquired them after he borrowed and did not write de-akni (a clause binding property he would acquire later) (see below, siman 111) — for the heir stands in his father's place. And likewise they are obliged to pay their father's debt from a loan that their father had in the hands of others, whether they collected land or collected money. And if they inherited land and movables, and it is not stated explicitly in the document that he shall collect from movables, whether in his lifetime or after his death, and the heirs wish to have the creditor collect land, and he wishes to collect movables — the law is with the heirs. But if they inherited nothing from their father, they are not obliged to pay their father's debt, and there is not even a mitzvah. Hagah [Rema]: If he inherited some property, he need pay only what he inherited (Rivash, siman 478). And if he says, "I do not inherit and I do not pay", see below, end of siman 278, whether they listen to him.

טען היורש שאביו לא הניח לו ממון ואינו חייב לפרוע חוב אביו משלו אם טוען המלוה ודאי שאביו הורישו ממון נשבע היורש היסת ונפטר ואם טוען שמא אין עליו אלא חרם סתם: הגה כתבו הגהות אשיר"י פרק מי שמת בשם א"ז שכתב בשם רבינו תם ורבינו שמחה ראובן היה חייב לשמעון ומת ראובן יכול שמעון לעכב קבורתו עד שיפרעו לו ואם שמעון הוא קרובו של ראובן בני המשפחה מוחין בידו שלא לעכב קבורתו שלא לנוולו וכן אם בא בעל חוב וגבה כל נכסיו אין מחוייב לקברו:

The heir pleaded that his father left him no money, and that he is not obliged to pay his father's debt from his own: if the lender pleads with certainty that his father left him money, the heir swears the oath of hesset (the oath the Sages imposed on one who denies a claim outright) and is exempt; and if he pleads "perhaps", there is upon him only a general cherem (the severer form of the ban). Hagah [Rema]: Hagahot Asheri, chapter "One who died", wrote in the name of Or Zarua, who wrote in the name of Rabbeinu Tam and Rabbeinu Simchah: Reuven owed Shimon, and Reuven died — Shimon may hold up his burial until they pay him. And if Shimon is a relative of Reuven, the members of the family protest against him, that he not hold up his burial, so as not to disgrace him. And likewise, if a creditor came and collected all his property, he is not obliged to bury him.

Se’if 3ג׳

יורש שמכר כל נכסי אביו ודאי ב"ח טורף הלקוחות אפי' אם יש ביד היורש נכסים קרקעות שלו לפי שנכסיו אינם משועבדים לחוב אביו ואפי' של אביו זיבורית ושלו עידית אינו יכול לסלקו בעידית שלו שלא מדעתו אבל אם רוצה לסלקו שלא יטרוף מהלקוחות ונותן לו מעות אע"פ שלא ירש המעות מאביו יכול לסלקו אא"כ עשה אביו נכסים אלו אפותיקי מפורש לב"ח:

An heir who sold all his father's property: the creditor certainly seizes from the purchasers, even if the heir has lands of his own, since his own property is not encumbered to his father's debt; and even if his father's was the poorest land and his own choice land, he cannot remove him with his own choice land without the creditor's consent. But if he wishes to remove him, so that he will not seize from the purchasers, and gives him money, even though he did not inherit the money from his father, he can remove him — unless his father made this property an explicit apotiki (a designated security) for the creditor.
