Se’if 1א׳
דין הבא ליפרע שלא בפני בעל חובו. ובו ג סעיפים: מלוה שבא ליפרע בשטר מקויים שבידו שלא בפני לוה אם יכולים ב"ד לשלוח לו ולהודיעו עד שיעמוד עמו בדין שולחים ומודיעין לו אם הוא בכדי שילך השליח ויחזור תוך ל' יום והמלוה יתן שכר השליחות ויגבנו נוסף על חובו ואם הוא במקום שאין השליח יכול לילך ולחזור תוך ל' יום מגבין לו חובו מיד אחר שישבע המלוה ויטול בין מהמקרקעי (רשב"א) בין מהמטלטלים ואין חוששין לשובר ואם כתוב בשטר נאמנות בפירוש שאפי' יפרע שלא בפניו או שכתוב בו נאמנות עליו ועל באי כחו אינו צריך לישבע: הגה י"א דאין גובין שלא בפניו רק מלוה עצמו אבל לא מיורשיו אלא צריך לילך אחריהם (ריב"ש סימן שנ"ג) וע' לעיל סי' ע"ג סעיף י' וסימן י"ד סעיף א':
The law of one who comes to be repaid not in the presence of his debtor; it contains three se'ifim. A lender who comes to be repaid with a confirmed document in his hand, not in the presence of the borrower: if the court can send to him and inform him, so that he will stand in judgment with him, they send and inform him — if it is within such a distance that the agent can go and return within thirty days; and the lender pays the agent's fee and collects it in addition to his debt. And if he is in a place to which the agent cannot go and return within thirty days, they collect his debt for him at once, after the lender swears, and he takes, whether from land (the Rashba) or from movables; and they have no concern for a receipt. And if a clause of trust (a clause making the lender believed as to non-payment) is written in the document explicitly, even for where he is repaid not in his presence, or there is written in it a clause of trust upon him and upon those who come in his right, he need not swear. Hagah [Rema]: Some say that they collect not in his presence only from the borrower himself, but not from his heirs; rather, he must go after them (Rivash, siman 353); and see above, siman 73, se'if 10, and siman 14, se'if 1.
Se’if 2ב׳
שלשה ראיות צריך להביא לב"ד ואח"כ יפרע שלא בפניו ראיה ראשונה לקיים שטר שבידו שניה שבעל חובו במדינה אחרת רחוק יותר מכדי שילך השליח ויחזור תוך ל' יום שלישית שאלו הנכסים בחזקת פלוני הלוה הם:
He must bring three proofs to the court, and afterwards he is repaid not in his presence: the first proof, to confirm the document in his hand; the second, that his debtor is in another country, farther than the agent could go and return within thirty days; the third, that this property is in the presumptive possession of so-and-so the borrower.
Se’if 3ג׳
הבא ליפרע שלא בפני לוה כשם שבית דין יכולים לפורעו מנכסיו שלא בפניו כך הם יכולים למשכן לבעל חוב קרקע בחובו שזה יותר טוב לו:
One who comes to be repaid not in the presence of the borrower: just as the court can repay him from his property not in his presence, so they can give the creditor land in pledge for his debt, for this is better for the borrower.
